Politicians and academics slam check-and-balance mechanism in draft charter

THAILAND -- Representatives of political parties and political scientists have agreed that check-and-balance mechanism in the draft constitution may pose an obstruction to the performance of duty of the post-election administration.

Speaking at a panel discussion today (Monday) on “How the draft charter regulate the government”, Democrat deputy leader Nipit Intharasombat said that the draft charter and the questions to be asked in the referendum appear to be have been designed to prevent a single party from commanding the majority vote in the parliament.

He said normal mechanism should suffice in monitoring the government.

Pheu Thai core leader Khunying Sudarat Keyuraphan pointed out that the draft charter has given too much powers to the appointed Senate and independent organizations during the five-year transition period.

In the meantime, she said that there is no mechanism to counter-balance the independent organizations nor is there a guarantee that the independent organizations will not be biased.

Other speakers at the panel discussion such as Professor Narumol Thabchumpol of Chulalongkorn University’s faculty of political science and Mr Sirote Klampaibul concurred that cubing the powers of the majority in the parliament was not the right approach to address the problem of lack of good governance of an elected government.

Well, they can start placing friends and relatives in high positions of independent organizations and in the Senate.

They already did that silly.

I'm not interested in the politicians so much, nice to see the academic's on board , one thing we do know is when you have stifled free speech , muzzled the free media, then you have something to hide and indeed the Junta has , it is back to the future retake 1986, the academics saved the day in Thaksin's rewrite, one can sense that while the academic's are sniffing about with this draft charter ,will the Junta leave them alone or all have them arrested ...................................coffee1.gif ,

It is obvious they need re-educating under PM Prayuth's Article 44.

What independent organizations? I think both NACC and EC have been nicely "pacified".

As for the occasional critics, good for them. They have the right to speak out.

Politician's, academics, political science students, activist and the public have all been "invited"(abducted) for attitude adjustments or goaled for criticizing the draft/referendum, so under the junta NO ONE HAS THE RIGHT TO SPEAK OUT.

SO once again junta huggers, The Dems don't like it the Red's don't like it, political sciences don't like it, if you criticize it or point out it's faults you go too gaol,

Tell us here just what is so good about a junta that gaols people for openly talking about this and forcing it upon the people?

So much for western educated people when they support this lot.

Love the term "independent". Perhaps "unaccountable" a better fit? "Here, you elected types go play in the sand box. We independents will go upstairs and make some deals."

I understand what you are saying about rights in Thailand.

My point of view, which is steeped in the philosophy behind the US Bill of Rights, is that every person has certain rights, such as the freedom of assembly and freedom of speech. These rights are not granted by governments; they are intrinsic (some in the US would say, "granted by God", the original word is "inalienable"). The government can exercise its power, suppress our rights, and punish us for exercising our rights, but they cannot take them away.

This is not just semantics. It is a belief at the center of democracy. I think many Thais do not have this belief. Their rights are abrogated and they "grin and bear it". Of course, they are encouraged to think this way, starting with their earliest teaching.

Thailand does not need any political or law check and balance in their (almost triyearly) constitution. Such a thing would upset their Democracy disguised dictatorship..
