Good day,

we, that is my thai girlfriend want to sell our house what is just 9 month old

to buy land and build something new.

We will not get back what we paid ...

Is there a tax in this case and if, how much and is there

a legal way to avoid to pay ?

Yes there is tax to pay, it is assessed on the value of the property, either the land dept appraisal or your declared selling price, not whether you have made a profit, to calculate how much you can try this link http://www.acuterealty.com/calculator.asp

I think there is an extra tax (around 3%) if you've held the property less than 5 years. The idea is to discourage speculative investments that push land prices up.
