In practice, most people over State Pension age get it automatically, but it can be reduced or recovered if your taxable income is over £35,000. You are generally not eligible if you usually live outside England, Wales or Northern Ireland, were in prison for the qualifying week, were in hospital getting free treatment for the whole qualifying week, or your immigration status says you cannot claim public funds. For care homes, extra rules apply: some people living in care homes are not eligible, especially if they receive Pension Credit, Universal Credit, or income-related ESA and have lived there for the full relevant period. For Scotland, the rules are different because Winter Fuel Payment has been replaced there by a separate Pension Age Winter Heating Payment.
