Sounds like you had the wrong lawyer. The deception matter would have to be filed in a separate procedure and court case, not in family court. Any good lawyer would know that.

For a serious solution (if OP has such a phobia about the birds) he should set off a few loud fireworks or other noise several times a day for a few days. The birds will soon learn to stay away from that area and rest some where else in future.
