Daniel Penny Manslaughter Trial: Defense & Prosecution Present Starkly Different Narratives

In a Manhattan courtroom, Daniel Penny’s attorney defended the former Marine’s actions on a New York subway, arguing that he intervened to protect fellow passengers from a “psychotic” Jordan Neely. Penny, now on trial for manslaughter, faces up to 15 years in prison if convicted for the chokehold that led to Neely’s death. His defense attorney, Thomas Kenniff, began the trial by asserting that Penny “did for others what we would want someone to do for us,” stepping in to shield subway riders from what he described as an “unhinged” and threatening individual.

Kenniff’s opening statements painted Penny not as a hero, but as a young man who made a courageous decision to act under stressful circumstances. The defense argues that on May 1, 2023, Neely boarded a crowded northbound train, displaying erratic behavior, demanding food and money, and speaking of violence and imprisonment. According to Kenniff, Neely’s statements, including “I will kill,” pushed the passengers from “fear to outright panic.” Kenniff described one mother huddling with her baby behind a bench as Penny decided to step in. “That doesn’t have to make him a hero … but it doesn’t make him a killer,” Kenniff told jurors, emphasizing that Penny’s actions were meant to ensure others’ safety, not to take a life.

Meanwhile, Assistant District Attorney Dafna Yoran presented the prosecution’s account, accusing Penny of “criminal recklessness.” According to Yoran, Penny continued to hold Neely in a chokehold for nearly six minutes after most passengers had exited the train car, indicating disregard for Neely’s humanity. “Mr. Penny was so reckless with Mr. Neely’s life because he didn’t recognize his humanity,” Yoran told the jury. She argued that Penny took matters into his own hands unnecessarily, keeping Neely in “a deadly chokehold” well beyond the point when any threat had dissipated. Yoran also highlighted Penny’s “indifference” toward Neely, which she claimed ultimately led to the man’s death.

 

To substantiate their case, the prosecution is relying heavily on two bystander videos, which they deem “the most critical piece of evidence at trial.” These videos reportedly capture the final moments of Neely’s life, and the prosecutor claims they reveal “life being snuffed out” as Penny holds him down. Jurors were also shown footage from the body camera of NYPD Officer Teodoro Tejada, who arrived at the scene and found only a muffin in Neely’s pocket. Tejada testified that Neely initially had a faint pulse, but medical responders could not resuscitate him.

The defense, however, has highlighted Neely’s mental health struggles. A former Michael Jackson impersonator, Neely had been on a city list of individuals frequently in and out of shelters and treatment centers, struggling with homelessness and mental illness. Kenniff stated that Neely was experiencing a “psychotic episode” and had K2, a synthetic drug, in his system at the time. As for Penny’s restraint technique, Kenniff noted that his client’s Marine training included martial arts and first aid, though the Neely family lawyer, Donte Mills, pointed out that Penny failed to use this training to help Neely rather than subdue him.

 

Penny’s legal team insists his actions were not racially motivated, while Neely’s family attorney has questioned Penny’s decision to use a chokehold instead of less lethal methods. Outside the courthouse, protesters gathered in support of Neely, chanting “Justice for Jordan Neely” and “being homeless is not a crime.” The demonstration included members of Black Lives Matter, with some calling Penny the “subway strangler.”

 

The trial, expected to span four weeks, will feature testimonies from police officers who witnessed the aftermath and officials from the Metropolitan Transportation Authority. For Penny, this case represents a pivotal judgment on his choice to act in what his defense calls a moment of “panic” but the prosecution sees as “indifference” and excessive force.

This is exactly the reason people just stand by and watch bad things happen to innocent people in Western countries.

 

Intervene and you'll end up in jail. 

 

Even the police go to trial for tackling criminals. Especially if the criminal being tackled is black like the Chris Kaba case...

 

They'll probably convict him just to stop another BLM rioting/looting debacle.

They're won't be anymore BLM style riots since that's not the current propaganda objective of Putin.  He's much more focused on using Russian influence in various media to manipulate Democrats into feeling guilty at any attempt to stop mass illegal immigration.  Likewise similar propaganda to guilt Democrats into supporting Hamas under the guise of "Palestinian human rights."  And as the evidence shows he's very good at what he does.  It helps that his targets are very suseptible to manipulation.

I don't think the BLM/Antifa types really need much encouragement to loot/riot. 

 

All they need is for individuals from minority groups to be held accountable for their actions. That seems to set them off.
