Delays continue to beset defendants in appeal of Koh Tao murder conviction

Featured Replies

Thai prosecutors have continued efforts to delay their filing of a rebuttal to an appeal submitted by the legal team of two Burmese defendants in a high-profile, trans-national murder case that has dragged on for more than three years.

The prosecutorial team has requested six extensions as of 22 February, the latest coming last week. The Burmese defendants Zaw Lin and Win Zaw Tun are currently being held at a prison in Bangkok, accused of the murder of two British backpackers on the Thai island of Koh Tao in September 2014.

Aung Myo Thant, a legal adviser at the Burmese Embassy in Bangkok, told DVB: “We, the defendants’ legal team, have submitted the appeal. Thailand’s supreme court has been awaiting a response to the appeal from the prosecution team in order to hand down a verdict.

It is not hard to work out why there is a delay by the prosecutors. The Supreme court has highly intelligent  and experienced Judges who are able to properly assess evidence and can see discrepancies, contradictory evidence and spurious conclusions. It is very difficult to defend a case that is based on bullshit to such people. The prosecutors will be having a very tough time trying to refute some of the glaring holes in the case.

Shouldn't that be 'appellants' and 'convicted of' ?

how many more delays will they allow ?

According to a member of the Burmese legal team, this could go on for a long time.  It's worth noting that the Defence was only allowed 5 extensions until they had to submit their Appeal in August last year.

Yes, but probably something got lost in translation.  The article was in a Burmese publication after all.
