Dear All,

I was hoping somebody could advise me.

My Girlfriend and I are going to apply for a UK visa for her. She has had 5 shengen visas as I have been working in Europe since I left Thailand. And has stayed with me for 3 months last year.

However now I am back in the good old UK, and working here. I want her to come to stay with me in England.

We want to get a 6 month visitor visa and have prepared all the usual docs. (my letters of invite, proof of earnings and bank statements, etc. She has land in Thailand and a good employemnt history for International companies, plus holiday visas for Europe and Australia)

DO you think she will be given a six month visa?

and 2nd if she does get it, then after 6 months we come back to Thailand can she apply for a (Fiancee?) settlement visa (either on the basis we will get married in the UK within 6 months- or if we get married in Thailand then apply for settlement visa) would she beable to come back to the UK right away? or would she have to wait another 6 months?

As your g/f has had visas for other European countries and Australia it is unlikely that the Brits will give her a hard time. Secondly, she is free to apply for a settlement visa as soon as she returns to Thailand from the UK.

It seems you are quite an expert on UK visa. Reading some of the other posts on this board I see that if you get a tourist visa you can not then get married in the UK and apply to extend you stay. However I also heard that you can do this as long as you get permission from the home office once you are both in the UK (In the case that after living together for a few months you decide that you want to get married)- is that true???

I guess it's a bit risky from what i've read on this board?

Hi Marko,

You are partially right. The new rules stipulate that if, as a foreign national already present in the UK, you wish to marry, you need to get permission from the Home Office. However, in order to qualify for this you need to have been given entry for in excess of 6 months and to have at least 3 months' leave remaining. As a visitor is granted leave for a maximum of 6 months then it is not possible for them to be given permission to marry during the currency of their visit.

They can, however, apply for a visit-marriage visa which specifically grants the authority to marry but the applicant would still need to leave the UK at the end of the 6 months. In your situation your girlfriend would be best returning to Thailand at the end of her visit and applying for a settlement visa or, alternatively, seeking that in the first place.

Thanks again Scouse, one more question!

If she applies for the settlement visa, does that mean we have to marry in the UK within 6 months (and demonstrate to the UK embassy in BKK, at the time of application, that we intend to do that). Once married in UK she can then stay for a further 2 yrs?

Or is it not necessary to marry in the UK, and in which case how long could she stay in the UK with this visa?

With a sttlement (fiancée) visa she has 6 months in which to get married and can then apply for a 2-year extention without having to leave the country. Looks like I have to discuss with the lady whether we go for settlement (i.e get married within the next six months!) OR get a six month visitor visa, then go for settlement after that.

Getting married is the ultimate commitment and it send a shiver down my spine!! But I guess I have to grow up sometime!
