1yr Extension of Stay required to apply 45 days before current Extension of Stay

Featured Replies

This morning I went to Sisaket Immigration to apply for an extension and I was told I was required to submit my request for 1 year Extension of stay 45 days before my extension of stay expires. My extension of stay is on a Non-Imm O visa issued in 2010. Since it was issued I get it extended based on teaching or marriage. The last two extension and this one is based on teaching at a government school. I was told all Non-Imm visas that wish to extended 1 year must submit their paper work requesting an extension 45 days prior to end of extension to stay or 45 days before end of visa. For me my extension of stay ends March 31, 2014 and they told I return by Feb 15 to submit my 1 year extension. WFT? If less than 45 days they will not accept requests for 1 year extensions.

It seems to me you were more than 45 days early and that is what they were saying not that you have to do it 45 days early.

The 15th of February would be about 45 days early if your extension runs out on the 31st of March.

It is interesting though that are using 45 days instead of 30 days as the earliest that you can apply. That means that it is nationwide now not just a couple of offices.

Kap Choeng Immigration allows up to 45 days early.

My extension to stay was to expire Feb 3, 2014 and I took my current school contract which was valid until March 31. This allowed me to extend to March 31st. The head of office asked why didn't you ask for one year, I said because I do not have a new contract yet. He Laughed and said tell the school we now require if you are extending to stay for 1 year to submit your paperwork 45 days before. He got out a calculator and said today is one day, feb is 28 days and March is 31 days, so you have 60 days left. You need to report back here by feb 14 to request your 1 year extension otherwise it will not be accepted and you will be required to get a new visa.

Btw, I asked him in Thai and English, I verified all the facts. He explained in Thai and English and even did all the math in front of me and was training two other staff which I have known for years. I know what he said, even if I do not believe it and hope he is wrong.

Immigration has no such policy.

I guess it could be something Sisaket is doing on their own. But I do really doubt that if somebody went in with less than 45 days they would refuse to accept the application.

Our school has 29 foreigners and is confirming the requirement so I expect by Monday more details. Right now they are saying it is because all information is being sent to Korat. Korat is verifying with TCT the teacher license, verifying work permit with labor dept and immigration history. I am hoping Monday someone will come to their right mind.
