  1. Below are the average cop deaths and assault injuries per year for the last 10 years:

149 deaths per year 58,930 assaults per year 15,404 injuries per year

By way of contrast, only 12 British cops have been killed in the line of duty in the last 10 years.

US cops are working in urban war zones in some areas, unlike cops in UK, China, North Korea and etc.

  2. Lol, just love reading posts from internet trained and internet educated legal experts .

You don't think the pause was significant? tongue.png

Not anymore significant than the first 7 shots fired.

This is just an incredibly sad incident for all involved. My heart goes out to the family of the guy killed and to the cop's wife who is 8 months pregnant and their unborn child.

I doubt seriously that cop woke up that morning and said he was going to go out a kill and unarmed black guy and ruin his life, his wife's life and his unborn child's life.

There is obviously some catalyst that caused him to fire or he simply cracked under the stress of being a cop in a large urban area where crime rate can be bad and he constantly has in the back of his mind that he just wants to make it home to his family.

And youre coming across as an internet educated psychoanalyst who is trying too hard to defend the actions of a bad cop.

Did it ever occur to you that shooting someone who is unarmed while running away from you in the back 8x does not indicate fear for one's well-being.

If anything, this cops actions and subsequent behavior reveals the callousnous and cold blooded killer instinct of someone who believes they will not suffer any repercussions for their actions. Why, because he will have the support of his commanding/fellow officers absent any evidence indicating foul play.

Obviously, the cop was wrong but it took video evidence to prove. How many countless times before has this and similar scenarios played out without the benefit of a video record.

Let's also not forget the random, frequent lynchings of blacks that were deemed socially acceptable not too long ago in US history.

I have known and represented a lot of cops in rough urban areas where gang violence is prevalent including a family member. It wears on them and changes them. Guys with wives and children are particularly on edge and every day their goal is to make it home to see their families.

What happened was despicable. I also though the choke hold case was despicable. No doubt there are bad cops out there.

I am just not inclined to think or judge this guy an evil person or a racist without knowing more about him or his background and history. I am more inclined to think the dude just snapped and went hay wire on adrenaline until something says otherwise.

I have known very good people that were cops that have reacted pretty aggressively in chase situations. A combination of fear, adrenaline, anger and etc. is hard to temper when day in and day out you live on the edge and see really bad stuff.

    RE: Video

Not sure I agree that this cop would not have had trouble absent the video. 8 shots in a guys back from a distance. They would have figured that out.

Cops dash cam showed that the dead dude did bring this on himself. You just don't run from cops and then you really don't try and fight them off. True, he did not deserve to be shot, but he set the events in motion. The cop did not seem aggressive at all when he pulled the guy over, got his license and went back to run his license.

  3. The state and local authorities have responded well thus far to the cell phone videotape and are saying they had certain suspicions before seeing the tape.

We recall however the Feds are also investigating, the Justice Department, to include the FBI and the Civil Rights Division. CRD enforces Title VI of the Civil Rights Act of 1964, as amended. The facts of this case seem to match the provisions of Title VI that present an "under color of law" conviction.

Under color of law refers to police or other law enforcement personnel who commit a violation of the Civil Rights Act and the Constitution, such as singling a person out because of his race. Which is why DoJ enforces Title VI.

I've edited Title VI due to the legal language so the link is provided for anyone who might want to read it all. I edited several phrases or clauses of legal language, such as "any State, Territory, Commonwealth, Possession, or District" and similar stuff.

18 U.S. Code § 242 - Deprivation of rights under color of law

    Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State....to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties .... by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both;

    and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon.... shall be fined under this title or imprisoned not more than ten years, or both;

and if death results from the acts committed in violation of this section or if such acts include.....an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

    https://www.law.cornell.edu/uscode/text/18/242

Title VI is 42 USC 2000.

  4. So is fried chicken, chitlins and salty collard greens. Actually, many dietary items really create immediate and dire health concerns, but once again . . . Doofus boy either doesn't get or cannot get it because it ain't politically correct due to his base.

That said, I do believe GW is a serious long term problem, but for Doofus boy to try and scare people about health concerns over GW is disingenuous when he doesn't mention or address more serious and acute factors that have more dire consequences on the populations health or economy.

In fact, it occurs to me that many eating these horribly ethnic types of foods are such more prone to cardiomyopathy, diabetes, hypertension, PVD, renal failure and obesity in those that had no insurance (now free Obama insurance) and no means to pay for their bs.

Now with free Obama insurance, these irresponsible, lazy edits raise insurance rates for the rest of us that are health conscious so screw GW concerns. Obama needs to focus on something that is acute regarding to health concerns.

  5. Well I'd say letting this POS out and giving him $ 25 mn was a great use of resources. A lot of these so called wrongly convicted were gang members IDed by other gang members that were typically survivors of the crimes. Don't run with gangs and commit crimes and might not be in such a position . . .

    __________

Even $25 million can't keep wrongfully convicted Chicago man out of trouble

It was Jimenez’s seventh arrest since he hit the figurative lottery, winning a $25 million jury verdict in 2012 in a wrongful-conviction lawsuit against the city of Chicago stemming from a murder conviction that was later vacated.

The cash has provided Jimenez, who’s now 35, with homes in Chicago and the suburbs. He also has 14 vehicles registered in his name — including the $130,000 Lamborghini sports car, a second Lamborghini, a Bentley convertible and other expensive vehicles.

    . . .

Since winning his own freedom, Jimenez has rekindled his childhood association with the Simon City Royals street gang, according to police sources.

    . . .

On the streets, a lot of people know about the guy who won the $25 million wrongful-conviction award, drives the blue Lamborghini and still keeps getting in trouble.

“Everybody is hearing about his newfound notoriety on the streets,” says Tio Hardiman, former director of the antiviolence organization CeaseFire. “He wants to become a rising star in the gang lifestyle.”

  6. I can't blame the guy for being a suicidal maniac. He was just doing what suicidal maniacs do. The fault is with the airline and any German laws that not only sacrificed the lives of 150 people because of "privacy" concerns, but with a system that even knew he was psychotic and still wanted to give him a career. How all self righteous they must have felt--until that jet went directly into the side of a mountain.

Felt self righteous? No, I think they felt sick to their stomach. What kind of person writes such a thing?

The situation presents a very interesting dilemma. Should everyone with episodes of depression, alcohol or drug use or anxiety be precluded from ever having a Class 1 medical? What if the issues were entirely situational or a one-off episode? Where do you draw the line? Should the same rule apply to bus drivers, taxi drivers, doctors or anyone charged with someone's safety or welfare? What about construction workers or lawyers charged with someone's freedom?

While we are at it, prohibit these same people from having a driver's license, from operating a truck and from ever having a gun.

Let's take it a step farther. If the pilot has any connection to Islam or is a Muslim, let's not let them be a pilot or have a job where they are charged with the safety of another as they, like the depressive type, may snap or convert to an extremist position at any moment.

It is not just German laws. Many country's have privacy laws regarding medical treatment. The airline stood behind a person and tried to help him work through and overcome his issues s that he could live out his dream. That was not evil or bad on the airline.

The alternative here is to now ban everyone with a medical or religious predisposition of losing it from ever having an occupation in which they are charged with the care and safety of others. Lol, let's do that and then ship them all off to places like Thailand where they can teach.

  7. I cannot imagine the mental anguish and torture of spending 30 years on death row knowing you are innocent of the crime! I hope the state of Alabama awards suitable restitution.

I hope he will sue and get a lot of money, not that it will bring back 30 years.

He will get a ton of money and he doesn't need any money himself to get it. There is so much money here that a really good law firm will take this case on a contingency - for part of any award rather than the normal hourly fee. The law firm will front any costs such as court costs, expert witness fees - everything. Because they have a financial interest in the outcome they will do a fine job and go for the throat.

The award is collectible because the defendants have deep pockets. The defendants appear to be the county in Alabama whose employees were the prosecutors. The state will also be sued because it has jurisdiction over the county in that it's a state court in that county. Also it's likely that the state crime lab did some of the initial work which convicted him. Few counties have a lab like that to do ballistics tests and certainly not 30 years ago.

Because the behavior of the state and county was callous and outrageous, a jury is going to be outraged. That jury will be at least 1/2 black and will be ordinary citizens of the state. The trial will probably be moved out of the county to avoid any conflict.

If there is a hint of racial bias in this case it's a federal offense and the feds will drop the hammer too. It could wind up being tried in federal court if there are both state and federal complaints against the defendants.

This is going to be one of the biggest monetary awards we've ever seen because the evidence was right there for at least 15 years and the defendants refused to act on it. The award will be trebled by the court due to the nature of the offense. The jury won't be told that in advance. I don't see less than $30 million and it could be a lot more.

    Cheers

Doubt there will be a change of venue and the case will likely be settled without ever going to court.

    Observations:

He was picked out of a line up by an eye witness. Experts did not conclusively establish that the bullets did not come from his gun. The examination appears inconclusive. He has not been exonerated. He actually could be guilty, none of us actually know and none of us are actually in a position to judge.

RE: Wealth results in better defense fiction

Evidence and forensic examination, as well as measures in place for defense of death penalty cases has changed a lot since his case was originally tired 30 years ago. Some of the best criminal defense lawyers in each state are now on the death eligible case defense list for indigent defendants. Defendants in death eligible cases get 2 lawyers and have unlimited access to experts of their choice. Accordingly, wealth of defendants has very little to do with defense in death eligible cases anymore and indigent defendants perhaps get the best defense money can buy and certainly get a better defense than 99% of the US population could afford to pay for . . .

The reality is a poor black man will get a much better defense team than the middle class white family dude with limited means these days. That said, carry on with the Stella urban legend verdict and complete and utter lack of knowledge about how the legal system works. Gotta love all of this education by the Internet.

  8. In some states, they end up paying about 1 million (or much more) to the person incarcerated. I think I read of a guy getting 3 million.

The 150 people on the airplane, I read, get at most 150,000 USD. And they are trying to give them 50k for each life.

    It's one weird world.....

And the woman who puts her poodle in the micro wave or the woman that spills MacD coffee in her lap get 5M+ each

At least get some of your facts correct if trying to make a valid point.

The microwave dog case for millions of dollars . . . urban legend. Dorothy Johnson's case was quickly dismissed.

The plaintiff in the McDonald's case did not "5M+" and you clearly do not understand the case, theories or the verdict. At trial, the court awarded $ 160k in compensatory and $ 480,000 in punitive damages. The case was settled for less pending appeal. She actually had horrific injuries (3rd degree burns over 6% of her leg including genitals) and McDonald could have settled the case pre suit for just the hospital bills.

More examples of educated by the Internet.

  9. What the country had better start "addressing", as local law enforcement put it, is this (al.com - What we know so far about David Daniels):

"Daniels was never particularly violent, according to Sharon Daniels, his mother. "I've never known him to be violent towards anybody," she said. He was one of her 14 children and grew up in the Alabama Village community in Prichard. But he did become more difficult over the years, she said."

    (emphasis mine)

Without being ethnicist (aka racist), I would bet there were multiple fathers and none of them resident (on paper, at least) in order to ensure maximum welfare payments.

"Without being ethnicist (aka racist), "

That's exactly what you AND your "likers" are.

One look at the photo...he's black, therefore his mother has multiple fathers of her children and for the reason of getting welfare.

Maybe some of your likers didn't even see the photo but made anOTHER assumption.

14 children??? Who the heck does that, especially one living in the Alabama Village community which are the projects. Completely irresponsible to have 14 children when you cannot even get out of the projects.

The we have the shooter. I think local news reported he had 6 arrests and long drug history and he was how old??? No job, no car, high school drop out . . . Maybe stereo types suck, but there is a reason stereotypes exist because some time they are absolutely true.

There's plenty of Catholic families, with one father, and not on welfare with 14 kids.

To "bet" that there's more than one father, to assume none of them are resident, to imply "not on paper anyway to maximise welfare"...of course it's racist.

Stereotypes exist, but it's the bigots that perpetuate them. As you have just done.

Do these Catholic families live in Section 8 or government housing and continue to have more kids that the government pays for?

First off, I know a whole lot of Catholic folks and none of them have 14 kids. Those with larger families 5 or 6 kids are actually very well off and do not live in government housing seeking hand outs.

Second, I said nothing about how many fathers were involved in the shooter's family.

My comment was simply what kind of irresposbile dumb arrsse has 14 children when they have to live in the projects. I suppose the kind that ain't quick enough to see the inherent problem with that . . .

  10. Comical.

Have Floridian officals been trained by the counterparts in Thailand?

I thought I was reading an article from the Bangkok post or not the nation.

Addressing anything but the real issue (ie gun control).

I was expecting to read that they would also try and prevent underboob selfies, prevent coyote dancing, wet t-shorts at songkran, and was fully expecting to hear Florida was becoming the 'Hub' for something...

I live in Destin about 1/2 the year which is next to Panama City. Though I am for gun control, the issue seems to be something other than guns or gun control.

The big change in recent years (which is un-PC to discuss openly or in the media) is the demographics of those flocking to spring break in these areas. We all know it and have seen the sift throughout the years.

Just as urban areas in other parts of the country have become more and more dangerous as the demographics shifted in those areas, both Panama City and a Western portion of Pensacola Beach have become a hot spot or mecca for low life, low rider, rap thumping wanna be thugs certain times of the year. We now have guns and a completely different level of drugs and violence showing up.

Certain events and concerts throughout the year in this area attracts the same undesirables who inevitably bring the same problems and behavior with them. Without a doubt, us locals always dread these times and events because we go from peaceful fun loving family oriented communities to loud trash cruising the streets and creating problems.

Luckily, these events and their presence only happens a a very few times a year (maybe 15 to 20 days total), but it is truly amazing how a small peaceful community can immediately change an instant when Ludicrous (recently), Three 6 Mafia and etc. play venues here or during spring break when the demographics make a dramatic shift.

Now you are telling me that idiots crashing parties with an intention of getting up to no good are a uniquely US phenomenon....and if it wasn't for them, none of this wouldn't happen.

Taking US exceptionalism a bit far aren't we?

WTH did you get that! I was only talking about what happens in Panama City which is the topic of the OP seeing as I lived 20 - 30 minutes from there since 2008 and am there fairly often.

  12. Spring break partying started in Ft. Lauderdale on a large scale after the 1960 movie, 'Where the Boys Are', popularized the location.

By 1985 it had become so rowdy that alcohol was banned on the beach.

That effectively killed it, so they looked for other places, Panama City included.

My brother and a carload of his college friends went to Ft. Lauderdale in the early '70s. They raised holy hell for three days. Booze, dope, girls, and fistfights.

But no shootings that I ever heard of.

    Times have changed.

Yep, things have changed, namely the kind of people now going to these spring break weekends. They used to be primarily for college kids ON SPRING BREAK from college . . . Now, these ring break vacations are being flooded by low life that are not in college and did not even graduate from high school (such as the high school drop out shooter in this incident). Based on his drug arrest history, age and non-working, non-car owning POS self, he was probably down in Panama City trying to sell drugs and up to no good. He certainly was not on vacation from his college work studies that week.

What is PC or any community plagued by the influx of these undesirable criminal thugs that, unfortunately, mess things up for everyone else? We would have Holder and Obama freaking out if these communities spoke candidly and openly addressed the real problem. Even then, there is nothing these communities can really do except shut the whole thing down because certain elements and demographics are ruining it for everyone else.

I can say without a doubt, Panama City is very busy all summer long and attracts a younger party generation because it is much cheaper than surrounding areas. Panama City, however, is a much different place and much more family oriented throughout the rest of the summer when the gang banger, thugs are not everywhere.

  14. Thanks for the earlier comment F430murci, but I'm sure you get equally frustrated with the ignorance in these aviation topics. I understand the public doesn't know a lot about aviation, but seems to me, the prudent thing would be to ask questions and learn something, rather than make stupid comments.

No worries. The Internet is truly an entertaining place.

There is a problem here. I don't think it is as big as it is made out to be in terms of likelihood of continuing to happen. Pilots are going to fight this stuff tooth and nail and throw out every possible excuse to try and take focus away from more stringent health and mental screening and from more cockpit monitoring. I get it. They don't want to easily lose ticket for what may be deemed garden variety or acute medical psychological conditions that may only be temporary.

  15. http://www.dw.de/gases-caused-near-disaster-on-german-plane/a-16274783

It happened before, it could have happened again - and poisoned the co-pilot in the cockpit of flight U4 9525.

That's what an expert said in German TV (Tagesschau).

Better be careful before you call someone a lunatic.

Captain poisoned the co-pilot? Lol, what kind of lunacy is that and where are the fact to support that theory? Common sense here. FO was a nut job, unstable and about to have his ticket pulled. The facts are simple. Captain encouraged to leave. He left. Door then locked and plane immediately put into a controlled fairly steep dive until plowing into a mountain. So you think the captain poisoned this loser POS that killed a bunch of innocent people and children, the poisoned victim then locked the door, programmed a nose dive and neither told ATC or anyone he was all off sudden stricken by sickness or no sounds consistent with the same . . . Whateva.

the referenced link is about oil gases, nothing about the captain poisoning anybody...

Yes, Manarak, the reference link is about oil gases, but F460murci hasn’t bothered to read the article of course, he has already made up his mind and wants to lynch the guy! What a disgusting mob on this forum!

I don't have to read the article to immediately realize it is just another self proclaimed attention seeking self anointed media expert seeking his 15 minutes of fame. They all come crawling out from under their rocks when events like this happen. Read my post a couple above where I address this.

  16. I'm curious, what poor service, have you received from a poor quality pilot? If you haven't crashed, how would you know? The fact is, you know very little if anything about the airline business, and what goes on in a modern day cockpit. If I were you, I would plan on staying home.

In this instance, it was just one nut that got into the wrong place, at the wrong time. Most of us would never think of doing such a thing, just as most of us would never think of hijacking aircraft and flying them into buildings. It may be the new reality, aviation and the world needs to deal with.

So captain sparrow you are an expert, I would suggest you know nothing of the airline cover ups that have gone on and one fraudulent cover up is one to many.

The industry is at fault here and even one of the leading aviation experts was today on TV saying the airline industry needs a shake up to prevent this from happening but you defend mad pilots and the industry captain Jack.

I'm writing as an FAA Certified Maintenance Technician, with 30 years of aviation experience. How about your qualifications, other than sitting and watching TV?

While we're at it, why don't you explain what a third crew member would do, to increase quality in the cockpit? Now's your chance to impress, go ahead and speak up.

Lol, like the Beech thing in your Beechguy moniker should be a dead give away for anyone with a little bit of a clue about aviation . . . Let's see, conspiracy nut job educated by Youtude and Alex Jones type sites v. someone who actually works with and knows about airplanes. I know who my money would be on!
