Ive got details of the transfer and details from the debtor of specifically what the funds were used for, all detailed in email along with repayment plans and Monthly statements continuing also after payments have stopped.The quickest way to lose a Friend is to lend him money!
If he is a close Friend or Family, lend it with the intention that you will never get it back.
If he is not a close Friend don't lend it to him.
Without solid proof of this loan, or collateral to back it up, your chances of ever getting your money back is about Zero! So move on and mark it up as a Future Lesson Learned.
Not that any of the above is any use without a formal written agreement signed by both parties.
But even then i doubt this guy would pay.
Sometimes it takes an event to find out who your friends really are.

you lucky i was building large boat in oz with pommie partner 68ft to sail world it sleep 14 people 3 toilets etc
i left money to finish boat as came to thailand after awhile couldnt contact him he died his daughter came out from uk
she knew it was partnership and had papers on boat which she destroyed
put boat up for sale sold cheap when came back boat gone she gone 600000$ lost cant find her no papers happy hunting

Friends don't lend friends money......if they want to remain friends. Here there's no such thing as a loan between friends...it's a gift.
Its not a gift when as in this case we agreed that if the venture didnt work then he would still be liable to repay.
This guy left under cover of darkness, literaly. Left and also stole items on his way. Clearly pre planned. So is no friend of mine.
He deserves all he gets.

Unfortunately, I think this is one of those life's lessons learned situations. I had a similiar thing happened to me. I was in Thailand 4 years ago when I received a call from a friend of 35 years. He was desperate to cover some debts on his business and needed $100,000. I was returning to the USA the next week, so met with him and two other friends. I put up $40,000, my friends put up $30,000 each, with a pay on demand promissary note and a estimated repayment time of 6 months to each of us. 4 years later, he is now divorced, going through bankruptcy, unemployed (lost the business), lost his home to foreclosure, and I and my friends are out the cash. I am able to claim the loss on my taxes against income, so will recover about 25%. I and my friends honestly feel that he will attempt to pay us back sometime in the future, if he is at all capable. He is that kind of friend, but my loan fund is exhausted to anyone but family until and if I am repaid. The loss stung, but I would have regretted not attempting to help.
Well lets hope the <deleted>**er realises who his mates are. Or were.

unfortunately, I wish I have similar service here in Thailand, few people owe me big
time and the courts a re a joke and time wasting trying to recover money from
dead beats...
One time a few years ago some deadbeat broke into my Dads house and took his pension money from his trouser pocket while he was sleeping.
Police came, knew who the guy was but did nothing.
Two weeks later my Dad had his pension money returned and the thief was found naked tied to a tree. It was 15 below.
Funny thing karma.
Things like that seemed to happen a lot in my home town.

I understand lending a mate money with no written agreements...we've all done it, and I have been burnt too.
But I learnt why contracts are useful and necessary and can save you a whole lot of stress later. Even a simple agreement is useful.
You cannot sell the debt. You have no evidence of a debt. You cannot recover in Australia if you "lent" it in Thailand...especially with no signed agreement.
It's really up to you how far you are prepared to go to get your money back...and if you are not prepared to carry out your threats, best you let it go.
...and learn from it.
Its really down to the debtor as to how far he wants things to go before he starts paying.
Yes, i can take the loss but why should i?
If i had robbed a friend i would expect repercussions. Its something i would never do. but we all have different moral values.
Lesson learned, and sadly i would never loan money again. Even with a written agreement.

Lets face it, even if it was legally enforcable in OZ or Thailand, if the guy is determined not to pay or cant pay then very little point in chasing him.
Living a life on the run cant be much fun.
If i were in his position i wouldnt sleep too well.

The guy starts a business and wants 'the easy life'.
No wonder he failed.
Did he have a business plan? I am sure a bank manager asked (saw it or not) and refused to loan him a penny.
He would never get a loan from a bank, but as i say he has repaid smaller loans i have given him previously which i guess led me to trust him.
Without his record of repayment i wouldnt have loaned him anything near what i did.
As i say, its not really the money more the betrayal of trust.
No worries, im sure his day will arrive.

Almost every shop, corner store, and mom and pop shop in Thailand sells promissory notes. They cost five baht or less. If you had one of those you could sell the debt.
I always do them, even with fiends and relatives just in case somebody dies before it gets paid back. That's a win-win for everybody.

I think that would work in Thailand but hes fled to Australia, a wanted man in Thailand by many i doubt he will return.

Guesthouse is really right. In Thailand the Thais can feed on Thais and Falang. Falang can only feed on other Falang. Anytime it is a Falang and involves a request for money it's just a red flag. It's something about the country people come over to start over again and they just up using their resources and become desperate.

Indeed, the guy did want to get something going and had a dream of an easy life.
All hes really achieved is to cause chaos, make many enemies and now hes back to square one in the Sydney rat race, and is looking over his shoulder every second.
What goes around comes around as they say.
In my book, you cant do things like that to friends without repercussions.
His day will come.

The business still operates under Thai control. The guy was basically scammed but also took their side. Thai girl involved etc. A familiar story.
Hes admitted the debt, and made a few token payments so he could get out of the country in one piece.
I do know some of his friends and family who now see him in a different light. Hes far from Mr popular.
I wouldnt be keen to take it through the courts or indeed throw any more money at recovery, but selling the debt would sound like an option.
After that it would be nothing to do with me and i would just forget about it.
But i would certainly pay him a visit if i was in town. I doubt he will be back to Thailand, from what i can gather hes made a few enemies here and is flagged at immigration for taking goods from his apartment when he did his runner.
I thought i knew this guy, just goes to show you cant really trust anyone.

I am prepared to take the loss, however i can see the debtor at any point as i know his exact location.You're going to have to face the prospect of never seeing your money or the debtor again.
I very much doubt you could legitimately sell the debt without evidence of a loan agreement. If you manage to sell it to shady people and something untoward happens to the debtor or the shady people then it could be said that you had a hand in illegal activities and possibly worse.
You've been done and that's about it, I'm afraid.
He would perhaps be better off if it were a third party dealing with collection rather than myself for obvious reasons.
A bad business deal is one thing and can be written off, but a friend ripping off a friend who trusted him is way different.
After all it could be anyone of his creditors that pays him a visit. Im sure im not the only one.

Now i know ive been pretty stupid loaning a "friend" 900,000 baht for a business venture in Thailand. Ive known the guy 10 years, loaned him money before but never this amount and always been repaid.
He has basically fled the country saying he aint paying.
I can take the loss but it is more about the betrayal of trust now.
Has anyone dealt with such an issue before? PMs are welcome.

Been coming and going for years on visa exempt and tourist visas, single, double and triple entries.
I was questioned exiting last week at swampy and just explained that i have a partner and family here and that i do contract work away for various periods of time.
I showed him my work permits for other countries and he just waved me on. After pocketing 500 baht for my 1 day overstay that is.

You should be able to get another entry by air but you may asked some questions on entry., It would be advisable to have a ticket out of the country within 30 days of arrival.
If you plan on staying here much longer it would be best to go out for a tourist visa.
If he doesn't have an onward ticket within 30 days, absolutely no Airline will let him check-in at his point of origin anyway
Not true,
I just flew in from Singapore, airline asked about onward travel but i just replied, no i dont have as im not sure where i will be going yet.
No questions and no issue at immigration.
