Thai In Trouble, Insights Wanted

Greetings,

LONG time lurker.. anyway would like to ask if anyone can add any personal insight to the following.

1) Thai Lady has motorbike on a monthly installment contract.

2) Thai Lady fails to make payments.

3) Thai Lady does not have motorbike to return to finance company.

4) Finance company demands payment of 65,000 bt.

What would be the maximum civil or criminal penalty that the above thai lady could face for failure to pay and failure to return the motorbike???

Well I aint no rocket scientist, but feel sure we can all imagine the scenario.

Farang overseas, g/f spins a line, trip to Western Union perhaps?

Farang unaware Thai lady would have someone sign as guarantor for the payments, so not the farangs problem.

Off course I am most probably way off the mark with all the above.

Assuming lady scooter type m/c, I would be interested in hearing what model could run up a bill that high?

I would assume that the lady wouldn't be worth the company chasing.

Sounds more like a story a girl would tell a white man to try to extort some sympathy money.

I'm behind with m/c payments, I have gambling debts, my parents have a sick buffalo, my mother needs an operation, etc.......

PS

If anyone hears the 'my well has run dry' story, it cost 3000bht to drill a new well on my wifes farm ....... that included the water pump.

When buying a bike on the never never, interest is factored in to the payments. Thus, when the all outstanding payments are totalled, it could easily be Baht 65,000.

This is a common scam in Thailand and as a result finance companies are cracking down. What usually happens is that a person enters a contract to buy a bike on hire purchase and gets an acquaintance (the person who will be stung)to act as guarantor. Within a few days the bike is across the border or chopped and the purchaser has disappeared. The acquaintance then faces the music as guarantor. Failure to pay resulting in charges being pressed. I have not heartd of anyone going to jail though.

That may be a record price. What do you feed the squirrel that powers the water wheel/pump?

For 3000baht you have to get the wife to suck up the water. Its OK because for 3k it only 50 centimeters deep.rolleyes.gif

I believe the OP's question is a valid one. As already mentioned, the finance companies factor in the interest as the total price and a 40,000 baht bike would likely be at least 65,000 baht when paid off. It is quite possible that the bike was stolen and couldn't be returned. It might also have been in an accident and too badly damaged to be returned. And Yes, the bike MIGHT have been sold for instant cash so the gal could try and collect from the boyfriend later. But that would only happen if the guy was stupid. Of course, there are a lot of stupid guys out there.

I don't know the laws in Thailand, but I highly doubt if the cops will put the gal in jail. However, she will be forever in debt and could never get another loan to buy anything else.

You don't go to jail for not paying a debt. However, in this case the motorcycle is not there anymore. Normally the motorcycle remains the property of the finance company, till all is paid. So if the lady in question or example sold the motorcycle she committed a crime as the motorcycle isn't hers. If it was stolen, than no crime was committed of course.

I think your MIL is subject to something else. The blacklist is in regard to credit. However, in your MIL's case I believe she has had an enforcement judgement placed over her by the court for repayment of debt. As soon as she buys any property and the creditors find out, they will get an execution (enforcement) order and the property will be seized and put up for auction, the proceeds going to the creditors. Any funds left over after repaying the debt will be given to the MIL. However, if the funds raised are not sufficient to cover the debt, the creditors just wait until the next time she buys property and repeat the process. There is a statute of limitations in taking action though.

Im not sure about it.. and i really don't care about it its her problem. She is always trying to loan money to buys land or other stuff and selling it again. Most of the times this goes wrong, i never loaned her any money. I don't see her often as my gf isn't that close with her.
