Does anyone know anything about the MOE's "Foreign Teachers Act"? Presently, one of my teacher friends is mired in a termination dispute regarding termination benefits and we are trying to locate this act.

All information or suggestions would be greatly appreciated.

Actually, I haven't heard of this but I will ask people. I would be very interested to know about legislation with this title myself.

I know recently some Int school teachers got screwed in regards to Labour Laws as they basically said it don't apply to them (will try and find out more).

Never heard of the "Foreign Teachers' Act" but this link will take you to the English version of the Thai Labor Protectection Act of 1998. Chapters 5 and 11 will probably be most applicable to you friend's situation.

The Labor Court in Thailand is very sympathetic to the employee and the fact you are foreign won't prejudice you at all. They can provide a lawyer free of charge to prepare your case to present to the court. There are 3 judges and they use common sense to make their decision. They've heard thousands of lying and cheating business owners and they seem to be quite intolerant when these people start bullsh*tting.

Also, does anyone know if the Labor Laws legally apply to foreigners??

Basically they weren't due anything (it was ruled) as the Labour Laws didn't apply to them (will try to get more info).

They sure do.

A few years ago in Chiang Mai there was a teacher working - I believe - without a wp on a tourist visa at a school called Prestige. The owner sweet talked him and convinced him they were buddies, played golf together bla bla... BUT! he was never paid a salary... the owner had made him believe that the teacher was going to be part of the company, shares, you're one of my family bla bla.. After 6 months the teacher was broke and lost patience with the bs... and was then sacked. the teacher took him to the labor court, even though he had no wp or visa, and won. Haven't heard of him since BUT he won in the labor court.

Go to the ministry of labor who will support you and guide you through the labor court process.

One more thing. In reading the Department of Labor Act, it very clearly states that foreign teachers in private schools are not covered by this act, but rather by the Private School Act. Anyone have any information about this act??
