Had the Australian couples checked the law independently for themselves in both countries before committing to a surrogacy arrangement then they would have realized what they were getting into from the start. Now more than likely, they will play the ignorance to the law game such as claiming to be held to ransom by the complex legal systems of two countries, through the media, as it appears to be brewing at the moment.

    For your information, according to Australian Immigration department; The following Australian states and territories have legislation making it an offence for their residents to enter into overseas commercial surrogacy arrangements.

    NSW

    Surrogacy Act 2010

    Maximum penalty: 2500 penalty units, in the case of a corporation, or 1000 penalty units or imprisonment for two years (or both) in any other case.

    ACT

    Parentage Act 2004

    Maximum penalty: 100 penalty units, imprisonment for one year or both.

    Qld

    Surrogacy Act 2010

    Maximum penalty: 100 penalty units or three years imprisonment.

    Also,To bring a child to Australia to live, the intended parents of the child will need to apply for either Australian citizenship by descent or a permanent visa for the child. Where a child becomes an Australian citizen by descent, the intended parents will also need to apply for an Australian passport for the child”.

    Furthermore; “in international surrogacy cases where the intended parent is not a biological parent, an Adoption (subclass 102) visa is the relevant visa for the child. The intended parent would need to formally adopt the child in accordance with the law of the child's country of usual residence and must meet additional residency requirements outside Australia before applying for the visa”.

  2. As case like this will take a long time to prosecute and to work out who was who in the Zoo.

    In particular, this will also test the integrity of the EIT and their endorsement of their members. That’s of course depending upon if the Engineer in charge of supervising the site was a qualified and certified member of EIT.

  3. I agree it has lost its way but I don't think it ever found it in the first place.

     

     

    Miraculously, when Thailand built Suvarnabhumi Airport there was very little loss of life. This was because AOT who were in control predominantly employed Multi-national construction companies to build the project.

     

    Thailand once had the concept of building things safely but after that mega-project it’s been a down ward spiral ever since. Now Thai developers want to build "cheap only" and sell "expensive" which in turn attracts hill billy Tenderers who have little regard for safe systems of work.  What goes around; comes around unfortunately.

  4.  Ultimately and sadly, the construction Industry in Thailand is unregulated and what laws there are never enforced by any authority until after incidents like this happen. This is a prime example of Construction industry that has lost its way and out-of-control. Time for the Junta to review this industry too including examine the very people who keep on financing these dodgy developments such as the banks who never carry out due diligence checks on the companies that build them.

    Whenever I see a law being upheld, makes me wonder why?

    Who ordered the judge to lock this guy up is my question.
    Get rid of that person and Thailand could move forward.

     

    I don't really understand your riddle or what your assuming. If this result had occurred or the case dismissed under either the Pheu Thai or the Democratic party then many would’ve claimed that the Judges decision was politically motivated or influenced. Then, this must be seen as a fair outcome in terms of justice served.

  7. Qantas....Thats what you get when Unions and over the top demands coupled with Regulations are in control....lol...maximum working hours exceeded. The Staff do very little even when they are supposed to be working....Qantas was good when REAL Australians ran the show, too late now....bye bye

     

     

    The mechanism that caused the grounding was a defective cooling system not the unions. One would conceive that this is consistent with perhaps an airline avoiding scheduled maintenance timelines to save on costs and management not having an immediate contingency plan to remedy the problem. This event clearly shows that Qantas is an overrated and overpriced airline.

       Most likely they were gassed. This happens quite a lot on campsites in France where crooks pump a gas into a camper van and then go in and relieve the owners of all their possessions. Can't understand why there aren't any CC Tvs on these trains.

     

    The Royal College of Anaesthetists believes that incident in France of alleged gassing of campers to be impossible due to the large volumes of gas required to be an effective agent in that sought of environment.   9. Hard to determine the actual cause in Thailand because the country does not have specialist’s in the area of toxicology or biological science.

     

    However, the last event similar to this was in January 2013 when allegedly two-three men drugged two staff of a Resort in Phuket and robbed the safe-boxes. Now that hired guns are trying influence change, better to eliminate the threat of death threats by shutting down the Thalang District Office Administration inclusive of the Cherngtalay Municipality (Or- Bor-Tor) since both these organizations have failed in their role of managing these areas effectively while at the same time having the privilege of impunity.

     

    By amalgamating all these districts into one on the island may also eliminate or minimize threat of greed and corruption against those who wish to maintain control over these organizations.

     

    Perhaps more so this is just wishful thinking on my part.

The problem in this circumstance is that the agency who provided the surrogacy services in the first place perhaps didn’t screen the surrogate mother correctly by conducting genealogy blood & DNA checks to assure the Australian couple that the risk of the mother giving birth to a child with a severe intellectual disability would be minimal.

    Take one look at the surrogate mother in this case and you’ll understand why. We all know that nepotism and the offspring that carries the down-syndrome gene can go back generations. So why didn’t someone provide an assurance that this wouldn’t happen? The answer is; exploitation of the poor by fly by night surrogate agency’s which is why the industry needs to be highly-regulated in this regard.

  12. In the end, the assailant boys behaving badly, if their charges against the victim are dismissed, will mostly likely be fined bht1000 each and barred from re-entering Thailand. However, there’s the issue of owing a duty of care to the victim in terms of the cost of hospitalization and facial reconstruction which could amount to Bht500,000.00+ in Samui. No wonder daddy had to fly in.

    Good to see, even under a benevolent/military-dictatorship, no one is exempt or immune from corruption detection.

    So far it's been very positive and I'm cautiously optimistic. The junta has investigated the source of wealth of politicians, and higher echelon police. I'll be even more optimistic when they start investigating the finances of the upper echelon military officials. The arrest of this general is a good start.

     

    The wealth of military officials in the upper echelons is usually only realized when a geek(unofficial 2nd wife) claims for share of an estate between the real wife a general in probate cases after they he has passed on.

    Questions are then embarrassing raised as to how generals amassed such fortunes.

    Hopefully lessons have been learnt from  those experiences in the past as we are now seeing today seen as a prevention measure.rolleyes.gif

I think the problem is that Thai teachers are not passionate about their job or pro-actively interested in helping their students in getting higher grades due to the small monthly wage they’re paid in most circumstances between 10-12,000bht per month. We attended a parents meeting for our a child and noticed that foreign teachers, obviously paid a higher monthly salary than their Thai colleagues, were more pro-actively engaged, knew about their weaknesses and strengths and cared more about their students in achieving higher grades in comparison to Thai teachers.

  15. So falkan what would the proper visa be? I am married but only by monks and no papers signed. Usually come in visa exempt as only here 26 days then back out 6 times a year. What visa applies? Visa on arrival? Cost of such visa?

    You are not married.

    There is no visa on arrival for Westerners. According to information here visa exempt entries will continue to be allowed, if that is not the case you will need a tourist visa with the related inconvenience.

    Indeed, technically "Callaway" is not really legally married under Thai law and living de-facto which in Thai makes difficult to prove that your living in a harmonious relationship.

  16. I'm a women. My husband is paying but I don't really want to give too much money for a dress that i'll wear for a few hours. I think i get get something much cheaper and still  be nice. I went at Thong Lo area the prices are to the roof. 

    Most Western Wedding dresses in Thailand are expensive such as those from Thonglor because most of them, if not entirely, are all imported from USA. 

     

    Predominantly western wedding dresses are hired.

     

    Thai people don’t normally marry in such attire which explains why there is hardly any tailors here that specialize in this area.
