  9. Normally severance is due only after the employee has worked there for more than 120 days. Over 120 days but less than one year a month's salary is due as severance.

    However, as the employer you are required to give notice on termination of at least one pay period. This can be up to one month, depending on how often salaries are paid, but it can also be one week if salaries are paid weekly for example.

  10. If you pool together and buy the building and land with a Thai investor under a Thai company then you would control the Thai company. When the thirty years is up then the Thai Ltd Co would just grant another 30 years.

  12. The requirement is that you have four workers and that you pay them a minimum of 9000 Baht a month. There is no requirement as to how many hours they work. If you want four part time employees that is acceptable but they still must be paid 9000 Baht a month each as well, of course, as pay into the social fund on each one.

    You can own or be a director,signing or non signing, without a work permit as long as you are not working inside Thailand. If you are a signing director and need to sign documents without a work permit you must be outside Thai borders when you sign as you have no work permit and this is considered working The date of the document and your passport exit stamp from Thailand would be the evidence you need to show that you did not violate that condition.

  13. You don't mention what kind of shareholder set up you have currently, do the other shareholders have preferred shares for instance. It is possible to add other shareholders but it would dilute your shares since you own 49% and the company must be majority Thai owned. Changing the majority shareholders could be problematic, it would be best if you could come into our offices with your company paperwork so that one of our lawyers can look it over.

    In Bangkok at least they are very strict and will be meeting these employees. They want to make sure you are not doing what you are trying to do.... possibly lay them off after you get the work permit. They will not be happy at the social fund office as its expected that you pay into the social fund on these employees.

    The questions asked to each and every employee will be questions like this

    What does your Boss look like?

    What is your Boss name?

    When is the last time you saw your Boss?

    When do you get paid?

    How do you go to work? What is the route you take?

    What kind of work do you do?

    The employees can be part time but they must get a salary of 9,000 minimum per month.

    In rare cases, exceptions will be made in the first year depending on the business objective for example, if its exporting. We have petitioned and obtained two work permits with four Thai employees( actual case last week) but we can offer no guarantees.

    It should be pointed out that this was not a simple or easy case of overstay of someone who could leave on the same passport they entered on. First of all our client had a new passport with no entry stamp. In order to clear immigration you must show the entry stamp transferred into the new passport. This is the step that gets most people in detention, offering cash under the table is not a good idea to get around this.

    You need to go to Immigration to get the new stamps and the main office is much stricter than the airport. However, our advisors had her wait outside while they talked to the Immigration officers and they were warned if they brought her inside the office at immigration she would be arrested. That's why they could not transfer the stamp. They had to convince the officer to call the airport to allow her to show the old passport with the entry stamp there. The odds are very high, that Farlang 2012 would have been hassled and possibly arrested because of the almost 3,000 day overstay if our advisors had not gone as well.

    The process went as smoothly as if you had just a 40 day overstay with a valid passport and entry stamp as we had cleared the process beforehand and the officer was waiting for you. Otherwise, they would not let you on the plane but would have sent you back to Immigration. If you are to be deported, this is where it happens.

  18. Hi Dazzler, It is possible for you to come to work in Thailand short term, let me address each of your questions.

    1. You could work on a contract basis however the Company must assist you in acquiring a Work Permit. It should be noted that when applying for a Non Imm B (Business) Visa as well as a Work Permit in Thailand Company documents must be provided to meet the application requirements. If you get an assurance from the Company that they would help you in the application processes then there should be no issue with accepting the contract from the company. Please note that even you have successfully obtained Non-Immigrant B visa, this does not allow you to legally work in Thailand, but you will need it for the work permit application.

    2. Again, as services are carried out in Thailand, you would still need to have a work permit to be able to work in Thailand legally. If this Thai company refuses to help you with both the Non- B visa and your work permit you should consider establishing a “Representative Office” or Regional Office” of your offshore company in Thailand.

    3. You could set up a Representative Office in Thailand but it is important to note that the office must not earn revenue in Thailand. It can engage in such activities as

    • Sourcing goods or services in Thailand for a Head office.

    • Checking the quality and quantity of goods purchased or manufactured in Thailand.

    • Giving advice regarding goods sold to agents or consumers

    • Information regarding new goods or services.

    • Reporting and analyzing activities

    And finally 4. We do offer a service where we Sponsor our clients in applying for a Non- B Visa at a Thai Consulate or Embassy abroad. The non-B would allow you to come to Thailand to explore employment and investment opportunities.

    Depending on which Embassy or Consulate you make the application at, you would receive either a 90 day Visa or a 1 year Visa. We have found Asian and European consulates and Embassies give the single entry visa.

  19. Due to the brief information provided, please note that we can only provide information based on a simple scenario.

    Once the court has decided that this court case is a Criminal Case, as the Accused you can appeal against the court order, you can challenge and deny the charges against you. If you appeal and the court decides that this is a Criminal Case, your status will now be listed as the Defendant and you would not have the right to go to the Supreme Court to challenge the order. You would now need to be bailed out of jail so that you would be able to seek further information, witnesses, proof and evidence to disprove the charges.
