The court upheld the rulings of the lower courts that Chalermchai, alias Major Tueng, and two accomplices - Sgt Manit Srisa-ard and Sgt Suwat Kham-ngao, murdered Prina Lepattana, then Yasothon governor, on March 4 2001. The murder took place inside the Royal Pacific Hotel on Rama IX Road. The court said the three checked in into a room close to the slain governor and there were evidences to believe that the three attacked the governor by stabbing his neck and shooting him at his head. Pisarn Wibulsilp, the lawyer of Chalermchai, said Chalermchai would plea for leniency from the Corrections Department due to his military service.
