  1. Hi

     

    About a week or two ago there was some weather warnings about storms and high waves around Koh Samui. Is the bad weather gone now and there's no no storms or high waves etc. forecasted for the next week? 

     

    Some weather sites says rain is forecasted a few days a week but is it actually raining a few days a week right now?

    What's the closest temple to Thong Lor where locals go to practice meditation, mantra, daily ceremonies etc? Not looking for the tourist temples but a temple for locals. Found a few large beautiful ones near China Town but it's a bit far from Thong Lor.

    There are some information boxes on the online form where there is no red star to indicate that the information is necessary to submit.
     

    These are things such as Given Name, Middle Name, Stay Visa Expiry, Building Name / Owner Name, and Phone No. 

     

    Even though it may seem that some of these boxes of information are not required, if you don't fill in every box, then there is a chance they will reject your online submission. 
     

    So it is best to fill in every single box when completing the online application. 

     

    Otherwise, yes, you will have to go to CW to do it in person. But you can book an appointment online in advance to save time waiting in the queue when you arrive:

    It's the first time for this visa. But I've used the website for TM47s in prior years. Maybe that's not enough? 

     

    Did they move the TM47 applications to the main government building/immigration in CW again? They used to have TM47 in temporary locations nearby before.

    Almost 3 months ago I got my 1 year marriage extension approved and at the same time I got a 90 day notification paper stamped into my passport. It says I gotta do my next TM47 filing on 13 March. 

     

    https://tm47.immigration.go.th/tm47/#/login - Tried to file here on the website but I'm getting rejected. Only comment provided is "Please contact the nearest Immigration Office in person immediately."

     

    I'm still living on the same address as last time and it's the same as my TM30. All info is correct. 

     

    Any idea why it's getting rejected? 

     

    If I gotta go in person, where do you do that in Bangkok nowadays? Would prefer not to have to go all the way to Chaeng Watthana again. 

  5. If you're a Thai tax resident and you have crypto investments in a foreign crypto exchange. You then earn income/capital gains on these foreign crypto investments while being a Thai tax resident, but, you never transfer that foreign income into Thailand, do you have any tax obligations on that income in Thailand? 

     

    On the one hand this post says that you do not pay any tax on foreign income that is never brough into Thailand. But, then it also says that it doesn't matter if you bring your foreign income into Thailand or not, as long as you earned the foreign income while being a Thai tax resident you need to tax it in Thailand. Maybe someone could clarify? 

  6. If you're a Thai tax resident by staying here 180+ days a year and you earn foreign income (such as capital gains on crypto) that you never transfer to Thailand, do you still need to pay income tax on that income in Thailand?  


    For example: If you generate income (capital gains) from crypto investments from a foreign crypto exchange and you transfer those profits to a foreign bank account. You then never transfer or use that money in Thailand, would you have any tax liability for such foreign income in Thailand? 

     

    I assume no. But that would mean you can legally pay 0 in taxes on capital gains because my home country in Europe wouldn't tax it either as I'm a tax resident of Thailand. This would still make Thailand a really beneficial country from a tax perspective.

    That information is probably contained in the Common Reporting Standard that both nations have signed up to so of course the Thai government will know.  Whether they do anything about it is another matter.

    It wouldn't matter though since Thailand doesn't tax foreign income like capital gains from crypto and stocks if it's never remitted into Thailand.

    1. My home country in Europe taxes its residents on worldwide income no matter if the income is brought into the country or not. Does Thailand also do this? If I for example become a Thai tax resident by staying here 180+ days in 2024, and, I then realize for example $100K in profits from US stocks and crypto investments in 2024, but, I never transfer this money into Thailand. Should I still pay tax on this foreign income in Thailand? Not sure if the new rules starting this year affects this? 

     

    2. Since Thailand do tax income that is brought into the country. Would it be legal to make a loan agreement with a family member and then that family member transfers money directly to my Thai bank account and I then pay back the zero/low interest loan to my family member over a few months? Would that be a legal and tax free way to basically bring in as much money as you want into Thailand? I'm thinking that this might be a solution to people with foreign sourced income to still bring money into Thailand tax free and still not pay any income tax.

  9. As a Thai tax resident, do you pay income tax on foreign sourced income even if you never transfer that money into Thailand? My home country in Europe taxes worldwide income no matter if it's remitted to my country or not. But not sure about Thailand. 

     

    Example: If you are a Thai tax resident in 2024 and let's say you earn $100K in stock profits in the US stock market during 2024. If you never remit any of those profits into Thailand, do you still need to pay any tax on those capital gains?

    In my home country in Scandinavia, you are liable for capital gains tax for up to 10 years for assets (such as stocks) that you acquired while having been a tax resident there. Even if you move and become a tax resident of a new country. This is to prevent people from acquiring assets and then move to a tax haven and pay little to no taxes. 

     

    My question is: Does Thailand have something similar? So, if I purchase for example US stocks while being a Thai tax resident, I then move and become a tax resident of another country, would I still be liable to pay future capital gains taxes on the stocks I acquired while having been a Thai tax resident?

    Me (Scandinavian) and my wife (Thai) is getting a divorce. We lived in the USA for a few years and got married there but now we both live in Thailand where our marriage has been registered since a few years back. We have no kids or properties. The only assets we have is savings and stock investments but those have always been kept completely separate. Though almost all of those assets were acquired during our marriage. The plan is not to split or share any of our assets. Got a few questions about this: 

     

    1. Do we need a lawyer to get divorced? Or do we just go to the amphur with one witness each? 

    2. When we go to the amphur and sign the documents they give us, does that mean that we do not split any assets and we both keep what we own? I'm worried that I'll sign something that gives her right to any of my assets. 

    3. I'm about to start a new business and make some new investments. After the divorce is done, I guess I'm safe that she would not be entitled to any interest in that? 

    4. Anything else to think about or any other advice about this? It's my first time getting a divorce (and hopefully last :). 

     

    Abroad

    5. I'm not a US citizen or green card holder etc. and neither is my wife. Is there any point in somehow registering the divorce in the US? 

    6. The marriage is not registered in my home country in Scandinavia and I haven't lived there for many years. I guess there's nothing I need to do there in regards to the divorce? 

    7. Will this Thai divorce and its documents be recognized in most other countries as a valid divorce?

    Prior to 2024, a lot people who lived and worked in Thailand had foreign investments such as US stocks and ETFs. To legally pay no tax in Thailand they wouldn't remit any income or capital gains to Thailand from such foreign investments until the year after it was earned. However, with the new rules starting in 2024 this wont work anymore as Thai tax residents will be taxed on worldwide income regardless whether it was remitted to Thailand in the following year it was earned. 

     

    As a Thai tax resident and someone who's working in Thailand, will there still be a fully legal way to continue to pay no taxes on income and capital gains from your foreign investments? For example by setting up an offshore company. If someone could explain how that would work that would be very helpful.

    For your extension you can apply anytime.

    Most apply up to 30 days early in case there is an issue. 

     

    Thank you. I guess the 1 year extension is added on the last day of the non-imm O visa as opposed to on the day I applied for the extension?

    I entered Thailand on a 30 days visa exemption, then got a 60 day extension to visit my wife and now I've applied for the 3 months non-imm O visa based on marriage. In a few days I will have been here for 90 days but the immigration officer at CW said that I didn't need to do a 90 day report yet. She said that I only need to do it when I've got my 1 year extension (marriage). I asked her twice to confirm and she did, very confidently. 

     

    Is this correct? If so, am I supposed to do it 90 days after I've received the 1 year marriage extension?
