- I am a United States citizen.

- I am 49.999 years old, I will be 50 "eleven" days past renewal date.

- I have lived in Thailand since 1996.

- My visa is a non-imm "B".

- I have had "yearly" visa renewals since 1997.

- I am married to a Thai since 1993.

- My visa is stamped "Thai Wife" (since 2002).

- We have three children, all borne here in Thailand, ages 6, 4 and 1.

- I have a "Treaty of Amity" independent (sole) proprietor business.

- It was established in 1997.

- I maintain my own work permit.

- I meet the income requirements of 40,000 baht a month.

- My wife's yearly income is over 1 million baht.

- I pay Thai taxes, using Phor Ngor Dor.90 (per the revenue dept).

- My wife pays Thai taxes, using Phor Ngor Dor.90.

- I and my wife have seperate bank accounts, no joint account.

- I can "not" show 400K baht in bank for previous 3 months.

- My wife can "not" show 400K baht in bank for previous 3 months.

- Together, we can show 400K baht in bank the previous 3 months.

In summary...

- I am "grandfathered" in.

- I meet household income requirements

- I am 11 days "short" of being 50.

Per Police Order 606/2006...

Considering paragraph 7.17, 7.18 and 7.19, criteria (5) of each,

"shall be not younger than 50 years old".

This seems to exclude me.

There is no other "paragraph" I fit into.

I must file the renewal on Feb 28, next Wednesday.

How do I maintain my 1 year visa

If you have 400k in your bank account believe you can continue with that method. Do not believe they will require 3 months if you say you did not know about the rule change in time. There is no age requirement.

You obviously meet the new requirements of 40k family income so can change to that if they do balk at the above. You do not need to be 50 years old.

I did not know about the changes until a week ago, thanks thaivisa. The floods from October thru December played havoc and cost us in repairs. This is causing "heart-squeezing" concerns. There is so much at stake. It angers me to see the "no under 50". Totally Asinine.

I would feel the same way if I was 50 or older.

You'll not have any problem at all, just use Lopburi3 advise.

I don't expect they will make a problem that your 400K was divided over 2 accounts as long as both accounts together had 400K during 3 months.

The 50 years limit is only be a big problem for the families not being grandfathered and that don't have a 40K income.

Honestly, I also don't understand why a Thai girl with an average family income (<40K) has no right to live in Thailand with her husband if her husband is young (<50), while she would have not have much problems if she would have married an older guy (they could use 800K on bank account).

Sorry didn't respond sooner. Our office was very busy today and I just didn't get a chance till now.

You should have any problem with the visa extension as you meet the 40K per month salary. I understand you do not have the 400K funds in the bank but that’s ok. Sorry to hear the flood problem you had this past year. Hope life is getting better for you.

Surely you know you qualify on several levels for an extension it would seem you are transferring some sort of personal issue to Thai immigration.

Correct, I can not 400K in the bank for 3 months

but "we" can show a combined bank balance of >400k.

We do -not- want to use our bank account balances.

We "only" want to use our monthly incomes.

using the supporting documents of:

- both of our tax 90 forms and receipts

- I do not have pay slips,

my income is an average of my yearly income (tax form 90)

- the wifes previous 3~4 months pay slips

- a "status letter" from wifes employer.

The reason for not wanting to use "funds in bank":

- we cannot touch our funds during the renewal process.

We need access to all of our funds.

We do not want them locked up for 30~60 days.

I am unsure as to

- what documents to give them

- what documents "not" to give them

- what to say if they request them.

Would you please offer some insight into this.

Possibly a minor point, but I will ask...

At the bottom of TM7, I see "reasons for extension"...

they have always wanted me to write "support thai wife".

I saw the topic (#90642), where Maestro replied (post#36).

Should I continue to write:

"to support my Thai wife and children"

or is this better:

“To live with my Thai wife and children,

in accordance with paragraph 7.17,

of the Order of the

Royal Thai Police Headquarters No. 606/2549”.

**note I left out the verbage "clause 5" as I am just short of 50.
