I am a licensed Thai motocy rider. My advise to the OP is pay up, 800 baht is nothing when looking at the grand scheme of things. You did drop the bike, you did cause damage, whether it is worth 500, 800 or 1,000 baht is not really the problem, just pay it. The problem starts if you don't. Forget the pussy legal crap, won't work in Thailand and as all the others have said, it will cost you more in the long run.

To give the OP some slack, If the "damage" was cosmetic, or what one might term, "ordinary wear and tear," then although the cost asked by the owner is small, the principle still stands. Bikes fall down, this should be under the normal wear and tear category.

Of course everyone is right; just pay and learn.

The idea of suing is just the knee-jerk reaction of a neophyte.

However, and this is the important point, if you want to get any satisfaction at all from your 800 baht, demand to see that the part or area "damaged" is replaced and request a copy of the bill. Of course you run the risk of them actually going to their friend the mechanic and him being told in Thai, which you don't understand, to inflate the price far above the 800 baht. But then again, if you are hard-core, go for it.

The bike was old... At least a few years and had damage... I will pay the hiring fee... But 800 is steep for a 2 minute ride?

Can any laws prevent the payment... Im entirely sure the damage was already there and that they are just trying to rip us off...

Laws. Let's cut this one short. No. I don't mean to be short about this one, but if you read through this site (save yourself the bother if this is just a holiday) you will discover that some of the brightest and boldest people have lost their cases with the backing of decent legal teams. It is difficult to explain with-out superlatives so I ask the standard long-term members to hold their horses in tearing me apart as this is for the good of the OP. The courts here will find for the side of an foreigner SO rarely it is ludicrous.

Now the "not laws" part. This is the part you REALLY need to listen to. If you like walking and breathing a great deal then B800 might be the cheapest price you will ever pay. Seriously, don't mess. There are numerous threads on here detailing unexplained suicides in this country. Just the other day a man "seemingly" stabbed himself to death. Have you thought about the likelyhood of this? Another man managed to behead himself and hang himself off one of Bangkok's most important bridges.

B800. As I have said, pay and say "Thank you". You have 3 500+ posters here recommending the same solution. You came for advice, you got it. If you don't like it then do what you will. Just read a few of the news threads on here first.

Bah! Paid already.. Still i dont like getting scammed.... Bike wasnt even damaged but you guys are really helpful... Yes i am young 18.. Travelled a lot... Anytime i had a problem we always solved it like this... Suing and winning money in that way... Just wanted to know what the procedure would be for thailand... Thanks anyways

Only 18 yrs old and you already have multiple experiences in other countries taking people to court for one reason or another? Have you ever had a relaxing holiday?

must of been taught well by mommy and daddy about taking people to court, I believe a lot of people make a good living out of that and I dont mean lawyers

Obviously a windup from the start. Who in their right mind would think of making money after crashing a motorbike? :) Suing a motorbikecompany because his gf crashed the bike, that wouldnt work out in any country. It is impossible not getting any scratches if you have an accident on gravel so who cares if it had small damages before, gf made more and you have to pay. 800 bath isnt much to talk about if you are 18 either, just a windup.

Yes I think this is a wind up or the poster has some mental issues

Maybe he should fine his girl friend if she is still around

She has probably left him and he is chasing her round the world for his 800 baht

If they gave u a discout to 799 baht would that be ok

I'd suggest going to the courts over this blatant rip-off. You start by making a formal complaint to the police, and hire a lawyer.

Until the case gets settled your passport will be confiscated, and you will have to stay in-country.

These procedures are fairly uncomplicated. Over the next couple of years you will have to occasionally show up at one hearing or another with your lawyer (and translator if you are not fluent in Thai). In the meantime you are free to enjoy the beach life.

I wonder if anyone has used this ploy as a Visa dodge?

A way of staying in the Kingdom without doing the Visa runs?

Just asking like ... not suggesting like!
