I thought that Non-B still continues to exist when work permit expires because you have already paid for your visa.

I asked one question to different people, and got 5 different scenarios.

NonB cancelled when work permit is cancelled.

1. Work permit expired. (has one year single entry nonb visa). Went to immigration to ask. Upon declaring and showing her receipt of cancelled work permit. She was fined of everstaying from the day the permit was cancelled.

NonB continues

2. Has one year M-entry visa. Went to the 90-day appearance with application form. Work permit has already expired before. No receipt of cancellation showed to immigration. His visa is accepted and stamped for next 90 days.

*If NobB is designed to depend on Permit, why did immigration didnt require permit upon the ninety-day appearance?

NonB continues

3. Has single entry nonB visa, work permit cancelled prior nonB's expiration. Example: Work permit expired on Jan 14, Visa is set to expire on Feb1. Goes to Cambodia... exits and successfully completed the visa-run without any penalty.

NonB cancelled when work permit is cancelled.

4. A person with expired permit but existing visa(based on passport) consulted a legal adviser. Adviser says, the person's got to exit a..s.a.p. because visa is cancelled when permit is cancelled. (but the person does not have any clue when the permit was cancelled)

I want to know what is the real deal. The real Law. Is there any variation of stamps and has different considerations? or are all Non-B's are the same? I know most people just get passed the immigration without being penalized because of immigration's "not-knowing" the real status of an individual.

you appear to have the bull by the tail , so to speak

your work permit is tied to your visa NOT the other way around

This is correct. In this case the work permit expired, it must be the same date that the extension of stay based on business expires. Hence she is overstayed not because the wp expired but her visa had expired. It was not “cancelled ,“ it expired.
NonB continues

This is correct. They did not have a extension of stay based on business. They had a multi entry visa. This visa was obtained at an Embassy/ Consulate and is not tied to the work permit. If you get the extension of stay based on business at Immigration inside Thailand, it is tied to the work permit.

NonB continues

3. Has single entry nonB visa, work permit cancelled prior nonB's expiration. Example: Work permit expired on Jan 14, Visa is set to expire on Feb1. Goes to Cambodia... exits and successfully completed the visa-run without any penalty.

Correct. They never applied for the extension of stay based on business. Hence no problem
NonB cancelled when work permit is cancelled.

Correct if the "visa" is an extension of stay based on business.

The key is if someone has the extension of stay based on business. If they do, they have 7 days to leave when the work permit is cxl or simply get another type of extension( retirement, marriage, visit Thai child, education) in that 7 day period.

Multi's & singles are completely different. Also, it depends on what job you are doing, what you are employed as.

Bsaically, you need at least a single entry to apply for a W/P. You can then apply/ pay for a 1yr permit or go every 3months to pay & renew before the exp. date. If your visa is extended for 1yr because ov employment/ W/P, then as soon as you cease your employment, you have 7-10days to leave the country or find a new job, and don't forget to inform immigration.

When you leave your employment don't forget to get 'Dtor Tor Sip (10) from your employer. This is very important, unless you like hassle with the authorities. You need this when you begin & end employment.

Correction:

Work permit was cancelled.

(has one year single entry nonb visa). Went to immigration to ask. Upon declaring and showing her receipt of cancelled work permit. She was fined of everstaying from the day the permit was cancelled, but her nonBvisa stamps permits her to stay upto 9 months more.

Correct, with one exception, she should of been fined 7 days after the work permit was cancelled. Not the day it was cancelled.

Her extension of stay was tied to her work permit, ( even though the permit had 9 months left)

This also goes for the husband, parents and kids if they are a dependent on this extension of stay based on business. Everyone is fined, 7 days after the work permit is cxled unless they get a different type of visa or leave the Country.
