  1. Sorry Crikey. I hadn't seen your 2nd post when I posted. I must have opened the reply box a minute or 2 before you posted.

But, what on earth made me say you don't need a work permit? Let me say what others are thinking: CR*P ADVICE. For some reason I assumed your work did not involve Thailand and you just wanted to live, and commute from, here. OK do preparation, reports and the like but not something immigration would be excited about.

I repeat however that getting an investment visa is easy peasy.

I agree 100% with Auto units advice re work permit.

    But Whoooa....steady on singa-traz.

He is only liable to Tax on the INTEREST on the funds he transfers into Thailand if he is in country for 180 or more days in a year.

OK big deal how much is that going to amount to.

  2. Nignoy,

Please forgive me. I'm sorry I implied you were an Australian. I understand your ire. I can think of no greater insult.

Serious point. British forces in Isaan 62-66 is something I need to read up on. But why would you need British government permission to hold a reunion?

  3. Crikey.

    Easy peasey

Following lifted from Imm Bureau website

Application for extension of stay of persons investing a minimum of 3 million Baht in the Kingdom

Evidence of transfer of at least 3 million Baht from abroad into Thailand. The applicant must be either the sender abroad or the recipient in Thailand of the investment.

Evidence of investing the transferred money after the transfer is completed in one or several of the following cases:

Deposit the money in a fixed account of a state bank (Krung Thai Bank, Government Savings Bank, Bank for Agriculture and Cooperative, Ratanasin Bank, Srinakhorn Bank, Nakhornluang Thai Bank, Housing Bank)

Buy bonds issued by a state agency or government enterprise. The bonds must be purchased directly from a state agency or government enterprise or an authorised dealer.

Buy an apartment or condominium at the price set and registered by the Land Department.

Any kind of investment deemed beneficial to the country by the Immigration Bureau.

    That's it folks! Easy

Investing in Gov bank probably best option. P*ss poor rate of interest but I expect you can live with that.

Don't buy condo until you are satisfied you will be happy here. Rent. Maybe you'll change your job. Not always easy to resell.

A work permit is permitted with this visa BUT from info you provide you won't get one or need one and even if you did you'll be in and out the country a lot so who'd know and who'd care.

Tax - forget it. You're not working here are you. Tax break - forget it.

Lastly if going for bank deposit save your money and forget forget lawyers.

You could come on consecutive tourist visas but eventually you could be denied one. You don't want or need the hassle. And if you regularly travel outside Thailand you'll use up your entries in no time.

  4. My apologies for those who are thoroughly bored by all this.

Section 34 of the Immigration Act (published on many sites) concerning temporary stay in the kingdom does not refer to support for or by a Thai spouse, but Clause 15 refers to

Other activities as prescribed in the Ministerial Regulations.

A sort of catch all which probably also encompasses retirement.

So we (I) need to read the ministerial regulations. Many Ministerial Regulations are published on the internet by academic and business organisations but I cannot find links to Immigration Regulations.

    Any hackers out there.

The Law refers throughout to Aliens and nowhere makes a gender distinction. But that proves nothing.

  5. Yes. One visa.

Mine had printed: Good for......journey(s) to Thailand. One, two, or three to be handwritten in as applicable. The issue date and utilize by dates are also written in. The writing was inserted by consular staff I hasten to add. I only used 2 of 3 permitted entries on first visa and I have used 2 of 2 entries on my second visa which has not been overstamped USED: I think it should have been.

  6. Old man River.

The dual national would not apply for a visa.

Read Rimrada's post. His wife travelled with two passports in diffent names LAST WEEK

    Lopburi,

Misspelt mane on a ticket is a seperate issue. If one of dual nationals 2 passports is correctly showing the name on the ticket why should there be a problem?

5 years ago, well before 7/11 I and my "wife" went to BKK to Hong Kong. Gulf air. Her last name is Yooram. The ticket said YoUram (it was my fault).

Check-in denied her boarding but to be fair they then made a phone call (I think to Thai immigration) and relented with a don't do this again. On return from Hong Kong absolutely no problem. (I recall that at return check-in a young Thai lady had excess baggage. We only had hand baggage and were asked if we would check 2 bags through for her. Check-in agent said OK. I said NO WAY which angered my wife).

  7. Kronberg,

Before I start. I am currently partially confined to barracks (apart from unwelcome visits to the dentist and even less welcome visits to immigration) whilst recuperating from an illness. I share this with you in case anyone is wondering why an avalanche of posts from me, a newbie. You can get hooked on issues raised in this excellent forum.

I don’t quite understand your point, but here, for my benefit, is a summation of the issue.

If a Thai man has a Foreign wife she can obtain an extension of stay on the basis he is supporting her. Strictly speaking he obtains the extension on her behalf and neither have to provide evidence of income/savings (so how does he support her? Maybe he has wealthy relatives). Anyway as always immigration have the discretionary powers to request more documentation.

Ignoring the specific circumstance of the OP this thread raises 3 simple but fascinating questions. (a) Does the law apply equally to a Thai woman with a farang husband; (b)if NO, does it apply but with conditions; © if NO or if the law is ambiguous are there sex discrimination laws which can be applied to force imm. to treat men and women equally

In the OP’s specific case there is an easy and unlitmately cheaper solution. Transfer money abroad and then have it transferred back into hubbies bank a/c and then he can get an extension based on supporting her. She has already hit a brick wall but my guess is if she wants to be a womens rights campaigner and persevere she will ultimately succeed after incurring large legal costs. She appears to have the determination for it.

However, and again for my benefit, to clarify my conjectures and opinions on the legal issues raised:

It is cetainly understood that if a foreign man is married to a Thai it is he who must demonstrate that he is supporting her and visa/extension conditions reinforce this understanding but that doesn't make it law.

I imagine the law is amiguous . It would not have been drafted with this situation in mind –woman supporting the man –not in Thai culture. So it wouldn’t specifically say NO to (a) and therefore would not include any conditon to satisfy (:o.

Just imagine the consequences if the answer to (a) is YES. Every penniless reprobate would be heading to Thailand (those few that aren’t already here) to grab himself a Thai wife? So even if a court found in favour of (a) the government would block it. It would have to.

Unambiguous sex discrimination laws –oh yeah!

My guess is that Immigration may permit an application to succeed on compassionate grounds e.g. someone has lived and worked here for years and suddenly because of age or circumstance finds themselves unemployed. He has no income/money but his prudent wife has saved some or she has relatives who would support them. (However Imm, would be more likely to give/extend visa based on his support for a Thai wife and ignore the income requirements –and upon reflection this was pobably the situation in respect of a real situation I gave in a previous post).

I make no apologies for trying to continue this thread. I hope someone out there can give authoritative, evidence backed, answers.

    .

  8. I think the notice said 26GBP. Anyway I was charged 1763THB, outrageous.

Yes you are required you show evidence of income. I showed a letter from occupational Pension provider issued in May after I got a cost of living rise. My feeling is they would be pretty relaxed about the form of evidence. hel_l, I could have produced the letter on this computer. I suppose they may make random checks...who knows.

  9. Simbo,

Isaan is full of something......thats for sure.

And before anyone is roused to anger and protestation, my future mother in law comes from Buriram so I'm allowed my opinion....

Sorry Ray23, no boxing match. I wouldn't want to give said mother in law the satisfaction of see my bruised and battered face. :o

  10. Syd, me again.

Sorry, I didn't read Moogs post.

Yes his suggestion is an option. However you'll need to check ticket conditions. It is not "obvious" or even certain that you can change the return date. Some tickets: no; Some: once only; Some: cannot bring the return date forward; Some: first change free, then a fee; Some: a fee each time.

And even if you do change it there is no guarantee there will be a seat available when you try to change back. You could just end up having to buy a new ticket from BKK or shorten your holiday.

Good luck. Let us know what transpires after your hols.

  11. OK. No problemo.

In UK buy a one way full fare refundable ticket using one of the many airlines that fly BKK - SIN and show it to check in staff if requested. Get a refund on return. (Can do online but a refund can take an eternity). Alternatively get a cheapo online with Airsasia to KL or SIN (trawl site for the cheapest - may get for 30-40GBP). OK, you'll lose your money but get peace of mind. Think what you'll lose if you are denied boarding.

I really can't say if you will experience a problem.

  12. Excellent question.

    Don't see a problem.

Travelling betwen Thailand and US on dual passports is commonplace: Legally US to enter/leave US; Thai to enter/leave Thailand. So the only issue is having 2 names'

The only proof (until issue of biometric passports) that you are who you say you are is the passport photo. So if the photos in both passports are clearly similar it should be adequate evidence that John Smith and Somchai Wattana are one and the same person. Having said that best advice is get to the airport early.

Actually Somchai Wattana was or is director of Thai Gov employment dept (true) so he would probably travel on a diplomatic passport. I bet it will cause a bit of a stink that a senior govenment official/minister is also an adopted US citizen. You're not his secretary making discrete enquiries are you Mr Lostnoon - trust us here. We are very discrete. :o

  13. OK,

Lets look again in more detail.

If you enter Thailand without a visa you can be required to show a ticket out of the country within 30 days.

Will you be asked to show that ticket upon arrival. Pound to a penny if you are from a western country. NO.

Will the check in staff query your return date. I have no idea.

Now you go to immigration and ask for an extension for 4 days. Yeah, normally easy to obtain (but discretionary) and what does OP say when he has to state reason? Because I brought a ticket for 34days. They'll love that. Extensions are normally permitted for circumstances that arise during the 30day stay - so OK he could lie.

Or he could overstay for 4 days, pay small fine. No problem.

YES. OP probably would be fine.

But why take a chance. What possible point. So my advice stands GET A VISA. Then OP need have no worries. And the fact he has posted here shows that he is a little worried.

  14. Maestro,

My Holmesian deductive skills suggest Morbius obtained his visa in Paris and Andym928 in Denver. I have confirmed this by reading their posts. I'll leave it to you to obtain copies of the appropriate visa forms.

By the way it ain't only the forms you read but also the guidance notes. You have quoted HULL, although I don't see the relevance. Hull provide a downloadable letter for you to complete giving the name and address of a guarantor.

Anyway, if people beat the system good on them.

  15. A word of warning. There are reports in this forum that Immigration are rejecting downloaded TM7s. If you do print remember to print on both sides of a single sheet.

Despite what Maestro says there are very reliable reports that extensions are being issued "on the spot". If you are given an under consideration stamp no need to worry.

  16. Nignoy,

Why are Isaanites so sensitive to criticism of their chosen place of internment. Methinks you protest too much. Sounds to me you are trying to convince yourselves that it is a great place to live.

Still if you come from Australia, the contrast it may well be exciting to colonials

And woweee....a party in December. So soon. Didn't you also have one last December? :o
