hi,

i've been running small business here for 2 years but am new to this forum. i am looking for help with some questions about work permits.

i have a non=immigrant b visa and work permit. in march i returned to home country [uk] for a month. when i returned to thailand my accountant told me that i had to pay double the normal 1350bt fee to restamp my permit.because it was more than 1 month overdue.

i have just been home again for 2 months and am being told i will have to pay 1350x2x2 for being 2 months late.i also read somewhere that it is poss to suspend permit whilst out of the country.it seems that i am being penalised for not being here and obviously not working.also, i am still having to pay my income tax whilst away and obviously not working.also my accountant stated that if i am not happy with this i will be even more unhappy in october when i will have to pay for a completely new work permit.at this date my work permit will be 2 years old.in this it states valid untill oct 07.but i have been getting renewal stamps up till now with no probs. my friend just said he has had the same work permit for 6 years without having to renew, he showed me this and they have even added in more pages for his 3 month stamps. i now also have a new non-imm-b and have had b visas for years with no break so this is not the prob.

any advice from you guys will be much appreciated.i tried to give all info but if you need more please reply.

Are you on a non immigrant visa (going to the border every 90 days) or are you on an Extension of Permission to Stay (going to immigration to report your address every 90 days)?

The only issue may be if you are on a multiple entry non immigrant B visa and have to be out of the country for more than 3 months.

Otherwise you ensure that your passport/work permit stamp will expire after your return; you can always make a border run just before your trip, get a 90 day stamp then renew your Work Permit for another 90 days, then go on your trip. When you get back you can use your new 90 day stamp to renew your WP, or just wait for the previous WP permission to expire and renew then. This does mean that you will have more stamps in your WP.

If you are on an extension then just get a re-entry permit.

In either case your accountant should continue to pay tax and national insurance.

thanks for the reply. to clarify, i have a non immigrant b visa for 1 year ,just got my 3rd b visa in the uk and go to the border every 90 days.I have been doing this for 2 years and do not have to be out of the country for 3 months.Good idea to renew before i leave but pity i didn't think of this before. I'm still not sure though why i have to pay double fee's to restamp my permit for each month that i am overdue, or why i may have to pay to completely renew my work permit in october [this will be 2 years since i originally got it.] have you got any furthere thoughts about this????? and thanks again for your time and advice

No need to completely renew your Work Permit in October, don't understand what your accountant is doing.

I have heard that some labour departments can 'overlook' an expiry of permission and 'backdate' the renewal if an 'additional fee/tax' is paid. So maybe this is how your accountant has been dealing with your overdue Work Permit renewals.

Anyway, as I wrote before, your best solution is to do a border run just before you make your extended visits overseas and then renew your Work Permit based on your border run stamp before you make the trip. You then have the option of up to three months away, but you must continue to pay tax and national insurance during this period..
