Hi, My thai GF and I are very worried becouse we have heard from various sources that if UK border control reject a 3rd UK TV from Thailand then they will ban my GF from applying for any visa for 10 years! Is this true? And if not true, is there any damage done by having a 3rd visa rejected.We currently have 2 failed UK TV's. Both times they failed us on simple things, nothing serious, which, we can now on the 3rd application address all issues raised on the 2nd rejection. We have no bad immigration history at all,Help please...........very worried :(Kind regardsAndy

There is no automatic 10 year ban. Put simply, the 10 year ban is normally ( in visa applications) initiated because the applicant has employed deception in an application. If this is the case in the two previous visa refusals, then it will say so in the Refusal Notice(s). There should also be a mandatory advisory that a further application that employs deception will result in a refusal and a 10 year ban. I'm assuming that you don't have that ?

You say that the refusal reasons are simple things, and that you can address those reasons. It would be useful to all, and help us to give advice, if you post the reasons in full.

Hi,

Thank you so much for your response, and yes iagree i should have added more detail earlier, but i was in to much of a rush. I now fill in the gaps for you kind sir!

My GF's name is Jane for the purposes of thisletter.

Weapplied for the 1st UKTV in December 2010, i am afraid that this applicationwas simply flawed owing to our ignorance, and lacked lots of relationshipevidence etc.

Imust just make clear Jane position:

MyGF was working in a shop in BKK, paid around 13.000bht pm. Working in a highly trusted position for thelast 3 years, we had supplied a glowing letter from her boss and all Jane’sskills, and all the evidence to back up genuineness of the letter &her boss etc.

Janeis also returning to UNI on the 1st of June 2011, to finish the last part ofher previously suspended business degree “suspended in 2008 in order to work” However in light of the up and coming visa trip in March and the return to UNIJane quit her job in March as she also had to give her boss 2 weeks notice. She is now unemployed until she return to hetstudent status in June.

Thesecond UKTV was much superior, and we felt that there would not be a problem,however this was rejected again for the following reasons:

1 They claim that payments going into my GF's bank are notcorresponding correctly with her wage, when they actually are. They have simplyfailed to properly look at the statement which is there fault. I can addressthis very simply by sending them a better bank statement highlighting thepayments in an indisputable way.

2 Even though they have accepted that we are in a stronggenuine relationship., they still say that we have not provided evidence thatmy GF will return to Thailand? So they have stated on refusal that because we not provide evidenceof Jane returning to the uni course, they were not convinced she will return toThai................etc. We were notable to obtain any kind of letter from uni to proof her return at the time.

So now on this 3rd application; wehave addressed there wage payment issue. And because of the time that has now passed, Jane has now been able toenrol on her UNI course and has the official letter of proof that the embassyasked for.

So now we have addressed the issues for the 2ndrejection, however, because of the nature of the beast I am still not convincedthat they won’t find some silly reason to reject us again?

Jane has been told by various people that ifthey reject her UKTV a 3rd time, they will stamp her passport asrejected and not be able to apply again, and this has worried us both. Do you know of any issues that can arise from a 3rd UKTV being rejected?

From what you have said it seems that you have addressed the reasons for the previous refusals; so good luck with this one.

As VP says, and he is a professional, there is no limit on the number of applications one can make; whether they are successful or not. The only reason for any kind of ban would be if deception had been used in a previous application, and as VP says the embassy would have told her if they believed this was the case.

In other words, the "various people" are wrong.
