Court officials inspect property development in Phuket

Court officials and the architectural expert discuss aspects of the development.

PHUKET: Officials from the Administrative Court in Nakorn Si Thammarat yesterday (February 5) visited the construction site for the Eva Beach condo development in Rawai.

The development is the subject of an ongoing case being considered by the court. The case was brought by a local resident who alleges that the Rawai Municipality should not have issued a building permit for the development, said the head of the Municipality, Arun Soros.

Accompanied by an expert from the Architecture Council of Thailand, the court officials went to see the site for themselves and to meet representatives from the developers, Eva Group.

The architectural expert will submit a report that will be sent to all sides in the dispute and the court “will make a judgement later”, an official said.

Have a look at google earth and the historic photos and you can see that this development is clearly breaking the law in regards to the setbacks. Their weak excuse is that the Tsunami took away a lot of beach and they were legal before. This is bull**** as the Tsunami did not take away any of the beach and in fact brought a bit more sand. Word has it that the "judge" has been delaying the final outcome for some time now thanks to .......................

Perhaps issues like this should be tried in a military court instead.

Redistributing the wealth is always a good Idea.

The military have done such a good job with the jet boats rental agents and other unlawful people in beach areas. Did nobody on TV forum see his speech where he even mentioned that the jet boat operates too must think of ways to help tourism in this hard economic times.

The evason hotel was even more guilty of this. Didn't see them get heat.

Their pool was basically built in the bay.

They were gone long before this (law enforcement) started.

Doesn't change the fact they just built on the bay and once the renovations finish and the rebranded hotel reopens it will still be illegal, unless they demolished it which I doubt.

It's much worse than the Eva.

Serenity Terraces looks pretty suspiciously close to the high tide line also. I remember when it was a restaurant run by an Aussie bloke and we would site right on the dry side of the retaining wall which is now where the condos are situated. Maybe they are grandfathered in somehow.........................

According to the gazette in this article http://www.phuketgazette.net/phuket-news/All-Eva-Court-probe-opens-door-new/48308#ad-image-0 Buildings are only 7.5 metres from the water, making them illegal as nothing is supposed to be built within 20 metres of median high tide line.

Guaranteed there is much less than 75% uncovered space, as they built this covering pretty much all usable land.
