Extension Of Stay With Non Imm O

Featured Replies

Hi everyone.

I have a multi-entry Non Imm O recently obtained from KL and it is based on marriage.

My first 90 days are up on the 5th December 2010. I started employment at my new school on the 9th Sep 2010.

What documentation does the school need to supply in order to get my extension of stay? In fact........if its a Non Imm O can they even do that? I do have a WP obtained last month.

Or can the school only provide documentation for a Non Imm B visa?

I earn well over the marriage 40k a month requirement but do not yet have 400k in the bank. Obviously I have only received two salaries so far so does that in itself present problems?

I guess what I am trying to find out is can I be given an extension based on my WP or do I have to go through the proof of earnings thing if I wish to keep my Non Imm O multi entry alive?

Any help appreciated.

You can extend for work or marriage - the entry visa type does not matter.

There is an advantage to using marriage as it would not end if employment ends. But paperwork would be more your problem than school and they might prefer you extend for work (which they know about and feel they have more control over you).

If you have a non immigrant multi entry there is no need to extend as you can continue to make 90 day border crossings if you wish - or you can extend during the last 30 days of any entry.

As you have just obtained and paid for a Multi Entry Non Imm O it would probably be better to continue using this until it expires.

You can then extend for 12 months based on Marriage or Employment.

Many thanks.

Just to be clear on this..........if I do my border run every 90 days........it does not affect my current WP which is running until the end of my contract? (September 8th 2011)

If I elect to use the employment route and the school take care of this for me.......does that mean my current Multi Entry Non Imm O is now invalidated?

Many thanks for all advice received.

It does not effect your WP.

No, the visa remains valid till it is expired. It would only expire if you would get a new visa, which you don't need.

Travel and return is fine on work permit and extension of stay should not invalidate your multi entry visa but would make it superfluous as you could not use it without losing your extension of stay.

Many thanks to all of you.
