What is the score with the work permit expiry date? If it "expires" on a given date (linked to your visa) and you do not have a new visa by that date in order to go to the WP office and have int renewed does it cause a huge problem?

The situation is that a friends visa and wp expire on the 19th of this month. He was due to go on a visa run to get another 90 days on the 16th and see the lawyer etc on the 17th (friday) for the paperwork for the wp renewal. Instead he got caught up with work and is now only managing to go on the visa run on the 19th (sunday). So by the time he gets to apply for the WP renewal on the 20th (monday) it will have expired.

Is this going to cause problems or not? He is a bit worried and his lawyer doesnt work on Saturdays to ask!

I suspect it may be a problem if a work permit is required by the Consulate he plans to visit. If you advise the Consulate involved the experts should be able to advise better.

This can be indeed quite a bit tricky because once a WP is expired it can not be extended but rather everything has to start from the beginning pretty much like a WP has never existed.

Most likely a new WP needs to be applied for means medical certificate, papers of education etc. have to be provided the same way when the previous WP was applied for.

Not letting your WP and/or permit of stay ever expire should therefore have the utmost priority and come first before any other obligations.

he has a multiple entry b so simply needs to exit and leave the country for another 90 days - no worry with the paper work etc for that.

He was told twice to make sure it was done - obviously he didn't quite understand the importance !!

Does anyone know if there is any leeway at all or will he need to redo the whole process again of application etc for the sake of one day?

OK only his permitted to say expires rather than his visa so yes he can return. As the work permit is a local issue only time will tell - but he should go with full paperwork and expect to start over I suspect.

For what it's worth, I can confirm from the boss of the labour dep in Chiang Mai that the work permit has to be renewed before the expiry date, and that it would indeed be required to make a new application if applying for an extension too late.

Make sure you communicate with your local authorities to get a clear picture of what is required, instead of making assumptions. Different offices have different practices, and policies can change without warning.

In BKk and with our legal staff, he would be ok. As the date, the WP expires is on a day the Labor Dept is closed. Clients have been allowed to submit for the revalidation on the next day, the Labor Dept reopens.

i have told him to be at the lawyers office as they are opening on Monday. Hopefully as the 19th was a Sunday he might get away with turning up at the Labour office one day late on the 20th.

As you say though its probably down to luck with the actual "officer" that is dealt with when he gets there. If he does have to do the whole process again is was a very expensive extra two days work!
