BANGKOK, Nov4 (TNA) – Mongkolkit Suksintaranont, list MP of the Thai Civilized Party, together with nine party members asked the Supreme Administrative Court to overthrow the cabinet’s decision to allow foreigners to acquire land in the country.

 

The group opposed the resolution of the cabinet which on Oct 25 approved the Interior Ministry’s regulations to allow wealthy foreigners to buy land to attract foreign investment to the country. They sought the court’s injunction against the resolution pending its ruling on the policy.

Fine. THEN every Thai who owns land and property offshore, MUST sell it off at the price they paid and return the money to Thailand.

At last a news article which calls the new rules by the correct name, ie a Regulation of the Ministry of the Interior. Other articles called it a law or an edict or perhaps some other incorrect names.

 

The law, ie The Land Act, and Ministeral Regulations as required by the law have existed for decades.

 

The law also states that every individual application by a foreigner to purchase land must be approved by the Minister. This means that even when an application meets all requirements stipulated in the Ministerial Regulation, the Minister still has the authority to disapprove the application.

I hope the court agrees with them. It is much safer for foreigners NOT to buy land here... as long as foreigners are discriminated  just as double pricing, named as alien or falang, and don't get the same rights as the Thai people it is not wise to buy land...

Think they’re mostly worried about the Chinese nicking everything, Pib. Which is fair enough. Though in principle, it’s a bit of a pss take. Rich Thais own a fair amount of land and property in my country, which has certainly helped to hoik up prices.

This whole 'foreigner land-buy scam' is 100% aimed at the Chinese anyway.

 

No-one (no normal people anyway) in their right mind would "invest" 40 million baht to buy 1 rai of land.

It would not surprise me to know that Thai's own enough land in the USA to cover Bangkok Proper.

My Thai teacher, bless her soul, taught me a few basics some 40 years ago. 

The shorter the name (first and family name) is, the more likely they are real Thai. The more syllables in a name, the more Chinese ethnic roots. Latter overran Thailand in the 20th century, last not least after China's Long March recalibration, to immigrate to Thailand where the locals had (and some even today) had no clue! 

If you ask me, Mongkolkit Suksintaranont's name has its fair share of syllables ....... and hence could be yet another prime representative of the latest immigrants two, three generations ago who do NOT want anyone else to spit into their soup! Dinosaurs 'r us? 

Even in China non-locals can buy property and have done so to the prosperity of themselves as well as to the People's Republic of China - your call! 

I wonder how many foreigners would be daft enough to want to risk investing millions of baht in land in Thailand ? Very few I reckon.

Chinese have been doing it for years somehow, maybe bribery or company route but they own houses and land around us.  Some have not been back for years as trapped back home due to covid. One family has the best house on our soi, slowly deteriorating due to their absence.  

They could always restrict the land sales to land that regularly floods and is full of termites. Or to illegal land plots carved out of national Parks.

There have been several large waves of Chinese immigration in the past. Meanwhile, many of these 2nd and 3rd generation Chinese are Thai citizens with all rights and are very successful economically. Historically, you can see that: The gold trade is firmly in Chinese hands, Chinatown in Bangkok, Chinese temples, Chinese cemeteries, etc.

Many of these Thai-Chinese are high officials and judges today. In the countryside, these Thai-Chinese own a lot of agricultural land, mills and factories.

 

Historically, the Chinese have always found ways to invest in land through their Thai-China family ties. Chinese don't need to invest 40 million baht to buy 1 rai of land. They have other ways.

The Land Code (1954) Governing Foreign Ownership of Land

2)    Acquisition of land by virtue of Section 96 bis of the Land Code

A foreigner may acquire the land under the following conditions :-

2.1 Acquisition of land for residential purpose not more than 1 rai

2.2 Acquisition of land by investment of at least 40 million baht in accordance  

       with the conditions concerning the period of investment and the location of  

 land prescribed by the Ministerial Regulation

      2.3 Acquisition must be approved by the Minister of Interior
