For now, the law regarding taxation of worldwide income is just a draft. for the time being we have to pay tax if we stay in Thailand more than 180 days a year and only on the money we bring into Thailand. My question is: a. on the Thai tax return form there is no space to fill in the amount that you have already paid (double taxation agreement) b. If you were able to state the amount that has already been paid in the tax form, this would be a completely different result in calculating tax than if you were to fill in the tax form without including what you have already paid. If there is a treaty and you have already paid tax but you only get the official documents later in the year how is this treated? Do you either pay the full amount first or can you only claim it back later in the year when you get the official documents from your home country? If I am considered as a tax resident, I also expect to be treated equally and not have to pay double prices in a park or be charged a foreigner price in a hospital.

Thailand to tax residents’ foreign income irrespective of remittance
matta01 replied to snoop1130's topic in Thailand News
My eldest son (50% Thai) has a PhD in political and social sciences and international development. He would provide a detailed explanation upon your request. There are numerous examples in Thai law(s) that can be interpreted in many different ways. I laughingly call it the Constitution of Thailand: It is not what you know, but who you know. I have lived here as a retiree for more than a decade. The first time I applied for my annual extension there was no problem. The second time this was not the case. I have since left the task to my Thai wife and watch it from a distance, never had any problems. When I see some people it bothers me, to be honest, I don't participate in brown envelopes or I don't prostitute myself here, everyone does what they want, of course.Personally, I don't think it is possible for people to announce something and then let everything take its course. If we only look at this forum, we see hundreds of messages, perhaps not all accurate or correct, but posted with good intentions (most of them anyway) by falangs very little or nothing from the Thai side. You can also interpret it this way: there is a lot to do for tourists who are accepted without a visa or the ban on alcohol is given up because they are not allowed to lack anything. However, people, pensioners who also contribute here, are simply ignored -
Thailand to tax residents’ foreign income irrespective of remittance

1 You are not obliged to look everything up yourself (there are people that not have a pc) 2 As a "democratic & developed country" one would at least expect that if something changes, such as in this case with tax rules, that information will at least be provided that is accurate 3 If one looks at the "educational and fantastic" information that one can watch on television, then this is also possible. 4. However, in Thailand people are "specialists" in the field of information but in a negative sense. 5. If one only has to know (or smell) "from oneself" what has changed or new, you will be surprised that many people say this is not for me. Even if you take it to heart, no one knows how the DTA will work (it's not a state secret after all) this are a few points -
Thailand to tax residents’ foreign income irrespective of remittance
matta01 replied to snoop1130's topic in Thailand News
It is only this year that Thailand has defined what a tax resident is in fact. Only this year we know that we are considered tax residents if we stay here more than 180 days. Personally, I note how and in what way a tax office is operated in this case and let me say do not compare it with a Western country. -
Thailand to tax residents’ foreign income irrespective of remittance

Many laws and rules are open to different interpretations. One says that as a tax resident you must file a tax return. Two says that you are not obliged to bring money into Thailand this year. And so there are numerous contradictions. As long as the "official" source itself does not provide information, I don't think there is any need to speculate -

Thailand to tax residents’ foreign income irrespective of remittance

Unfortunately, I do not belong to the group of elite pensioners, but the proclamation of tax measures in this case has meant that several Thai people such as the elderly or orphans and others no longer receive money or support from some of these pensioners as they now react completely differently and they say we do not know also what awaits us. That is the result , it is very unfortunate but it is the reality. -

You are not obliged to bring money into Thailand in 2024. How you are going to file a tax return? Proclaim something is one thing. Converting it into a "workable" system in practice is something else. Not thinking before they start is a common mistake here -

In my opinion, the system of taxing money you bring into Thailand is not "workable", so I think that in the future they will switch to a tax on global income. In less than six months one should at least have clear information and guidance. Therefore, if the Thai services are not concerned about it, neither am I -

If there is no room whatsoever to place the amount of tax already paid on a Thai tax return, how does one calculate the tax? A) suppose you bring 1,000,000 THB into Thailand you deduct the deductions as follows: 60,000 THB + 190,000 THB + 100,000 THB remains 650,000 THB you then calculate according to the tax brackets. First tax bracket no tax , second tax bracket is 5% and so on... Thus, on the 650,000 THB you need to pay 27,000 baht according to the rules. However, now you can say I have already paid 80,000 baht tax in my home country result: here you must pay 27.000 THB minus 80.000 THB that you has pay this means you do not pay tax or B) you bring 1,000,000 THB into Thailand you deduct the deductions 60,000 THB + 190,000 THB + 100,000 THB + the 80,000 THB that you have already paid in your home country remains 570.000 THB you then calculate the tax brackets, first tax bracket has no tax, second 5% and so on result you pay 19,500 THB tax

Regarding the meeting between French and Thai authorities, the point of discussion was Article 18 of the DTA, where the Thai services cited an English version stating that the tax could be claimed by France and Thailand on the one hand. The French-language treaty states that only the state that pays the pension can claim the tax. ( only one word is the problem " maybe") The French recognize and are not aware of an English-language treaty. This English copy is therefore not signed There is only a French and Thai treaty that has been signed. Question for Mike If one has paid tax on, for example, a pension, in which section should this be stated on the tax return and can you therefore adjust the document accordingly?

a. The time: In Thailand, the declaration must be made in the first quarter of the year. The figures (such as how much tax people have paid on their income in their home country) are only available in the third quarter. b. The documents: Which documents must be presented and will be accepted as proof that one has already paid tax in one's home country? What if they are only available in the third quarter? c. If you transfer money to Thailand, to your Thai wife's account in Thailand (you are not required to have a bank account) is this money considered a gift?
