PAD To Sue PM Abhisit For Causing Territorial Loss To Cambodia

Interesting....if PAD manages to suceed in suing the PM and the precedent is set, may be I can sue the British Royal family for the parts of France they conceded to the Frence,..or the British goverment for giving away India, Aussie etc...:whistling:

The Thai constitution seriously sucks if you are allowed to sue a Member of Parliament. They could not possibly do their job, as intrinsically it involves compromising between opposing views, one of which is likely to take offence at almost any decision.

You can't sue government in the UK (and I suspect royalty also). An individual MP can be prosecuted for a criminal activity (suing is a civil offence activity) - perhaps PAD are playing that card and the reporting is loose.

It is a little more complicated and serious that what you estimated above....

If and when convicted....

the sentence includes beheading or long term imprisonment....

And should it happen in old days, treason includes.... the death sentence which would be carried out for 7 generations to include subsequent off springs.... :o

Thailand is allowing too much of this government pressure tactics. Siripon is right. Throw the reds and the yellows leaders in the same cell and let them settle their differences there. Whatever the result, who cares?!

You seem to have missed all the essences of all the Thai people uproar.... :whistling:

The reds are essentially demanding the return to the era of Tuxsin whence govt is practically above any existing law.... :blink:

The yellows were two years ago demanding the end to Tuxsin govt and its corruption practices on the grandest scale ever....

The yellows are currently demanding that the Thai govt must exercise its sovereignty over its own territorial....

such as, repossessing its territorial temporarily granted thru the request of the UN and the International Red Cross Society et al around 1980, to accommodate the fleeing Cambodian refugees....

the encampment according to old UN and international news paper clippings showed the inscription appearing on those old photographs to have been set up inside Thailand territorial....

The water hole and related washing and cleaning buildings and related activities were recorded to have been erected on Thai soil for the benefits of the Cambodian refugees.... that was around 1980 then....

And now around 2010.... the Cambodian govt and HuSan and the committee of the JBC wish to redistribute those parcels of Thailand territorial to Cambodian for the benefit of setting up a reserve for tourism around PraVeHarn temple....

The former Tuxsin govt and now the current Apisit govt seem not to care one way or the other....

Particularly, when the poor Thai farmers who were the original land owners in those areas with free and clear and unencumbered Warranty Deeds presented their original Warranty Deeds together with the yearly tax receipts to the Apisit govt some two weeks ago....

to answer the Defense minister's charges that he personally had never known nor seen even one warranty deed in those hotly disputed areas.... and if there is any warranty deed surfaced, it is probably hocus bogus copy....

After the official presentation and examination of those Warranty Deeds.... and found to be genuine....

Those farmers were told by the PM Apisit himself.... not to talk to the media and just to return to their northeastern home.... so the govt could do their best to rescue the 7 who were then still in Cambodian prison....

However, a deputy minister and personal close friend of Apisit, SiRiChoke audaciously during a press conference inferred that those old farmers were lapsing in their memory, their warranty deeds really do not cover the land where the UN well and the Cambodian encampment situate....

Whereas another deputy minister, GaSit also proclaimed that Thailand has nothing to lose.... Cambodians are our (Thailand) friends.... and most importantly, he reiterated that....

those parcels of land where former Cambodian refugees settled during the UN rescue mission around 1980 are undoubtedly within Cambodian territory.... since they occupied those parcels of land for a long long time....

the deputy minster, GaSit's official stand appears to be that Thailand has nothing to lose--why bother with such small strips of land....

more over, Thai people ought to look forward to the very near future.... when and where Thailand and Cambodian would join hands in developing an International Natural Reserve to accommodate Farang tourists coming to visit PraVeHarn temple and the surrounding Thailand national natural reserves....

and Thailand will benefit exponentially from the gas and oil exploration in the joint effort with HuSan.... when the JBC finishes the redistribution of Thailand territorial to slightly favor Cambodian and HuSan.... et al....

The yellows if I understood it correctly have already filed and petitioned for a treason trial....

TO STOP THE PROCEEDINGS, THE YELLOWS DEMAND.... :Thaiflag:

1--Apisit immediately declares null and void the MOU43....

2--Apisit immediately withdraws from any and all participation actively or passively with JBC.... declaring null and void any and all previous agreements.... and

3--Apisit must immediately reclaims all Thailand northeastern territorial currently illegally encroached upon by the Camb since 1980.... and sending all the encroaching back to Camb, if necessarily, by force....

What do you think.... DO THE YELLOWS HAVE A VALID CASE TO PURSUE on behalf of all Thai....? :coffee1:

I do believe that individuals can take court-action, and sometimes win, against the UK tax-authorities, HMRC ?

Wonder whether the same principle applies to all those still-existing refugee-camps on the Burmese-border ? If it's merely necessary for them to occupy the land for 25+ years, to legitimise their right to it, and make it part of another country. Would it also have implications for any land-owners/inhabitants of the deep-South states, who might wish to be Malaysian citizens, rather than Thai ?

I doubt that it's quite as simple as the deputy-minister thinks.

In the case of Mae Salong the KMT-refugees still asked the Thai authorities, for permission to stay & develop the land, which was and remains within the Thai border.
