The aim is to clarify the issues around whether or not an indevidual should be considered tax resident in the UK. After consultation, the test will be written into legislation and become law (and therefore start to be applied) from the start of the 2012 tax year. Obviously it is still at the consultation stage and things may change but, on first reading , to me, it looks to be a vast improvement on the current situation (and not as draconian as some had suggested). It should allow an indevidual to establish much more clearly and relatively easily whether or not they would be considered tax resident for a particular year.
