Prayuth, Democrats oppose taking reds' case to ICC

The Army chief and the opposition Democrat Party disagreed with the ruling Pheu Thai Party's plan to take the case of the 91 who died in a military crackdown on red shirts last year to the International Criminal Court (ICC).

Thailand's internal justice system is working properly on the case, Army chief Prayuth Chan-ocha said.

Thailand's judicial system would lose credibility if government MPs took the case to the international court, said Prayuth.

Pheu Thai MP Sunai Jullapongsathorn said earlier that he would lodge the case with the ICC next month to seek justice for those who died in the incident.

Prayuth said that as an MP, Sunai had a right to do so but his act would not be proper.

"All concerned officers and I are ready to cooperate with any kind of justice, but the government should also be fair to all officials who worked on the ground as they were only doing their duty," Prayuth told reporters.

"They performed their duty in accordance with lawful orders," he said. "We [the military] rely on the nation, religion and the monarchy."

Ninety-one people died in the bloody crackdown after red shirts rallied against the then Democrat government of Abhisit Vejjajiva. Among the dead were unarmed protesters, military officers and even journalists.

Many protesters and their leaders have been prosecuted for disturbing social order while the opponents are still walking free.

There have been several attempts to bring the case before the ICC but all have been unsuccessful as Thailand has not yet ratified a court treaty.

Democrat spokesman Chava-nond Intarakomalyasut maintained it was impossible to take the case to the ICC.

The ICC has very limited jurisdiction, he said, adding that it has authority to consider only crimes against humanity, international wars, genocide, and violence against "vulnerable" persons.

As long as our domestic justice system is still working, the international court cannot take up the case, he said.

"Khun Sunai should not spend the national budget for this useless, impossible mission. May I suggest that he ask former prime minister Thaksin Shinawatra for the budget to fight this case," Chavanond said.

Asked if the police was speeding up investigation into some of the cases, Chavanond said it was an attempt by the police to divert attention from the case of the red-shirt protesters who were involved in the chaos.

The Democrat Party was ready to face justice, but the authorities should handle all cases fairly, he said. The government should also tell the truth about the arson and the deaths of military officers, he added.

If Red Shirt Pheu Thai MP Sunai plans to submit the case on December 9th, he'd better hurry up in getting the Rome Statute ratified by Parliament and approved before then.

Otherwise, he'll just look silly.

Thaksin Shinawatra total wealth placed at 400 Billion Baht

UPDATE:Subtract 3.6 Billion Baht amid claims it was stolen from him by a Dubai lawyer

UPDATE:African gold and platinum mines valued at 1.63 Trillion Baht

It shows how Thaksin is finding it hard to find happiness. All this wealth and he still isn't happy. This is his Karma.

He'll have lots of company then.

I've often wondered if looking silly is not thought of as being important to these guys, or just not thought out at all.

They come and wreak havoc on the city, causing billions of baht worth of damage to personal as well as public property, loss of income, loss of jobs, tourism and on and on the list goes. I think what this quote means is, if the terrorists get prosecuted, then those that are sworn to uphold the law and restore peace (the victims) should be prosecuted too if things don't got the way of the terrorists. amazing!

Well no surprise about who would oppose the idea.

Whether it is practical or legally possible or not is another matter, but in the context of political conflict, recent articles on the deaths of the two journalists mentioning witness testimony that is going to be very very embarrassing to say the least to these two parties if it is as mentioned in respecatbale foreign media and the thai legal system being questioned heavily outside the country this just adds pressure and everyone knows Thaksins strategy of it doesnt have to be like this as we can all forgive each other.

Also slip it in with the anti-Thaksinistas fantasy of the floods wrecking the popualrity of PTP while delivering a huge boost to the Democrats having turned out to be yet another of their secret desires without any actual substance (PTP should give Sukhumband an honour for service rendered) as they now realise and we can see the game heating up again.

And then slip in the splits between the liberal and ulra-conservative anti-Thaksinistas that ole Abhisit is currently doing his best to try and paper over, it gets even more interesting.

It was a terrible thing, but was supported by nearly everyone in the country and for certain reasons absolutely no serious politician will take that anywhere near an international court as we have seen.

Army Chief Questions World Court Involvement in 91 Red-Shirt Deaths

The Army Chief is questioning the appropriateness of investigating the deaths of 91 red-shirt members during last year's street protest against dictatorship.

Army Chief General Prayuth Chan-ocha questioned Pheu Thai MP Sunai Julapongsathorn's plan to ask the International Criminal Court to investigate the deaths of 91 red-shirt members, saying this could affect the credibility of the Thai justice process.

General Prayuth stressed that what happened last year was a domestic matter, and the Thai justice system can handle it.

The army chief said that the Center for the Resolution of the Emergency Situation, or CRES, revealed a list of names of anti-monarchists involved in crimes of lese Majesty.

He urged the government to resolve all problems through a democratic system without involving authorities within the conflict.

He went on to say that Thai authorities, including soldiers, will strongly adhere to the national religion and the monarchy, and strictly comply with orders that are legal.

They will have another coup to stop the truth coming out.

Unfortunately this one will not be pretty.

I truly hope not. The prevailing mood I see is not anywhere near supporting such an action and I fear you are right about it not being pretty.

Mr.Sunai will have to travel to The Hague to try to lodge the complaint. What a waste of money! Taxpayers' money?

Supposedly his money and European Red Shirts money.

Sunai, who is Chairman of the House Committee on Foreign Affairs, said he will use his own money for the travel and many red shirts in Europe have organized everything for him.

What if they are not Buddhist (I assume he is referring to Buddhism although it has never been recognised as the official national religion as far as I am aware)?

You mean ridiculous?

I warned of a coup about 6/7 years ago, wasn't taken seriously back then and look what happened.

"It will never happen again", "Thailand is past that sort of thing", etc, etc, etc.

Heard it all before but the leopard still hasn't changed its spots.

I didn't, but being a Spurs fan I couldn't bring myself to mention...........although I must say, expressing it in the way you have done would make it easier as it sums them up to a tee!!!. Their manager should be called Arse n winger or even another 6 letter word beginning with W, with N as the third letter and ending in ER!!!!

If they done no wrong why are they afraid.????

Perhaps they are afraid of yet another Thai looking foolish on the world stage.

In this instance, for a politician to attempt to file a case for which he is not eligible to file.

I don't think the International Cricket Council would accept this case. But they might be willing to help organise the next election result.

It has never worked.

Taking this kind of case to the international arena is exactly what Thailand needs.

Oberkommando, you are 110% right. Army is afraid of ICC.

About waste of tax money (churtz), the yellow shirts have wasted and stolen money for decades. Don't worry about this step of mr. Sunai.

I would say they would have at least one case:- violence against "vulnerable"persons, as stated above. Trained military, tanks and rifles against bamboo and tyre barricades. Give me a break.
