Working permit, 1 year visa, job lost whats happen?

Dear all, thanks to help,

My friend from the Philippines got a job in Thailand. She got a one year work permit, then an extension of visa for 1 year. Recently she has been fired as her company has bankrupt. On her passport she has a valid visa (for working purpose) for 8 more months with multiple re-entry permit.

My question is:

Even so she lost her job, is her VISA still valid? Will she have a problem to stay 8 months till the end of her visa? Will she have problem while re-entering the country after a trip in her home country coming back within her visa validity?

Sure the experts will reply soon, but as far as I am aware the Extension of Stay based on employment (not a visa anymore) ends as soon as employment ends. She can go to immigration and get a 7 day extension to get her affairs in order.

As said when the job ends the extension of stay ends.

She would need a termination letter dated for when she goes to immigration to cancel the extension and apply for a 7 day extension.

She could leave the country but the re-entry permit could cause problems on entry to the country if she comes back.

- When leaving the country the immigration staff can KNOW that the job is finished (may be by typing the extension of stay number?)

- That then she is considered as overstaying in the country? with the penalties associated with the overstay? Fine, blacklist?

Thanks for those precisions. Particularly, can the immigration know that the extension of stay in her passeport is no more valid?

They would not know that the extension is invalid unless somebody went to immigration and canceled it.

There is nothing but the overstay fine of 500 baht a day up to a max of 20k baht. There is no blacklist or any repercussion from it.

This scenario used be simple (but illegal) to stay since technically visa ends with job but no way to check.

Now immigration etc are more computerised it is harder.

Know several people who were stopped and not let out at border since they had a valid visa and no reentry. Airport home maybe easier.

In this case needed to email a letter of termination from company dated that day while they waited at border.

The not being allowed to leave only happens to teachers during school terms I imagine. I travel regularly and hold a WP and extension based on work (not teacher), and never been asked anything when leaving or returning. They sell the re entry permits for a reason.

As for your point that immigration is more up to date with what is going on I agree. It wouldn't surprise me if they check every now and then with labour dept or social security if a person having extension based on employment is in fact still being employed and taxes and social security are being paid.

No, they do the same to ED extensions holders or whoever that appears to be leaving in order to come back with a new visa from the bordering town. These people purposely do no have a re-entry permit.

Nong Khai is no longer asking for the letter of termination, (though of course they may start again at any time).
