Apologies, this may have covered before, but immigration rules seem to change quite quickly.

I've had a work permit attaching to a non im type O visa for the last couple of years.

I have a company in Thailand and my children were born in Thailand. The non o was easier to get and didn't involve crossing the border every three months, as was required wih my prevous type B..

Have recently moved provinces, the department of labour official added the change of address endorsement to the work permit, but mentioned that I should have a type B.

Anyone know the rule on this? I was under the impression that a work permit could attach to either a non O, or non B?.

You don't have a non O visa; you have an Extension of Permission to Stay based on Family (Section 7.17 of National Police Office Order 606/2549).

Your original visa status that was extended is still B. The labour pepole were wrong, there is no problem.

what actually happened

At first I had a non-b issued in London.

Then switched to a non-o issued in Bangkok

Then got divorced - lost my visa entitlement and had to leave the country and enter again on a entry permit.

Went overseas and reapplied for a Non-o (on basis of supporting my children) - This is my current visa.

So there is a break in the chain?

What you got in BKK was an Extension of Permission to Stay on the grounds of supporting family, not an O visa.

Are you now making border runs & on a 90 day border stamp; or are you reporting to immigration every 90 days?

You can definitely have a work permit on a Non O visa.

Whether you will get a one year extension on your visa depends on

meeting the financial requirements.

It sounds as though you did not on your previous B visa.

Yes, i did meet the financial requirements on every visa applied for. Swithced to the O to cut down on paper work.

If the work permit attaches to the non 0 that is better for me. I'v had both and prefer the O.

I have a work permit based on a non-O, as my wife and kids are Thai. I have my own company in Thailand that pays me a wage and my work permit is for that company. I also have an overseas company that pays my thai company money based on providing my services for overseas contracts. I use that money to pay my wages in thailand.

It's a bit complex, but it gives me a work permit, non-O visa and enough money to live comfortably (I work outside Thailand for around 6 months of the year). Ideally I would like to hire people and send them abroad for 6 months a year, but I haven't found anyone who wants a basic thai wage, speaks English fluently and understands the telecomms IT industry!
