Government to use Section 44 to take back Sor Por Kor land



BANGKOK: -- Prime Minister Prayut Chan-ocha will invoke Section 44 of the interim constitution in his capacity as the head of the National Council for Peace and Order to issue an order to take back Sor Por Kor (land reform for agriculture) land from any individuals who occupy more than 500 rai of the land.

The Ministry of Agriculture and Agricultural Cooperatives is drafting the order which will be vetted by Deputy Prime Minister Wisanu Kruea-ngarm and the Council of State.

Prime Minister Prayut said that, as a matter of fact, the government can reclaim the Sor Por Kor land from anyone who occupies more than 500 rai of the land because it is illegal for any individual to occupy that much land.

In reality, he admitted that it was difficult to solve the Sor Por Kor land problem because the problem has dragged on for a long time and has become more complicated.

Taking back the Sor Por Kor land does not mean the end of the problem or the problem is solved, said the prime minister, adding that the government will have to take into consideration what to do with those whose Sor Por Kor land are reclaimed and where they are to be relocated.

“We have to figure out how the action to be taken will cause the least troubles to the public,” said the prime minister.

How about relocating them to jail? Just an idea.

500 rai is about 173 acres or about 70 hectares, a very very sizeable chunk of land.

And what is going to happen to those who illegally occupy less than 500 rai, like certain resorts operated or owned by certain bigwigs? Will they go free?

The Sor Por Kor land issue was never complicated, as the general claims. In fact it's pretty much straight forward: You get land from the government for free and are allowed to use it for yourself, primarily for agriculture. You are forbidden to transfer or sell the land to anyone else. If you do, you break the law and will be punished, as well as the party taking possession of that land. Easy as pie.

What has always been complicated was enforcing that law.

Take back the land, give it to the peasants and then the peasants will resell it to the original land owners. Yup, problem resolved all right.
