Ed visa with wife and child on Non-Imm O

Hi all.

I just got an ED visa that must be renewed in 90 days. My wife and daughter both applied as well and go non-im O visas that also need to be renewed. We are hoping to stay in country for a year.

My language school just informed me that we will need a bank statement showing 500,000 baht in an account in order to renew my wife and daughter's visa. They said it is a requirement of the dependency visa. All I've been able to find online is that same bank statement req for the dependency visa when parents come who have a child studying in Thailand. Am I correct that my wife and child don't have dependency visas? Does anyone know if this rule still applies to them?

looks to me like your Daughter will have permission to stay based on studying and your Wife will have permission to stay based on having a child at school.

500,000 baht in the bank is needed for your Wife's extension.

You are studying and will get an extension of stay under 2.9 of the rules. An extension of stay based on this opens the possibility of your wife and child to be a dependent of you under rule 2.11, this doesn't require 500,000 baht.

The 500,000 baht requirement is when a child studies in Thailand and a parent want to stay in Thailand as a dependent of the child, to take care of the child. That is not the case here.

2.9 In the case of enrollment in a private educational institution: Permission will be granted for a period as confirmed by the institution but shall not be more than 1 year at a time.

(1) The alien has obtained a temporary visa (NON-IM)

(2) The particular educational institution holds a license from the competent authority to operate; and

(3) Confirmation and request has been made by that particular institution; and

(4) That particular institution is accredited by the competent authority (except in the case of enrollment in an international school or university)

2.11 In the case of a family member of an alien who has been permitted to stay temporarily in Thailand for study in an educational institution as set out in clauses 2.8 or 2.9 (applicable only to parents, spouse, children, adopted child or the child of his/her spouse):

Permission will be granted for a period of not more than 1 year at a time.

(1) The alien has obtained a temporary visa (NON-IM);

(2) Proof of family relationship; and (3) In the case of spouse, the marital relationship shall be de jure (legitimate) and de facto; or (4) In the case of a child, adopted child or child of his/her spouse, the said person must not be married, must be living with the applicant, and must be less than 20 years of age; or

(5) In the case of parents, there must be an account deposit with a local bank made in the name of father or mother of not less than Baht 500,000 as shown in bank account transactions for the past 3 months. For the first year, it should have that said amount in the bank account for not less than 30 days at the submitted date of the application.

From those rules it looks like the school is wrong and I'm fine without the bank statement. "In the case of parents" seems to mean in the case of parents of a student. I'm the student so my wife and daughter should be fine. We have the other documents and I found it weird they were issued the visas without the statement, but would need it to renew. Is my understanding correct?

Yes.

Another thing you might want to consider is that your dependents extensions will only be as long as yours.

If your extensions are only 90 days long that means doing 3 extensions every 90 days.
