  1. Given the OP stated catagorically he intends working in Thailand can we state catagorically he needs a WP ?

    But the thing is there is clarity, there is a list of occupations a foreigner cant do under any circumstances and there is a recently published list of circumstances where a WP is not needed..... couple that with the standing rules that one needs a work permit to work in Thailand which further states where one is paid or even if one gets paid has no bearing on the defintion of work

    It seems to me the intent is pretty clear in my opinion of course

    The other thing that needs to be addressed about not being able to get a WP for on line work ....yes one could if one set up a Thai limited company, and in fact know someone who has done exactly this and the core on line business has nothing to do with Thailand big difference between "cant" and "wont "

    I honestly don't think we can categorically state that, no - we have no guarantee that what the OP personally considers to be 'work' would also be considered 'work' for the purpose of Thai legislation by a judge. It might be, but it might not.

    I'm not really sure where you're going with the occupation list comment, it doesn't really cover anything pertaining to remote work that I can see - http://www.thailawonline.com/en/others/labour-law/forbidden-occupations-for-foreigners-jobs.html - nor does the 'list of circumstances where a WP is not needed' cover every other possible activity. I don't think we can infer that any other activity is allowed or disallowed just because it does not appear on either list.

    In regard the the WP for online work - yes by virtue of a Thai Ltd co and a lot of bureaucracy everyone 'can', the question remains whether they 'need', and I don't think anyone here can accurately determine that.

    Per your second paragraph where i am going is this, they have published a list stating which activites dont require a WP, we also have a list which prohibits certain activites for foreigners, given the list was published in 2015 and the DOL will be fully aware of people working on line,

    can we suggest seeing as on line work is not on that list, this suggests a work permit is required, as if it wasnt they would have put on line work on that list wouldnt they ?

    so everything what is not on the list is work and require a work permit?

    strange logic ....

    opening a door in a shoping center for a nice woman, painting your room,

    changing your light, changing your oil in your car/ motorbike,

    fixing your flat TV at your wall,

    pick up your son at school, driving your neighbour to the doctor, take the menu from the bar in restaurant, changing money for a friend,

    and millions other things, all not in list, so by your logic, everybody is working 24 hour in Thailand illegal because all activities are not on the list but

    for many people it means a paid job, painter, taxidriver, handy man, security guard, waitress, bank clerk

  2. That is the whole point - unless you are employed by a Thai company and paid by them in Thailand you don't need a WP.

    If you are 100% employed outside of Thailand and paid 100% outside of Thailand, you are not working here, even if living here.

    Because again how can they stop you answering work emails and replying whilst on holiday? They can't.

    Being paid is irrelevant. You could work for free while in Thailand but you still need the right visa and a work permit.

    The OP is not someone on "holiday". He is talking about being resident here and working. Big difference.

    I am with 8 other foreigners in the parents board of an international school, we meet twice a month, we doing differnet projects, like fairs, sportsday,

    partys, selling food aso,

    so you really dont want to say that we are working and we need a work permit?

    Right, so think we're in agreement that there is no legal distinction between whether or not an activity is 'work' regardless of the length of stay and visa status of the individual in question.

    Thai law simply says 'working is working' so therefore what is 'work' for someone who stays in Thailand for 5 years must logically also be 'work' for someone who stays for 5 days,

    1 - If someone stays in Thailand for 5 days and spends 10 minutes a day dealing with business related emails, are they working?

    2 - If someone stays in Thailand for 5 years and spends 8 hours a day dealing with business related emails, are they working?

    3 - If the answers to 1 and 2 differ, why is that and upon what legal basis?

    Your questions are irrelevant to the OP.

    He has claimed himself that he will be "working" and living in Thailand. The only question is whether or not he needs a work permit. We can all agree that if he was working for a Thai company he would need the right visa and work permit. The relevant question is does working for a foreign employer exclude him from Thai labour law. In my opinion and with advice from Thai authorities it doesn't.

    I believe a senior immigration officer did go public and say that someone on holiday can "work" at their business while on holiday in Thailand. If you or anyone else want to argue with the Labour department about what constitutes a genuine holiday I wish you the very best of luck.

    there is no work permit what can be issued for such a work,

    no country can give a work permit for work outside their territory!

    your work must only fit the law and the conditions in the country where your work is for,

    if you write a book in your condo, then IMO can you arrest?

    if you paint a picture in your condo and somebody outside Thailand offers you to buy it, you get arrested?

    if you write a blog about anything on a webpage and you get money from google adds, you get arrested?

    if you make a video of your cat on your condo balcony, you put it on youtube and you are lucky and you get 100.000.000 likes

    and a lot of money from youtube, you are working and you get arested?

    NEVER EVER!!

    Simple. It's illegal.

    • You cannot work in Thailand without a work permit and you cannot get a work permit for the work you describe.
    • If you truly want the answer then don't listen to anything posted here and go along to your local Labour Office. Ask them the same question. You won't like the answer.
    • The Labour Department is the only authority that can give you permission to work.

    It is not as simple as you think. If that was that simple, I would not have any problem with it.

    If you really need to know, Chiang Mai immigration is a nightmare. You need to line up about 6am to be serviced on that day. If you lucky enough, you will be serviced, but you need to spend there all day long.

    Unfortunately, I am not retired yet. I work Monday to Friday so if I want to go there, I will have to take day off.

    So this is the deal - spending all day from early morning hours in crowdy and hot office, missing a day at work which I will have to make up later on, to pay 2000 baht fine. Great. No thanks ! I will pay that fine on the next chance, for example when going abroad.

    I am not a criminal by not doing my 90 days reporting. I missed out something that I have done before about 10 times always on time. I have valid visa for staying in Thailand so please don't make me a criminal.

    he missed the 90 days report, this is nothing big, you not get arested the only punishment is 2000 Baht to 5000 baht maximum,

    nothing else, so it is normal that a person think about make it sense to make a 90 days report now with all hasle or wait, because you have the fine anyway and

    nothing else will happend, the extension is valid. the same stiation like you stay longer than the stamp in your passport allows you and you think about paying 1900 baht for extension and spent 15 hours in IMO or pay the fine at the border, this not make anybody a criminal !!

    there are Millions of more nice architecture places in Europe, in CM (and I live here) there is no control about

    buildings, using plastic in signs, building materials, building styles, every marketplace in Europe is better maintained, than Thapai Gate or North Gate, sorry even I love CM but from Unesco World Heritage CM is more off than Paris from CM

I've lived in both, would only ever come to Bangkok for work or transit, Chiang Mai, a city of 2 million people surrounded by mountains and jungle within ten minutes drive of the city centre is a hundred times better, with easy access to Laos, Myanmar and Cambodia. Just have to get used to Chinese tourists!

    i dont know where you got 2 Million people from may be 800.000 in the city and this is already calculate 40 km around,

    but CM is the only city to live and work in Thailand, great night life, many concerts, festivals, 90.000 female students all around, cheap flights to Phuket, Krabi, Samui, Macao, Bkk, Hatyai, aso,

    if you are not looking for young bargirls, CM is the only option, with 100000 baht you will be the king of night life and live in a pool villa

  8. As others have said, get parental consent witnessed at the amphur if you want to leave the country with the children. At the airport they can ask you for this.

    But another point that has been raised is that you might not be the legal parent of the children. see:

    I would advise to sort that out first and maybe even try to get sole parental rights. Otherwise the mother can ask the children back from you at any moment.

    He is the leagal father, he doesnt need any paper from anybody, the kids are British citizen and can leave thailand whenever they want,

    before writing nonsense here and scarring other people better be quite and dont talk if you dont know the law,

    british passport means that one of the parents is british, and that the have he surname means there must be a british birth certificate also,

    to get a passport for a kid both parents have to sign the application!

    kids are british and can leave the country whenever they want, there is no law or possibility to deny this!

    daily travel more than 5000 kids out of thailand with 1 parent only, never ever anybody will be ask for a permission.

    if they have a thai passport with different names on it, of course the IMO should check and ask about the status of the adult, but if you can show that you are a parent than there will happend nothing.

    Only a court order can stop a perent from traveling with his kids, nothing else!

  9. i just rent a house in the center with bar & café downstairs and apartment upstairs, the former owner told me

    he paid 2x 1000 baht to the police, he never had any problem in 2 years, police warm if there is a raid about closing hours, if a problem with customers you have a telefon number to call and police will solve it, we open in 5 weeks after reconstruction, so i will see who will come to collect, all papers, licenses, permissions are up to date and correct.

  10. While these things stated in the original post may in 'substance' be accurate, the fact that they exist is not necessarily a 'problem.'

    The laws are made for Thais. Perhaps they don't see these issues as 'problems.' Perhaps they see them as their government protecting them from foreign influence, foreign invasion of business, and foreign incursion of their culture.

    Perhaps the problem isn't the problem. Perhaps the problem is 'your' attitude about these conditions.

    self confidence and education, may be they could learn a little bit more to support the community, foreign influence is a good thing in every country all over the world, where would USA, Australia, UK, Europe be without fereign influence,

    All Thailand is foreign made, show me anything what is older than 700 years in Thailand,

    show me a building older than 250 years and still funktionable,

    show me a company who made it up to be a leader in the world, or lets say in the first 50 in the world in his subject?

    Thailand need so much help and influence to change the country that every Thai person has a real chance in his life.

  13. If people would get the proper visa there would not be any problems. Thai Immigration knows what it is doing. It is those who try to be smarter than the system that get caught eventually. They get advice from people who do not have the slightest idea what they are talking about when it comes to immigration law. If I want advice on Immigration law I would go to Thai Immigration not thaivisa.com. Some do know what they are talking about but most do not. If you follow the law good things happen. If you do not be ready to pay the price ether in cash or time in the monkey house it is up to you. Some here on TV.com will give you great advice others will get you into more problems than most can handle If you drive a BMW you do not ask people at the Proton dealership for their advice when you have a problem with your vehicle. .

    if you would read carefully the OP lives in Cambodia so I guess he has a workpermit or/and a 1 year Visa,

    so why he should go to a Thai embassy and pay for a Visa if he want to visit the neighbour country Thailand for 4 to 7 days?

    As from 1.1.15 as ASEAN starts this problem should be in the past. They cant stop people from neighbour countrys entering Thailand

  14. It's not about race. And certainly has nothing to do with age. It's about tax dollars. Public facilities like the Korat Zoo are paid for with tax dollars. Thai tax dollars. If you're able to show a work permit or sometimes just a non-B, you can pay the Thai rate at those facilities. Usually. Every once in a while you get a ticket vendor that's not familiar with that policy...

    so your oppinion is if thais travel to other country they have to pay 5 tiems more for trains, museums, zoos hospitals because its built by goverment tax??

    any average tourists who stays in thailand pay more tax than 50% of thai in 1 year, they not pay income tax because income too low, an average tourist spent more money that 50% of Thais earn per anno,

    so with your logic they should get all services for free

  15. I am okay with tourists paying more than citizens.

    Cracks me up when guys that spend more on coffee than a lot of Thais earn squeak about having to pay a little more for something.

    If you can't afford to travel stay home.

    The adult price for a foreigner at Korat Zoo is 150 baht. This I can tell you is bloody good value, the Zoo is excellent and on top of that there is a fantastic swimming complex. I often spend a day there with my 7 year old daughter. If it's good value I do not worry about two tier pricing.

    so you would liek to pay also a higher price for our electric, water, internet, telefon bill ????

  16. OP, I'm against the 2 tier prices also.

    But I have to accept it, as it is also happening in my country and other countries I have been.

    Recently, after obtaining the Yellow book, I pay Thai prices.

    But to make a statement that they are racists because of that, it's out of order.

    It's just an attempt to increase their revenues from people that they believe that can afford to pay more.

    As I said before, Thais are not racists, but they do envy foreigners earning more money than them and can have a better life.

  17. I think in "most" of these places it's effectively a discounted Resident's Price and Non-Resident's Price. Pretty much the same as happens all over the planet.

    this is no discount for US Americans, it is a discount for peopel living near,

    but we talking about 5 or 10 times higher prices for non thais, this is a big different
