When you where rejected what was your action to have it over turned

I think you can fax the ECO to ask for him to reconsider and try to explain the misunderstanding and where you went wrong and apply the extra documents with more clear evidence.

I am not sure this can be done before an apeal is actioned. Anyone tried this your views would be very welcome

The official way is to lodge your appeal at the visa section where you were refused, the Entry Clearance Manager will review your case in view of any new evidence that you have supplied with your appeal form. The refusal decision may be overturned at this stage by a ECM

1. I sent an email (visa enquiries) last Sunday evening after reading the reasons for the rejection.

2. Followed up with a telephone call on Monday to VFS requesting to speak to ECO as I think admin error. Explained the situation to the VFS, she spoke to the ECO while I held. Said they would investigate and mentioned that the Embassy had received my email....could I speak to ECO? No, please wait Sir.

3. On the way to work on Monday I picked up the Bank statement forms sent on the 1st June along with the 'proof of fax' and scanned the 18 pages as a pdf and emailed it again to the Embassy.

4. They reacted extremely quickly, between 10 and 11 ( 3 and 4 Thai time) on Monday morning the Mrs received a call saying decision overturned, pick up Visa on Thursday from Embassy. I had an email at 10.20 from the Embassy, saying decision overturned and sorry for any inconvenience caused.

Based on the reason ( re-course to public funds) I thought that there might be an admin error at the Embassy as I had been asked to fax through my last three month bank statements at the back end of April. They received my fax on the 1st June. My suspicion was that the fax had not been associated to my main application. So my thinking was that the ECO was thinking has asked for bank statements, sponsor not sent, three weeks later syill not got, therefore rejection.

Hope you mentioned the child on the sponser form and has a british passport, it allows the ECO to bend the rules as consideration when a child is involved

couldn't put the babies details on the sponser form as she hadn't been born...but wrote a covering letter stating when she was due and that she would be travelling with them...she also has a british passport

Hi again,

can someone please clear up a quick question I have about an appeal after getting a refusal on our settlement visa?

we are doing all the things just now for it, however, all the documents that were in the original application have not been sent back to us? only a few, such as our sons birth certificate, council tax letter, and my accounts from my accountant. Everything else I didn't get back?

So my question is this:

They say to give further documents supporting your appeal which will be fine, but how about the documents in the original application. will they still have them? such as the photos and lease for my house ect ect... or do I have to send in all those again?

reason Im asking is i dont want to appeal and then something silly happens like they say you didn't give us your lease for your house, which they already got the first time and never sent me back.

thanks for any help or advice you guys have, and never give up everyone who got a refusal.

Jay, also check out http://www.ukvisas.gov.uk/en/howtoapply/infs/inf19appeals my understanding from this is that you don't need to submit what you have already submitted i.e. it is additional evidence. I can't give much more here as my original rejection notice is in Bangkok (I'm UK) and I can't comment on what documents the Mrs had returned from the SV application.......perhaps others could help here. I know from two previous Visit Visas we did not get back my sponsor letter.....but we did get back photos etc.?

this is what my problem is... the ECO didn't give me the chance to send him extra bank statements. At least your had the decency to request them from you before a refusal...

Im not sure who was mentioning the part about making sure they new about having a child with a british passport??

We have a 1 year old with a british passort and we still didn't receive any favours, let alone bending any rules???

That was me

Not all ECO are the same as you have just seen from ticktock. he got the chance to submit more as he had a good application and the nice ECO didnt want to reject it when everything else was perfect.

It is in the rules of ECO that he can bend a little on compassionate grounds if he feels the need, so i was advising to include it.

He has to have good grounds to split a child from their perants.

Pingit i dont know all your details

ECO,s have 1 set of rules, but them rules can be applyed with a iron fist (maybe yours) or with a little compassion (maybe Ticktocks)

All i can say is do the same as Ticktock and give it a try.

On checking ticktocks posts

you are wrong as their DIDNT ask for extra documents (same as another refusal bandx) the ECO rejected both applications and same as you give his reason.

Both applicants then faxed the paper work needed by fax and asked for them to review the case and WALA VISA ACCEPTED

you have not been badly treated you have the same chance as the other 2 so if you think it was JUST a bank statment missing then get it in

Anybody got the fax number to hand that you were all sending it too? And on the top of the faxes will I put the ECM's name on it ( Gerry Stuart ) . ? ? ? I would REALLY appreciate that number as I cant find it.

Hi everyone,

the fax number I have for the Embassy in Bangkok is +66 (0) 2 255 9278 .

Does anyone know if this would be also the right fax number to reach the ECM , or does he have a different fax number?

Just gonna fax over some documents and a letter asking him to review the case.
