    Exactly,, but thinking back after the fact,, once they had my 10,000baht,, And I kept insisting on blowing,, they were trying to make it clear to me,, that they already had a result for me,,, and that if I pressed it,, they WOULD be able to produce a receipt from an official machine,, showing "I blew" whatever they wanted me to blow,,, .05+

    I too have been stopped by the BiB in Bangkok (as a passenger in a Taxi), they were riding pillion down a quite soi, saw me in the back of the Taxi and requested the taxi to pull over where they request my Passport. I recognized the money scam for precisely what it was. 

     

    Thus, if you have lived here for a decent amount of time, have a healthy balanced opinion and do not carry too much paranoia against the Police (in this case) then its safe to assume that your experience can recognizes something for what it is....  Its would seem to be one of those unbelievable events - the sort of unbelievable event which occurs more often than we believe it could !!!

     

    Perhaps the only 'get out' in this situation is to have reliable and connected friends who can deal with these situations at the time... 

     

    A good Thai friend told me sometime later, after my illegal stop,,  the BEST thing/things you can carry in a wallet in BKK, are a biz card of a higher up cop, and a biz card of a well known good lawyer in BKK,, Unless you're really screwing up,, he said those 2 items will get you out of most any BS stop and rob by the BIB.... lol

    Which ever way the law looks at it, you refused a Breathalyzer test and were considered guilty by the BiB on scene. 

     

    The BiB then wrongly refused you your rights to take the test at the station, I'd agree that by this stage they were only interested in extorting $$$.

     

    Question: Can you recognize a Lieutenant or above by his uniform in the RTP ? 

     

    I find it extremely difficult, especially at a check point with no lighting and especially as there is usually a handful of guys one usually sat down out of the way, so unless I were to check each single Police Officer I could never be certain if there were a senior officer present or not. 

     

     

     Ya, it was NOT a roadside wand, etc,, the tube was held on with a piece of silver duct tape or such,, I stated in another post,, I've been stopped before, at a legally set up, drunk driving stop prior,, so I knew when there were no barracades, lights, desk/table, normal "grunts" yanking people off the road,, it was NOT a legal stop,, So I wanted to blow at the station,, assuming they'd just give up if I made them deal with me and not get the results they wanted at the station,,

    The first machine offered the 'Wand' does not require any contact, it simply measures the alcohol levels in the 'ambient' breath. 

    The idea that the mouthpiece has been reused by numerous people without being sanitized is simply paranoid conjecture with no basis in fact, the 'punching a series of buttons' idea is equally paranoid...

     

    I am no fan of the BiB in Thailand, but I find many of these comments way off balance. 

     

    Ultimately the question which needs to be answered: Has anyone given a Positive Breathalyzer result and been charged when they have not had one single alcoholic drink ?

     

     Read my post #12,,, Their result, from the "official" machine in the station,, showed that, "I" blew a .01,,, I NEVER blew,, someone else did,, They knew 10,000Baht was a "safe" bet, other than sending me to court with someone else's results,, Why run the risk of THEM getting caught in their scam, when they already had a sure 10,000,,, Biz as usual,,, I've blown at a roadside stop before,, an official, legal one, had my girl with me also,, I had NO problem blowing for them as I had not had a drink at all,, and they showed me the device, zero'd it, My girl mentioned to them to change the mouthpiece as it appeard used,, they had to look for a fresh one,,, So on that occasion,, I had zero problem complying with them,, Is EXACTLY why I knew enough to refuse to blow in the stop I related in post #12 a FAKE roadside device,,,

    Because of his refusal to take the test he was guilty of DUI. His friend paid 10,000 Baht to get him out. 

    He then insisted on taking the Breathalyzer test in an attempt to get the 10,000 baht back. Too late, he'd already paid his fine... I'm sure he felt his rights were violated, Ultimately he had it coming after giving up his rights when breaking the law and refusing to offer a breathalyzer sample. 

     

    20/20 hindsight is lovely, but in this case I'm sure a simple breathalyzer sample would have seen him on his way in mere seconds instead of a self-created drama and a shuyte load of hassle for his friends and GF. 

     No,, I refused to blow into a calculator with a plastic tube taped to it,, I INSISTED on blowing at the station, in a at least REAL breathalizer machine,, they weren't interested in enforcing drunk driving laws, ONLY extorting $$$, with and illegal road block, (no proper lights, no senior officer on scene, etc), improper/fake field testing device, and NOT getting a positive result from the actual machine in the station,,,

    BS,, he WANTED them to blood test, Blowing into a POS machine, with most likely a used mouthpiece from possibly NUMEROUS other people, and punching a series of buttons to show a result,, is THE oldest BS the BIB use to EXTORT funds...

About 2 years ago,, I was riding my scooter to the Tesco on Soi 71 off of Sukhumvit Rd, there were NO lights, anything to indicate a legal stop, only 2 lanes, 1 blocked by cars, down to 1 lane,, So I slowed way down, almost a walking pace while proceeding thru, The cops literally jumped out from between 2 of the cars parked, blocking the far left lane, and grabbed my arm nearly pulling me off the scooter,, They immedietly shoved a, "breath machine" into my face, insisting I blow,, I'd had NOTHING to drink, but when I looked at it, it appeared to be something like a simple calculator with a plastic tube taped on the top, Honestly, (which means after blowing into it, they could've typed ANY number into it they wanted) I refused each time they insisted I blew into it,, saying,  "I will blow at the station",,  After several of these back and forth, they cuffed me, took me in, hung out in a cell, for about an hour,, I assumed waiting to blow into the "official" machine there,,,  I called my girlfriend, she spoke with them on the phone,, then told me they will let you go in the morning,, Shortly after, a friend I'd called came to pick me up, had already paid the BT10,000 fine they insisted on, (He thought he was helping me out of course),,, I told them "NO, I want to blow here!" They refused to allow me to blow, and would NOT refund the 10,000 Baht "fine",, they said I had to sign a receipt for the fine,, reading it I realized it was a computer print out, with my name at the top, and a breath alcohol level of .01,, The copper said with a smile, "You seem ok guy, so I only give you .01",,, So SOMEONE else there, had blown FOR me, I refused to sign it and demanded they return the fine if they wouldn't allow me to blow legally,,, They then claimed, "If you don't sign, you will stay here, and go to the court in the morning" So better you didn't blow, as they have NO evidence as to wether you'd been drinking or not,, But that doesn't mean they still won't stitch you up in court,, I'd wait them out, IF they're bent, they'll most likely get tired of screwing with you, and release you,, OR do what they did to me,, create a blow machine result with your name on it,, and want a "fine",,,

    We're on a website, that is for, and about expats living in Thailand,, I didn't feel the need to either change my keyboard to Thai, or figure out the correct combination of keys, or the need to specifically spell out the word Baht.. I assumed most here would be able to know exactly what I meant, No, it's not a lot of money,, but as several have stated,, I myself, would rather travel with a smaller amount, and draw out in Thai Baht, the funds I need AFTER I arrive...

    From the OP description,, it sounded like the IO was almost willing to let him take care of it, but just didn't trust him to return,, simplest is to have a friend bring the $,, unless it's impossible for someone in detention to have any outside contact...

    Or quite possible that I trusted my local PO when they said,  "No need, keep this shipping paper",,, when I asked about it,,,  Are you aware of a different Customs department, that the Thai Post goes thru, as opposed to one that DHL, Fed-EX, UPS goes through?... I'm not,, and as I stated, I received it through Thai Post, and paid a $1600 Baht import tax,,However coming through Fed-Ex, is was $300,000,,, Google is your friend,,, there's several threads out there, stating exactly as I've done,,,

The only carrier I have used in Thailand that has either not issued a LARGE import tax, or at least a reasonable one,, is Thai Post,, all the other shippers, Thai customs will NAIL you on import taxes,, EVEN if you supply them with an accurate, honest invoice as to the items actual value,, they are thieves,,, I had a watch I returned to the sender for repair, After repair, the sender used Fed-Ex to return it to me, They included a receipt for the repairs, and what was done,, Thai Customs hit me with a HUGE import tax for it because they claimed it was undervalued,, $300,000 Baht import tax,,,, it was accurately declared, I included a retail price for it, a copy of my invoice, from receiving it originally thru Thai Post, with the Thai post's import tax on it I had paid,, as well as an original receipt from Thai post when I shipped it back to the supplier to be repaired, with the declared value on the receipt when I shipped it back, proving to them that it was already in Thailand, and was a personally owned item, They only saw $$$ and wanted it,,, I had to go back to the Customs department at Swampy 4 times, to argue it, they kept lowering the amount, I asked if I refused it, would it be sent back?, they claimed that it would NEVER be returned, to the sender, at first, that it would be destroyed, So I said I wanted to watch them destroy it, or proof of it being destroyed as in a smashed up watch,, because I KNEW it would end up on the wrist of a Thai customs agent otherwise, and told them that,,, They then claimed it would be returned to the shipper, I asked for a receipt to PROVE it had been shipped back, so I could provide that to the shipper, "No, can not do" So I asked how could I be SURE it would either be destroyed, or returned, I only got sheepish smiles from them, On the 4th trip to Swampy, I took my Thai wife with me,, SHE ended up getting into a slightly heated argument with them over it,, She ended up getting them to drop the imported value down to the amount that I had paid when it was shipped thru Thai Post,,  $1600 Baht,, which even then was wrong, as it had already been paid the 1st time,, ONLY use Thai Post, EMS when shipping items in,,, 

  14. I guess i could go koh chang immigration on Friday. So how many days fine and how much per day am I looking at (I'll try arguing first that I've been in their system as PENDING since 16th)?

    You can only do the 90 day report at the office where you obtained the extension of stay.

    The fine for late reporting is usually 2000Bht with a max of 5000 Bht.

    That's incorrect,, I got my retirement extension in Bangkok in Feb,, I just last week did my 90 days report in Bueng Kan

A friend who was in Asok earlier, about 5-6ish,, messaged me that there were many, MANY cops, many on, as he described, "big" motorcycles, as opposed to the normal 2 to a scooter,, All located, (from what he could tell) in the area mainly between say, Soi's 13-21ish, He also mentioned he noticed them having what he called, "some sort of meeting/gathering", in the Robinsons/Terminal 21 front area. I stayed in tonight, so am only going on what he told me. Was anyone else there that can confirm, knows what was going on?
