I went on my visa run last week to find that I was one week too late to extend my 3 month non O visa so I only got the one month extension.Being married to a Thai and living here for two and a half of the last three years I decided to apply for a marriage or retirement visa.We went to Chiangmai immigration and they told my wife that as I already have 400,000 bht all I need is to transfer from the UK another 80,000 and I would qualify for the marriage visa ,which is only 2,000 bht,and I would not have to go on border runs every 3 months. This sounds too good to be true I have previosely been informed;

1) The full amount has to be transfered into thailand with the transfer advice saying it is for visa

2) the bank account cannot be topped up

3)The money has to reside in the thailand bank account for 3 months before I can apply.

Can anyone clarify the rules,as I do not want to transfer 80,000 bht only to be told that I should of transferred more money

John, please ask this Immigration officer if they have looked at National Police Office Order

No. 606/2006 7. 17(5) In case of the applicant who is married to a Thai wife, one of them or both of them need to have the total annual income that is averaged out not less than 40,000 Baht per month. Except for the case that the said foreign national has entered Thailand before this Order is enforced and the foreign national has been permitted to stay in the Kingdom by the result of having married to a Thai wife, then if the applicant does not have the said income, then, the latest 3 months records of the account book of any Bank in Thailand with the account name of either or both parties need to have the amount of money not less than 400,000 Baht.

If this Order that went in full force from the 1st October 2006 and signed by the Commander in Chief of the Royal Thai Police was not for foreigners living in Chiangmai?

I believe there are two items here.

1. Change of visa at 2,000 baht using the old 400k rule. Believe that is what they go by up to Nov 15?

2. Extension of stay after obtaining the visa which will require another 1,900 baht and proof of 40k income.

As for the 80k extra perhaps 3 month rule? 40k each for the two missing months?

It appears I was correct , I and nobody else who read my letter saw the potential problem caused by my non im not being valid

From your first post, and reading between the lines, I did indeed find that you were probably here with no visa but a 30 day entry without visa. That is why I said there would be 2 steps involved. The first one you could meet with the deposit as they are still using the old rules. The second step would require 40k income using the new rules.

I could not understand why you were getting this advice from Immigration about funds, when you did not qualify in the first place. Hence the question to Immigration in Chiamgmai " What is up? "

I wonder if the Chiang Mai Immigration Officer is taking the view that the extra 80,000 Baht makes up a total of 480,000 Baht, which is equivalent to the 40,000 per month income requirement? Not what it says in the National Police Office Order I agree, but wouldn't it be nice if a little leniency was being exercised and an either/or situation being allowed.
