New House In Sisaket

My wife's in Sisaket at the moment and wants to buy a new house in the town within the next day or two. I was there last week but the seller faffed around for a week! :o

Now the usual snag - I am not there to sign away my rights to the house (I'm in HK). The builder has said that she won't be able to buy without my signature, and that has been my experience on land purchase in the past.

I told her that if the Amphur fax me the form I will fax it straight back signed, or buy the land and house separately, with the land in her sisters' name. However, I've got the feeling it's not going to be as simple at that and I haven't got the time to go over to Sisaket again.

Has anyone else had this prob? If so how did you get around it?

Tks but I'm not sure if that thread helps me.

Boogieman was being told that he had to get his marriage verified at a Thai embassy. It is accepted by the Amphur that my wife and I are married - we have bought property before in my presence whilst I have been there to sign and wife has copy of marriage cert. etc.

My problem is that they are saying that I have to be present at the purchase and sign away any rights to the land. I will suggest that I go to the Thai embassy here in HK to sign away and see if that helps.

Boogie found out that this was also the problem he had. Apparently it's OK if you go to Embassy to have them certify. However don't know if they will need your marriage certificate. Best to give Embassy a ring and ask them what you need to take with you. Do you have the papers on you in HK?

Yes, got all I need here, we also know people at the embassy so shouldn't be a prob. Trying to get thru' to wife now to see if this would be acceptable to Amphur in Sisaket. Tks again for your help.

After a bit of confusion the problem I ended up with was that the land office would not accept my signature on the form for signing away my money. They either wanted it signed in their presence at the Land Office or signed at a Thai Embassy. I posted them a notarized copy of my passport, showing my signature, but they would not accept this. In the end we had to put the house in Mother-in-law's name.

Hope all works out. Would be interested to see how you make out.

Tks Boogie. We've put property in mum-i-l and sis-i-l before and sure we could do it again but it's a bit more expensive this time and would prefer not to. Actually, not wishing to sound callous, but mum-i-l is on her last legs and my wife is the sole beneficiary in her will, I wonder what the tax implications could be. A visit to Thai consulate in HK would be no prob either and sounds the preferable route. Will let you know what happens.

Another prob I have now is that my wife seems to have turned off her phone - she bought a Thai sim card last week and I guess she doesn't want to use it up :o

It seems to be going OK now. Managed to talk to the wife last night - she has paid a substantial deposit on the house, balance to be paid on exchange of documents. There does not appear to be an urgency to finalise this - I can sign next time I am in Thailand or, as I told her, I can sign at Thai Consulate in HK. In the meantime she can get some mods. done (and aircon inst.) to the house. She was strongly against getting the house registered in her sisters' name.

Also, the builder/developer is in HK this weekend (he speaks reasonable Eng.) so hope to discuss with him directly.

OK, we (well my wife) are now the proud owners of a new house. I went down the signing at the embassy route.

Documents supplied: A copy of my passport (with a seal and stamp from Brit Embassy, cost Bt1,250), my written statement of no interest in the property signed and stamped by a HK Notary (Bt2,000), a copy of wife's passport (they accepted a copy of an old expired passport as her current one is with her in Thailand), copy of my HK ID, copy of marriage cert. Cost at Thai Embassy (they stamped and signed them) a further Bt1,250. Total cost Bt4,500. All documents photocopied. Copy set kept by embassy. I then faxed them to Thailand, and am following up with originals in the post.

I don't think that the HK Thai Embassy had done this before and they seemed a bit unsure whether the Amphur would accept the documents - all in English.

Glad to hear everything worked out for you.

As matter of interest did the land office ask for all of those documents ? or did you just send everything to cover all your bases ?

Hopefully I wont be in the same position again. Any further deals that we do I'll make sure I'm in Thailand for the completition.

Actually I had no contact with the land office. I took a file with a load of papers to the Thai Consulate and they picked what they wanted. The key documents were the statement and my pp which were stamped by the notary/Brit embassy and Thai embassy.

I've heard a lot of bad stories about HK embassy on the forum but they helped me a lot, and out of their normal office hours.

Makes me feel a bit happier too, as it shows that the Bank guy in our deal was actually right about what the Land Office wanted. I did have my doubts ! I can see why they wanted those documents, it just seemed a bit strange that all this came to light AFTER we left Thailand. I put it down to the fact they they dont sell many houses to Farangs in those parts, certainly not one's that are out of the country.

I guess these experiences will help anyone else if they find themselves in the same predicament. Not too bad really as long as you are in proximity to a Thai Embassy/Consulate, which, unfortunately for us, we aren't !

Anyway glad it all worked out for you.

Let's resurrect this one for a bit.

The wife and I are thinking of buying some land on our next trip to LOS. She is Thai and American and holds current passports for both countries. What documents will she and I need to present when signing the papers for the land purchase? Will she need a valid Thai I.D. card? Hers expired years ago and we never bothered to renew it. Will we need to bring our marriage license? Anything else? (besides the money :o )

If you are both going to be present the process should be fairly straightforward.

You will need to go with your wife to the Amphur where the property is registered with the seller/s. The documents required may vary from amphur to amphur, even from time to time within the same amphur so be prepared for a bit of a runaround.

My wife has a Thai ID so takes it, not sure if it would be OK without it, also has many copies of the marriage cert. notarised and with Thai translation and passport. I also take my passport - we've been half a dozen times to buy property. You will also need to sign that the money for the purchase is your wife's and that you have no interest in the property.

The seller will need to take land registration documents and passport/ID.

I suggest you go along with the seller with what documents you have and see what else they want - they always want something else!

W/out a Thai I.D. you cannot register a chanote in your name.

Too many Burmese 'immigrants' recently in Thailand and Amphur districts have clamped down hard.
