I would just like a general opinion on my situation

Met my Thai girl friend 3 years ago and stayed with her in Thailand for 6 months and she has been to oz on a 3 month and a 6 month tourist visa 2004 / 2005 And late 2005 was regected for the 3rd tourist visa.

We had the Thai buddist wedding ceremony early 2004 and now we will marry legally in Bangkok next week.

She will give birth in September for her first child

And we are thinking of applying for the spouse visa after the birth

Can any one see any problems that may arise with this situation or will it be a text book case and sail through it with minimal fuss.

Depends on why the 3rd torist visa was rejected....

As for a spouse application....your length of relationship and obviously the evidence you have to prove an ongoing relationship shouldnt be a problem, Just need to make sure the rest of the application is up to scratch....

Whether you sail through it or not is in thee hands of the embassy.... :o

The 3rd TV application was reJected because they thought that she had enough visits to Australia in that time frame for holidays

The Official Jargon was a standard answer that went some thing like they didnt think she would return or it didnt satisfy the Embassy that the applicant would work in Australia

I believe it was on a a standard form signd by Gemma Jackson

On both occasions she returned to Thailand before the end of her visa

Unofficially the Staff at the visa centre told her that she could not have a 3rd TV so she should apply for a Spouse visa or a PSV

My wife had one tourist visa. We were married in Bang Rak. Lived in Thailand together for a year have a son. Got his dual citizenship and she just got her visa to come live with me over here.

Originally we were going to stay in BKK but I got a fantastic job offer back in Oz. She applied in December last year and was approved last Monday.

Seems from what you are saying it's genuine so should be no probs. But you never know. Good luck with it.

As your second tourist visa was granted for a six month stay, your third application was rejected because you applied within the same calendar year as the second, or within 12 months of the second visa expiring.

I was stuffed around by this same unwritten rule.

The embassy believes that two, maybe three TV's are sufficient for the purposes of touring Australia. After that, couples should know whether they have a future together and should plan to make their relationship permanent.

Wozza, you should have gathered sufficient evidence by now to prove to the embassy that your relationship is genuine and that she would make an ideal Australian resident.

Put it all together and submit your spouse visa application. From what you have stated in this thread, you shouldn't have any worries. :o

I have read most of your posts on this forum for the last 12 months and have observed the pricless amount of information and support that you have given to our fellow boardmembers trying to settle their loved ones here in Oz.THANKS

I met my wife in May 2004 in Thailand. She visited me for 8 days August 2004 on a 3 month visa (work commitments). Since then she has visited me twice more and also went to Sydney for the Thai Ed Dept for a month March 2005. We married in Oz on her third visit to me (not incl her Sydney trip) in October 2005 in Oz and then applied for visa 12 Dec 2005 in BKK and did the Buddhist ceremony Xmas Day 2005 at her home town. She was granted her spouse visa on March 27th and arrived in Perth on the 31st!

It seems clear now that if we had delayed our marriage any further, she probably would have been refused another TV application. Neither of us were aware of this! PHEW!!!

I agree with MM Wozza. I really can't see any problem with a SV application under your circumstances.

I don't see any issue with your circumstances. The reason for the third TV rejection will probably help your SV. If I recall correctly, I heard something along the lines of when they stop issuing TV's it's time for a SV (this was told to me by a migration agent).
