  2. For those who may have QROPS pensions, I believe the UK chancellor is opening up flexible drawdown, as it has stated the 70% rule to provide pension is being abolished, we will know more in the DEC 5 statement

     

    It may need the local legislation also be amended as well so may not happen for a while, but think it is coming

     

    Anyone have any views

    Seems there are many conflicting views so do the report and you are then 100% safe, remember you can do it a few days early

    From my research so long as you stay outside the country, probably no, however if step onto Thai soil you could probably  be nailed, the jails in Thailand are not even rated in Trip adviser, and no doubt to be avoided !  !  !

     

    Maybe your embassy might give better advice

     

    Also you would find no forum or newspaper here in Thailand that would  knowingly carry the story

     

    I am not a lawyer or legal adviser but I doubt any court in the UK would grant extradition even if one were found guilty in their absence, well I hope not, but gain better not to put it to the test

     

    It would seem to me these laws have a lot in common with the laws that protect the Royal Family

     

    My strong views are do not try or push your luck, just enjoy the good things of which there are many and keep your head down

    Again if Thai Visa allowed this no doubt they could also be sued

     

    But moving on many of us post on some of the travel sites, like Agoda, Trip Adviser,etc bases outside Thailand,if I apply the laws and rules of Thailand and were to post some negative comments, on sites naming the hotel or restaurant, like bedbugs in the beds or rats running through the kitchens and dining room one could expose oneself to a case of defamation, if living in Thailand

     

    These overseas sites want name and shame

     

    If I buy from say Lazarda in Thailand and review a product adversely I could open myself to a defamation claim, and claim for using the internet adversely 

     

    Be aware this law protects the crooks and unscrupulous

  6. Just for the record, in no way am I suggesting using the shame and name tactics, or the internet to be defamatory, about anyone or any organisation whatsoever

     

    I am also aware that these rules/laws relate to foreign forums as well if one wants to live peacefully here, there are many foreign journalists who could risk many things, if they ever came to Thailand as a result of what they may have written in overseas publications

     

    What is considered normally acceptable in the UK or USA, is governed by different laws and rules here

     

    I believe I am pretty well aware of the dangers of such actions, I am also not stupid or irresponsible

     

    I am however interested in acquiring more knowledge, like how can under these restrictions, newspapers report things properly, and maybe the answer its they can not

     

    I choose to live here and do my best to abide by the laws of the country, as I advise all people so to do

     

    I have been advised I have an an extremely strong negligence claim, but as I investigate and learn more, I am beginning to come to the opinion, that pursuing it here, would be longwinded, ( like5/7 yrs, ) could be dangerous, and despite the fact that some substantial monies are involved, just not worth the effort or added stress, sometimes first loss is best loss.

     

    I do however keep an open mind, on my course of action, my potential claim has ten months before it becomes time expired, I do not like the rules but I fully accept them and will abide by them

  7. I am hapily retired living with my wife in Northern Thailand, I also choose to live here and believe those who constantly complain are free to leave

     

    Maybe by the nature of my topic this will soon be censored, and if so well OK

     

    I am to some extent aware of how dangerous it might be to write or say something bad about someone or a hospital here, and am seeking information

     

    How do the newspapers get round these laws

     

    If you shame and name, and can prove in court you are factually correct what can happen to you

     

    If you were to say, hypothetically, to publish facts that demonstrated gross negligence and name the persons and doctors involved, but give no opinion, and allow the readers to come to their own conclusion , and say nothing bad, what would happen then, you could also say you were publishing to let others see how good the hospital was !!

     

    A few years ago I had a lawyer who is not registered with any of the Thai regulatory bodies he gets round this by employing Thai registered  lawyers, I suggested a document that his firm drew up, was maybe not properly registered, he got mad at me, I suggested naming him on the internet, he then threatened me with defamation laws.

     

    I decided I was lucky to have seen this side of him, and withdrew, as when I was dead he would probably not treat my wife well, so I found a new lawyer

     

    I then decided to complain to his regulatory body, but he was registered no where, either in Thailand or outside

     

    We also know the value of human life is low here, and need to be careful, I often jokingly liken living in Thailand to the Wild West 200 years ago, which is my perception as a whacky man!!

     

    Some of these things need changing so I believe, and comments on this controversial topic would be appreciated

     

    I am a happy contented foreigner living and contributing to the economy substantially here

     

  8. I have bought online from eBay in Hong kong, Ali express and Alibaba in China , they all give guarantees and refunds in event of non delivery

     

    Paypal also gives same protection

     

    UK credit cards will give some protection as well

     

    Generally shopping on line is a lifesaver if living in Issan

  10. I have a substantial charity acting on my behalf, and since I have a terminal illness I have been advised they can not sell the debt, and the charity is in the process of getting the lender to confirm they will not sell the debt

     

    My lender is a a large stock exchange listed , company ; so will likely have to abide by the rules and guidelines

    I have no Uk assets whatsoever, except my government pension, I have been advised this is safe, but who knows?

  11. I have a situation where it is possible a lender may get judgement against me in the UK, which I do not like but is not threatening my humble existence in Thailand

     

    Does anyone have any experience of this.

     

    If it were enforceable in Thailand does anyone  know what the consequences might be

     

    Any help or input appreciated

    I too have lloyds IOM premier account, it also gives free international transfers, it has my Thai address on it and I have a visa debit card on it, so long as I maintain min bal 2500 there are no charges, and lost int at todays rates is minimal, also gives free travel ins to age 75

     

    A couple of years ago I made the account joint with the Thai wife, took awhile but achieved without too much difficulty, no certified copies originals of some Thai bills they translated internally, being joint it will avoid IOM probate

     

    I complained 2/3 times and was probably given around 200 pounds back to compensate for their mistakes

     

    One of the more reasonable banks in todays environment

     

    Remember banks do not like to lend the money in the beginning, they do not like if you repay early, and do not like if you repay late

     

    I just do not like banks

     

     

  13. yes pay pal is expensive on the exchange

     

    however on some sites like Agoda you can chose your currency of billing, if you chose your Paypal base currency then Paypal does not penalise you, some time you can buy on eBay in base currency as well

     

    the guarantee Paypal give is with some of the cost, due to using Paypal on some 200/300 purchases over the last 2/3 years, I have never lost out and Paypal have refunded me several times for non delivery or faulty goods

  15. SLOW DOWN BEFORE GOING FROM FRYING PAN TO FIRE

     

    Some observations, we have maid 6 days a week, and pay 300Batt a day (8Hrs), and she is happy with money Issan

     

    1000 for two hours work very generous, two hrs massage for me and 1000 batt gets very good results! !

     

    So she has been with you six yrs maybe talk to her and see if it can be stopped, she will not easily get 1000 for two hours

     

    Maybe better the one you know, than do not know, she will hopefully be more wary

     

    I also believe we have a duty not to place temptation, in front of people, like cash for people with little or even lots of money

     

    In future limit your loss by what you leave available !!

  16. I have had both types of extension, and yes retirement is quicker and easier, I have just renewed marriage extension at KhonKaen

     

    I choose marriage extension, because I believe the immigration rules here in Thailand could change at any time

     

    I believe the marriage extension is safer than the retirement, and less likely to be changed, and even if changed;if you already have; you will probably be grandfathered into the new one, on existing terms, it also demonstrates a greater commitment than a retirement extension

     

    I personally feel we are very much tolerated, rather than wanted, by the nation as a whole

     

    In the majority of the rest of the world if married we would have far greater rights than we are granted here in Thailand

     

    There are also totally separate rules for  women married to Thai  men , which many say is discrimination

    Which rules is more the question

     

    I have yet to see a definitive list of exactly what is required, if immigration produced one it would make both the offices and the customers life so much easier

     

    Page one is the list and you tick off each item, if you do not have them old OK no extension, but at least we are not bobby trapped at the end, which has happened to me many times. despite being very careful to see I have everything correctly completed

  18. Remember we live in Thailand, and most as is the case with myself choose to be here

     

    We all know the rules appear to vary from time to time

     

    I did the income route this year and it backfired because I only showed 37, 000 per month, currently I am awaiting new letter from embassy as I have another pension I did not include

     

    I consider I was very stupid not to have remained with the 400,000 in a bank account in my sole name for two months, IT is the simplest way

     

    Next year I will take from my wife's accounts 400,000 and put it in an account in my name, after  extension approved transfer back to wife's name, ( all monies in my wife's accounts come from me)

  19. This is thailand, remember, I have dual USA/UK and both these countries say very strongly you MUST enter on the countries own passport if you have one

     

    Of course coming to Thailand you need to depart on the same as you arrive

     

    IF and only if you have two passports and the same rules apply as in the UK or USA, then you would have to use the thai passport to enter Thailand
