UK PM Burnham Halts Early Prison Release Plan

Andy Burnham has announced a pause to a scheme that would have allowed thousands of prisoners in England and Wales to be released earlier than planned, with eligibility depending on the type of sentence and how much of it had been served.

The decision follows criticism from survivors and victims’ families, including the widow of Thames Valley Police officer Andrew Harper, who was killed in 2019. Lissie Harper said the prospect of the men who killed her husband being freed early was “deplorable”, as the plan faced renewed scrutiny ahead of its planned implementation.

Pause agreed after victim backlash

Under the Sentencing Act, due to take effect in September, some offenders would have been moved out of custody at earlier points to help ease pressure on prisons. Justice Secretary Alex Norris said the pause was intended to “give victims and survivors certainty” and ensure the government “got the implementation of this policy right”.

Norris said a review would also examine what information had been provided to victims and survivors as part of the early release process. Burnham earlier said no prisoners would be released “under this policy” until an urgent review was completed and measures were taken to “minimise risk to the public”, adding that changes would be made where needed.

The BBC understands the scheme would have resulted in around 700 prisoners being released early in September.

Norris said the government had heard concerns from victims and survivors and from people across the country about implementation of parts of the Sentencing Act. He said one element needing to be handled properly was the information given to victims before release decisions were made.

He refused to say why concerns had not been raised when the Sentencing Act was introduced but said Burnham was “quite right” to review the policy.

How early release would have worked

The scheme was designed to apply in stages from September and would have shifted release dates for prisoners serving fixed terms. Offenders due to be released after 50% of a standard fixed sentence would have been eligible after serving 33%, with the remainder served in the community under monitoring. If an offender offended again, they could be returned to prison. For those serving fixed sentences for serious sexual and violent offences, the planned change would have moved release from 66% of the sentence to 50%.

The most serious categories, including life prisoners and those subject to extended monitoring, would not have been included.

Norris said Burnham was pausing the policy to ensure implementation is correct, rather than abandoning the act entirely. He said he hoped to provide victims with “certainty as soon as we can”.

Victims’ Commissioner Claire Waxman welcomed the pause, calling the original version of the early release plan “the wrong course of action”. She said many victims had already been told offenders who harmed them could be released early, leaving them with “renewed fear and uncertainty”, and argued victims should have safety and confidence prioritised.

Reactions and timetable

The pause comes after letters were sent to victims in recent weeks warning them the early release scheme was due to begin in September. Kemi Badenoch, leader of the Conservative Party, said she welcomed the pause but called for killers and rapists to be “permanently” exempt from any future version, describing the policy as “dangerous” in a post on X.

Jade Belgrove, a survivor of sexual assault campaigning against the scheme, said receiving a letter informing her attacker might be released early was “horrific” and described relief at the pause.

Steve Gillan, general secretary of prison officers’ union POA, said he understood concerns about “operational stability” but said the government was correct to pause early releases to ensure “adequate public protection” and to put victims first.

Prison officers also reacted, with one telling the BBC that prisons were “super overcrowded” and warning that if releases do not proceed in September, capacity could become critical by November. Another said the pause showed the government was “putting public safety first”.

In 2024, the Labour government announced separate and temporary emergency measures to release some prisoners early to ease overcrowding.

Yeah, absolutely. Just as sickening as the previous governments who utterly failed to manage these issues, leading to the absolute shambles that is happening now. Reform UK's policy on this looks good on paper, but I have absolutely zero confidence in them moving what's on paper into reality. To be fair, I have zero confidence in all politicians. I'll be very happy to be proven wrong of course.

2 of the violent criminals in jail for the manslaughter of PC Harper are scheduled for early release after just 6 years. His family have expressed their outrage about this. His family are what are referred to as the victims of a horrific crime which is why it made the news. The MPs responsible for the moronic solution of letting criminals out early were laughing about the early release of criminals. It is obviously linked.

The MPs are allowed to be callous and laugh in the face of the victims of this horrible crime if that is their desire. You are entitled to support their joy at this if you so wish even if the victims of these brutal crimes are outraged and scared of their impending release. But neither you nor the MPs get to dictate what can be shown on a non BBC news channel even if it does reveal how utterly moronic these people are.

To suggest that the ministers' conversation is related specifically to the case of PC Harper's murderers is ridiculous. Neither you nor GB News have any evidence to support that assertion.

I have reservations about the scope of this early release scheme and would not like to see PC Harper's killers released before they have served their full sentence. However, if the early release of non-violent petty criminals or, for example, someone guilty of fraud means that there is more room to lock-up violent criminals then I can see the sense in that.

Your anti-Labour bias is clear. Burnham could find a cure for cancer and you'd probably complain that he hadn't found one for dementia.

Has Burnham found a cure for cancer? No, he has not. So I judge him and his clown show on what they have or have not done as he did not put himself up for scrutiny before being "elected" as PM. He is currently wasting taxpayer money on turning his circus of clowns into a traveling circus of clowns which was not in any manifesto. When the country is in such significant debt I would prefer not to see a PM without a mandate frittering away taxpayer money so he can work from home. It irks me.

Two violent criminals involved in the murder of a police officer were due for early release; two ministers were overheard joking about the appointment of a judge and the early release scheme; therefore the ministers were joking about the murder of PC Harper! You have absolutely no evidence that the ministers were joking about the murderers of PC Harper and yet you persist in pushing that line as though it was fact. And you accuse me of being obtuse!

Burnham has been in power for 5 DAYS and you already expect him to have found solutions for all the UK's problems. You will not even give Burnham the opportunity to succeed and even if he does, you will insist he's a failure. Your anti-Labour bias is clear and obvious.

You seem to think that the killers of PC Harper being released as part of the early release scheme is not related at all to Labour MPs laughing about prisoners being released early as part of this very same early release scheme. Letting murderers out early is the equivalent of spitting in the face of the family of their victim, especially when there are plenty of alternative options which the stupid Labour MPs do not seem to have even considered. Who cares if prisons are overcrowded? The Bangkok Hilton has communal cells that can accommodate 40-50 people. Is it comfortable for the inhabitants? Probably not. Is it avoidable? Nobody ever talked about that. The plan was to let nonviolent prisoners serve 33% of their sentences--sounds about right to me. Those who have committed crimes of violence would serve their sentences under the law with whatever prison regulations such as good time the only reduction. What do you see wrong with that?

Imprisonment is only intended to effect separation from family & community, not vengeance. And, let's face it, there's zero rehabilitation provided.

I do agree with you about foreign criminals. Would you consider deportation adequate punishment for their crime? There are Mutual Legal Assistance Treaties in place with 110 countries worldwide. What that means is that UK prisoners transferred will serve a sentence applicable under the citizenship country's laws.

This is not a quick process! In Thailand, for example, drug prisoners getting 35 or 50 years would prefer a life or death sentence. If a fixed term, they must serve 8 years before transfer. With a life sentence, 4. Return to Canada not only cuts the term (our life sentences are 25 years) but, of course, housing in much softer prisons, including conjugal visits.

Mahmoud and Streeting were stupid enough to allow themselves to be caught on tape but, once again, there is no evidence to suggest that they were laughing about the murder of PC Harper and/or the early release of his killers. GB News implied that there was a connection which was distasteful to say the least, but no surprise given that their anti-Labour bias is as marked as yours.

I have already stated that I have reservations about the scheme - especially the early release of violent criminals - and I don't doubt that many Labour MPs feel the same way. Nevertheless, until we build new correction facilities, the government needs to consider how best to deal with overcrowding in prisons, which is why the early release of non-violent criminals e.g. petty thieves, fraudsters, etc might be an option as it will free up space.

Of course Burnham was planning this coup for a lot longer than 5 days, but planning a coup and running the country are two completely, separate and different tasks. What were you expecting the timeline to be? Day 1: Become PM, Day 2: Have government in place, Day 3: Confirm budget, Day 4: Develop individual departmental plans, Day 5: Implement individual departmental plans, Day 6: Announce that all the UK's problems are solved.

If so, maybe you can give Burnham's government one more day before announcing that they have failed.

If someone is given a 3 year sentence they should serve exactly 3 years. Not a single day less. The only way I would possibly allow early release of non violent criminals is if they showed remorse, financially compensated the victims to at least the level they stole and the victims expressly agreed to the early release.

Again, I don't understand how you can conclude that I believe that early release is the only option open to government. I stated that is an option worth consideration; no more, no less than that.

Releasing those on remand who are awaiting trial for non violent crimes seems like a good idea.
