Cancel extension of stay without termination letter from ex-employer

Featured Replies

Dear all,

I recently resigned from my job and my employer canceled the WP around one week ago but only informed me on friday afternoon about this. I have to admit that I should have paid more attention to this.

Anyway, it seems that my employer does not want to provide me with the "Employment Termination Document" from which I understand is necessary for cancelation of the extension of stay. I also understand that I am already on overstay.

I want to do everything legal and therefore I suppose I have to cancel my extension of stay, then leave the country and come back on a tourist visa. I also plan to move back to my home country first week of may. Therefore I need a proper and legal visa for April.

As I said, my employer is not willing to provide me any documents. So my plan is to go to the one stop service in chamchuri on tuesday morning and try to cancel the extension without the letter. I am still in possession of the WP, so they should be able to check if its already canceled and then print out a paper for immigration?

Can anybody advise, if this will work? My extension of stay is valid until december 2015 and I have multiple entry permit.

Thanks in advance.

I had to get a employment cancellation letter from my school when I was stopped at a border crossing a few years ago. They would not let me out without one being faxed to them as the border crossing was not just down the road for me. Luckily my girlfriend went to my employers, who then with the letter went to the labour office. Back to my employers with a letter from the labour office for the boss to sign and then faxed. Caused my hassle and 2 hours stranded in the immigration office at the border. I was not the only person in the same situation. By law I am sure that your employer must provide the letter if you request it. If they refuse go to the labour office and explain your situation and see if they can help you, take a Thai that you trust if you can. Good luck!

You can try to get it cancelled at immigration but I suspect they will not do it without a letter.

Since you apparently have a valid re-entry permit this complicates matters because without it being cancelled immigration on arrival back in the country probably would insist on using it. Otherwise you could fly out and back to cancel your extension.

Thanks for your answers. Will try to sort it out tomorrow and update the result here for future reference.

Just fly out.... you don't get stopped at the airport. Only 4-5k Baht to Phnon Penh.

Yes they stopped me at the border at Mukdahan last week. Luckily I happened to have a letter from the school which I hadnt given much thought too until that moment. After showing the letter they cancelled the xtension and let me through.

Ok guys, here is what happend today.

I went to BOI chamchuri today to sort out my visa issue and to get a clear picture on what to do next. Unfortunately my ex-company still refused to give me any paper.

So while I was waiting there, suddenly a guy from my ex-company's lawyer entered the room and I recognized him because he did the visa and wp in the first place. I asked him what to do and he said that I need the WP cancellation letter in order to cancel my extension of stay. I told him that I don’t have it and that my company does not want to give the paper to me. So this guy left for 10 minutes, came back and gave me the paper!!! :D

Best thing: It turned out that I still did not overstay because they granted 7 days grace. WP was cancelled on 1st of April. Which means I have to do a visa run today but that is fine.

In that case, I believe my multiple entry permit would be a problem as they would most likely use it instead of issuing a new tourist visa.

I thought you had a non B extension. As for the "multiple entry permit" (of unknown visa type) leaving by air or land makes no difference to whatever they'll do...

How you can have a non b extension AND another unknown multiple entry visa????????? You can't have two visas at the same time.

Beside that is possible to have two visa at the same time, he means exactly the "multiple re-entry permit" that anyone can get at immigration, cost Bt 3,800.
