    There are two main paths you can take:

    1. You can add a branch office and have Pattaya as the HQ and Bangkok as the branch, when it comes to applying for your extension, you can extend from the Branch office (Bangkok), but you would then have to show 8 Thai employees (4 in Pattaya and 4 in Bangkok).

    2. The other option is to relocate the HQ to Bangkok from Pattaya

    With this path you have two options:

    A.. Return your current work permit and apply for a new one from Bangkok (government fees will be at max i.e. 3,100 Baht plus you will need to provide an entirely new set of documents just like applying for a new one).

    OR

    B. Keep the current work permit booklet, file for a relocation of the company's HQ (govt fees approx 1100 Baht) but if you let the Pattaya Labor Department handle the transfer then it can take up to two months to complete OR hand carry the file to Bangkok (100 Baht to the Labor office in Pattaya and 1000 baht in Bangkok to submitt he relocated file)

  2. Thai law requires that if it is unsure if your consumers are Thai nationals or if they are based in Thailand or elsewhere then you will need to pay VAT. So, for example, if you were to sell DVDs and export them all overseas, with it obvious there are no sales in Thailand, then you could avoid paying the VAT.

    However, because people will be downloading online (or over their mobile) then they could be anywhere in the world, including of course, Thailand and so the government does require you or the consumer to pay the 7 % VAT.

  3. I agree with the previous poster, you must have a one year extension of stay based on your job with a multiple entry re-entry permit.

    You cannot transfer a work permit to company B from company A which this visa is based on but you can add a work permit location to your existing work permit. This way if the company A cancels your work permit, your work permit is still valid because of company B

    The extension of stay is then not cancelled as you still have a work permit with company B.

    However, as you said the extension is coming up and it takes ten days to add a second work permit to the existing one, you would also have to get approval from Company A and since you are leaving in two weeks they would most likely drag their feet with the letter or refuse to cooperate entirely. Every case is different but we have to talk in generalities.

    If company "A" was cooperative and you were our client we could try asking the Labor department a favor. But as it stands at this late date you will need to travel outside the country and obtain a new non-B, return and get a new work permit and new extension of stay with a re-entry permit.

  14. For a lease agreement to be valid, it would be based on mutual agreement between the 2 parties. That is the Land Owner/Lessor/Landlord and the Tenant/Lessee (how you would want to term them). No matter if your landlord is a Thai with an English speaking spouse, she is still considered as a Thai.

    If your agreement was made only in English and there were a breach of the agreement, and the case ended up in court, the agreement would still have to be translated into Thai.

    It is a good idea to have a bilingual agreement (Thai and English) to avoid any misunderstanding of the content then the claim that he/she did not understand the English or you don’t understand the Thai could not be made.     If you are selling items over the internet, ie operating a retail business online, then you really need to open a limited company. However, in our experience in dealing with the Labor Office, they have told us they do not have a problem if you run a simple internet business that does not involve sales of goods out of your home.

    Legally, if you are working in Thailand then you do need to set up a company and hire Thai employees. You don't say what nationality you are but if you are American you may want to consider setting up an Amity company which would allow you to hold the majority of shares and retain full control of your company, If you are not American then it is possible to structure the shares in such a way that allow you to still hold control but not have majority shares.

    Depending on what structure you go for you will need 2-3 million baht in registered capital and four Thai employees. Once the employees have worked for you for one month you will be able to apply for a work permit. You will need to obtain a non-B visa, which you can do with your company paperwork once it is set up.
