Two Green Bay Packers fans file suit after seating denied in Super Bowl

DALLAS, TEXAS (BNO NEWS) -- Two Green Bay Packers fans who were denied seating during last Sunday's Super Bowl game even though they paid for tickets have filed a lawsuit in Dallas, Texas against the National Football League (NFL), the Dallas Cowboys, and Cowboys Stadium.

Dallas-based law firm Goldfarb Branham filed the suit on behalf of two Wisconsin residents who were sold tickets to seats that did not exist, which are being described as 'phantom seats.'

The suit includes claims of fraud, breach of contract and negligence.

According to the lawsuit, at least one week before Sunday's game, the organizers knew the seats might not be ready, but remained silent. After the scandal in which several hundred fans were unable to be seated, both NFL officials and Dallas Cowboys owner Jerry Jones accepted responsibility in published reports.

"Our case seeks compensation for all of the hard-working people who may have saved a few dollars here and there, and planned the trip of a lifetime, only to be deprived of their seats by a wealthy owner and a league that didn't care enough to do it the right way," said Charles W. Branham, who is representing the two individuals. "The law does not allow the NFL or anyone else to sell someone a product that doesn't exist."

Around 400 fans were unable to be seated in the stadium, and the NFL said it would offer them triple the value of the tickets - some of which ran for around $800 - as well as a transferable ticket to next year's Super Bowl, which is scheduled to take place in Indianapolis.

Later, a second option was offered in which a free, nontransferable ticket of the fan's choice to a future Super Bowl as well as roundtrip airfare and lodging.

In addition, around 2,000 fans were offered a refund of their tickets after entry into the stadium was delayed because their seats were still not ready. Also, 865 fans were reportedly seated at comparable or better places.

The reason behind the incident remains unclear although some have stated issues with related to the contractor, while others have blamed the weather.
