Hi,

Thanks for your great forum.Fantastic!!

I got a letter from the Asylum Immigration Tribunal telling me about my Hearing date and place. One of the pages sent says that I must send:

1-Witness statements of the evidence to be called at the hearing, such statements to stand as evidence in chief at the hearing

2-A paginated and indexed bundle of all the documents to be relied on at the hearing with a schedule identifying the essential passages

please explain :

1-What are witness statements of the evidence?

2-what documents they mean? are they the same as the ones I sent with my appeal form to counteract ECO arguments(Banks statements, pay slips, utility bills etc...)?Must I send wedding photos, letters?

We have no legal representative, but I can prepare the documents. It's a spouse appeal outside Uk

Your advice will be greatly appreciated

Thanks

Azer1,

What you need to do is provide a witness statement in which you briefly outline your skeleton argument, using bullet points. Each witness will require a witness statement. You then collate your witness statements and the documents upon which you will be relying and number them 1,2,3,4 and so on. Once you've done that then prepare a schedule upon which you list each document and the page number, e.g Fred Bloggs' witness statement - page 1, bank statements - pages 2 - 5 etc. If you wish to top off the job, then you can make reference to schedule in the witness statement, e.g. "I have adequate funds with which to support my wife (schedule pages 2 - 5)" Place the schedule on top of your bundle and send a copy to both the AIT and the Presenting Officers' Unit. Also keep a copy or 2 spare.

Here's a schedule you can use as a guide.

If I have time, I'll post a template witness statement too.

In a witness statement you should state the facts of the case as the witness believes them to be true and you should do one of these for each of your witnesses. Each witness should sign and date his/her statement.

Your collection of papers should be assembled together and the top sheet should be a schedule which lists all of the documents in your bundle and their page numbers. The following documents should then be numbered according to the schedule. This is what is meant by a paginated and indexed bundle.

Hi Scouse,

Thanks for your great help

Hi Scouse,

For some reasons, the attachments can not be opened. I was wondering if you would be able to attach a sample of "WITNESS STATEMENTS OF THE EVIDENCE" and "schedule identifying the essential passages" . I need to prepare for my hearing.

Many thanks

Jo
