You should be fined for gross stupidity for smoking, full stop.

Apparently there is a law where you are not permitted to use a mobile when riding a bike in the rain - seems to be very pratical as the 'spare hand' is already holding an umbrella

All US states, most European countries including the UK have laws that deal with 'unsafe operation of a motor vehicle.' Even in a car, a cop can give you a ticket for this if you only have one hand on the wheel. I received a 'warning' from a CHP who stopped me while I had one hand on the steering wheel and the other arm resting on top of the passenger seat years ago. The law is very ambiguous, and leaves a lot of room for a cop to interpret however he sees fit. But one hand on a motor bike narrows the margin.
