Australian Visa Condition "8503", Nfs - Why It's Imposed

Hi Gang

This case involves a Russian woman but it could be applied to any "high risk"
country such as Thailand.

There is always lots of discussion on here about 8503 being imposed for Thai's.

He is a good example of why it's imposed and is hard to get lifted.

Wonder what would happen if she was to far pregnant to fly?

I also think her bf is getting a bit carried away with the whole financial ruin bit. I mean it's not a free process but surely they considered these things when she moved in you would think anyway. The whole thing seems a bit heartless by diac, but if they let her stay on these grounds, it would open the flood gates for others I'd imagine.

The circumstances in which the minister may waive [condition 8503] are:

(a) since the person was granted the visa that was subject to the condition, compelling and compassionate circumstances have developed:

(i) over which the person had no control; and

(ii) that resulted in a major change to the person's circumstances;

Pregnancy would not be considered a circumstance over which the person had no control.

All seems a bit sus to me.

She arrives in Australia with a three months visa and almost immediately joins a dating site.

She then finds someone and almost immediately gets pregnant.

I think that was her intention all along; get pregnant by an Australian man so she could remain in Australia.

Should have read up on the rules first!

As we discovered on the other thread ... you are allowed to fly up till 8 1/2 months pregnant.

She can go home and then apply for a Visa ... just like everyone else.

I'm tired of the sympathy card being played.

Half of me thinks the only reason the media picked up on this particular story is that she looks pretty on the photo ... what about the 100 other that are in the same position?

Some times we are subtly feed by the Media ... but on this occasion ... I'm not biting.

IMO, that would defeat the purpose of her true intentions, which was

to snare a husband.

Anybody that thinks Ms Zaydenberg came to Australia for study and

not to find a husband, also believes in the tooth fairy.

I see they already tried that route providing a letter from a Doctor saying she should not

undertake any "unnecessary" travel.

Bottom line is, if she couldn't travel due to the pregnancy, she would be placed on a Bridging

visa E until a time when she could.

That gets very messy and political though, which is why it's often tried.

I'd suggest banging away like a dunny door until she got pregnant isn't

something they had no control over.

I think this guy is going to be in for a world of pain.

I think it's shocking that he involved his kids by being

photographed for the paper. Like David48 said previously,

just playing the sympathy card.

It's one thing to want to be with someone, but another

Every person has their dreams of which country they wish to escape to ... Tahiti is up there on my list ... but that what it remains ... a dream, an aspiration.

Some people try and materialise that dream.

Just reading the News story in the OP, it seems that the Man found his dream girl and this dream girl found her dream country ... just that the Australian Government has a wee say in the proceedings.

The test of the relationship is if the birth actually occurs (in Russia or Ukraine), the relationship survives and the lady is granted residency here. Her case is no more desperate then 100's of others.

The Aussie government is currently paying 6 billion dollars a year to maintain facilities for illegal migrants, arriving in Australia by Indonesian fishing boats every day.

No-one has come up with a solution which will deter them and the Indo govt seems to turn a blind eye to these craft setting sail on a daily basis.

No use suggesting turning the boats back as that's against maritime law - or it is as soon as they pull the plug and start sinking. They have to be rescued.

In my own personal case my Thai lady had the no further stays on her visa

while in Australia she became pregnant

we had no idea till we where back in Thailand

on out next trip to Oz we had to take a trip to NZ as she was on a Multi entry

She visited the Gold Coast hospital who worked out the birth date

then we decided to get a specialist to look after her

He had a different opinion of the birth date and said she was due to give birth earlier than the hospital said

Came the time for her to return to Thailand and 2 months before the birth was due

when we went to see the specialist he did a check of the baby and sid she would give birth in 3 weeks

There was no letter advising

But a letter saying "HE DENIED MY THAI LADY TO FLY" due to the fact that the Hospital had it wrong and that we had planned her return to Thailand on advise given by the hospital which was incorrect"

With this letter it was decided by Aus. Immigratiion to remove her NO FUTHER STAY and granted her a Bridging Visa

years later she is now an Australian citizen

Moral: does she appreciate her good luck

No way, in her mind it was the Australian government duty to allow her to stay as she was pregnant

End of the story:

1 week before she got her Australian citizenship, she was gone and living with another guy who had a better income than me, and she had only met 2 times before, And left the child with me.

Again It was my duty to do all I did for her

No matter what you do, when the time comes, there will always be someone better than you

Actually the previous government had great success with their policy of ...

OK ... you're a refugee but no ... you can apply for your brother, sister, parents, uncle, grandmother to piggy back your 'Family' migration Visa.

The family saves all their pennies and sends one. That one then applies for the others.

I'm all for Refugees ... but let us decide who we take and let's take a broad spectrum of Cultures and Nationalities to enrich what a great nation Australia is and not those economic refugees who can afford the taxi fare across the ditch of $5,000 - $10,000, are of religious orientations which get Christmas banned in some loony left Councils.

No Johnny, no Christmas Christian Nativity play this year ... we don't wish to go and upset the others now do we?

I am not surprised by the Aussie Immigration stance. The best laid plans o' mice an' men oft gang a-glay. Maybe she should have tried the UK. They'll let anyone in - except Thai born wives of natives.

Are you referring to asylum seekers or illegal immigrants? There are 13 times more illegal immigrants than there are asylum seekers in detention who have arrived by boat. There are 4446 detained boat people, the largest national grouping of which are Afghans (1422).

Just check the Russian dating sites, there are hundreds of them qeueing to get into Australia. So why should she be the one to get preference, she jumped into bed and got preggers too bad, or was it intentional ?

Yes, but you have to realise that she is Thai ! and the other is Russian. I have met several guys tricked by Thai ladies !
