Constance Fisher drowned her three children in a bathtub in 1954. Mental hospital. Declared better. Released.

Husband stayed. They had three more kids. She drowned those three too. Same house. Same bathtub. Same excuse. Six dead children because a system treated a child killer like a patient who just needed time.

That is the whole argument. Not “was she sad.” Not “did she hear voices.” What happens after you let them out, and who pays for it the second time.

Your personal jury (maybe imaginary) story is not a shield. This is not a small city case with an ‘unpopular’ outcome that only the twelve people in the room can possibly understand.

The jury has 80 witnesses and 300 exhibits. If they cannot decide whether she was criminally responsible for that then it is not some deep mystery of the juror experienc. It is a huge failure to apply the law to facts that are not in dispute.

I studied the defence of provocation at law school. One requirement was the provocation had to be immediate, the response had to be close in time, for the provocation to be usable as a legal defense. Not for women though. They found a way to absolve a woman who planned to burn her husband alive, namely "battered woman syndrome". If you are a woman you can use that defence, kill your husband after years, after months of planning, and still use provocation as defence.

Different rules apply for women.

So a 56 year old woman tried to intimidate the jurors by filming them, a Clancy supporter. Security guards found the photos on her phone, after she lied she just wanted to take a photo of Clancy. But she actually took footage of the jurors. She has been charged with trying to intimidate jurors.

I don’t understand. For decades, feminists have argued that women have full control over their minds and that even pointing out mood changes during a cycle is just male misogyny.

Now, that entire argument is getting thrown out the window because the Lindsay Clancy defense is literally claiming in open court that hormones can turn someone into a deranged psychopath capable of child murder. It’s wild to watch that narrative completely flip.

A not-guilty finding based on hormones and insanity would have crazy implications. For example, if hormonal states can legally erase accountability, why wouldn’t they also affect fitness for jobs, high-pressure decisions, firearms, and parenting?

Courts cannot treat a woman as legally insane for the worst possible act and then pretend the same reasoning has no implications anywhere else.

Also, Lindsay Clancy is no more insane than Jeffrey Dahmer, who was diagnosed with borderline personality disorder, schizotypal personality disorder, and a psychotic disorder, and yet, he was still declared legally sane at trial. For the sake of those children, and for the sake of all the good that’s in this world, I hope the jury makes the only sensible decision here.
