  1. We want to employ 10-20 Native Norwegian speaking peoples to work with telephone sales from here in bangkok. Is there anyway to do this without the need to have 2m baht and 4 thais employed for every foreigner???

    Will it make any different if whey gets their salary in Norway??

    I have heard that an export company can hire foreigners with only the 2m baht but not need to hire any thais. Also that the company only have to show 500k baht and not 2m baht. We can show 5m baht if necessary but not 20-40m baht.

    Can they be hired as specialist? It is hard for us to find Norwegian fluent speaking thais.

  2. 30K per month is ok with the Labor Dept and why you were approved for a work permit. It also was ok for the one year multi entry visa. However if you are applying for an extension of stay based on business, Immigration inside Thailand has much stricter conditions than the Labor Dept. It still is legal to get the visa outside Thailand and have your work permit correspond to it.

    So what you are telling me is IF i chose to have salary of 30k/m first year (accepted minimuma salary as you admit above) - im not alowed to apply for an extension of stay based on business and a higher salary following years???

  3. We do not have any revenue at all as we are doing research for a future production. All the money comes from our partner and my own savings. And we do not have any 1 million in thailand – Can this be problem?? How to solve??

    Immigration is giving some foreigners till November 2007 to meet the criteria for the extension of stay based on business. This may happen with you.

    But how can my past (2005) salary have anything to do with my new application?? I have fulfilled this year salary level. January to July I had 50k/m and for August to October 30k/m but to day, we changed that to 50k/m and also paid the tax.

    You need to show the PND 91 (Copies of the foreigner’s income tax submitted annually attaching a receipt (if any))

    This is expected to be matched with the minimum salary required for your nationality.

    I have PND 91 for 2548/2005 and it says 500 000bt and that was more than the 30k/m that was the minimum requirement for my WP/visa (with out any Extension Of Stay) at that time (100% export company)........

    I don’t get it.... I have fulfilled my obligations for 2005 more than well, and now it is a major problem…..

    How to inform the immigration officer about that 30k/m was the minimum requirement for me 2005???

  5. I tried to get an extension of stay today. My current expires 16’th of November 2006.

    The immigration officer told me that I had to have 50k in salary every month. According to her it was not ok if 30k one month and 80k next month. Correct or not??

    I have been told that with my 100% export Thai-company that I own to 99,994%, I do not need more than 30k per month in salary – but the immigration officer did not agreed. So now I have to raise the tax assessment for 2005 from current 500k to 600k and also raise my income for some month 2006. Is that really necessary??? 2005 I had a NI-B and did visa runs every 90 days and did not have any extension of stay until 17’th of November 2005…

    Were to find information about my type of company???? (100% export Thai-company own to almost 100% by farangs with 30k in salary)

    30K per month is ok with the Labor Dept and why you were approved for a work permit. It also was ok for the one year multi entry visa. However if you are applying for an extension of stay based on business, Immigration inside Thailand has much stricter conditions than the Labor Dept. It still is legal to get the visa outside Thailand and have your work permit correspond to it.

    By the way, its not just the salary criteria. You also need to meet the following criteria as well.

    Registered capital of no less than 2 Million Baht

    That business must submit their year end balance sheet which has been inspect and certified by a certified accountant. In order to show the financial status, stability and recognition of business. In overall the audit must show owner’s equity of no less than 1 Million Baht

    That business must submit their year end profit and loss account which has been inspect and certified by a certified accountant. In overall the total revenue must show an amount higher than the total salary and benefit paid the employee and

    That certain business has the necessity to employ foreigner

    That business must have a ratio between foreign employee to Thai employee of 1:4

    The officer said that everything looked good except for my salary. She suggested me to pay tax for the three months i only had 30 000 in salary this year (aug, sept,oct). But she also wanted me to change my income for 2005 from 500 000 to 600 000... Is this really necessary?? - I mean, I did not even had any extension of stay based on business at that time. I got it first at feb 2006....

  7. As long as you still have employment the same as before you should be able to extend your stay as you did 8 months ago. This is the normal yearly procedure that all those on extension of stay undergo but as you have no idea what papers are needed (or probably where they are located) you either need a good new secretary with knowledge or other help. You can talk with immigration and I am sure they will have a list of what you need but it may be better to have outside help in this case I suspect.

    Thanks all for your time. I have already asked one clerk to go to IMM tomorrow morning to sort things out. Yes i still have the same job - As long as i don't kick my self :o

  8. The 90 day is an address report so the next is due in 90 days if you do not leave Thailand. It does not allow you to stay here. What is the 13 November expiration date you mentioned in first post - that is a critical piece of information. But unless you have traveled overseas about one year ago and visited a Consulate to obtain a visa do not believe you have a valid visa so my above posts are null and void.

    Can you not visit immigration and obtain another extension of stay (which seems to be what you have), even if they can not give for the full year? Once you have that you can get your new passport and transfer the extension into it. You need to visit immigration yourself or have a legal service such as forum sponsor Sunbelt help you get paperwork in order for another extension of stay. From your posts I would highly advise having a legal service help you and it should be very cost effective compared with starting over (as it seems you were trying to do).

    It is only an address report. - Ok I understand.

    So the best way is to apply for an extended permit to stay.

    The second best is to do a in and out visa run before 13 of Nov 2006.

    To clarify:

    I did went overseas (Penang) to obtain my current ME-NI-B visa about 11 month ago. My second ME-NI-B.

    When I went back to Thailand, I applied for one year permit to stay. They gave me 3 month at the time during some investigation. After 6 month I got what I wanted – permit to stay without leaving the country. And I got the 16 Nov 2006 stamp in my passport.

  9. It is really hard to figure out what is going on with you - and believe that is why we can not answer. Why are you looking to put a visa in your old passport if you are getting a new one a week later and why are you asking about multi entry one year visas when you have been on extensions of stay?

    If you are out of a job how do you expect to obtain a non immigrant B visa of any type?

    If you are not out of a job why would you want a one year visa - why not extend as you have been doing?

    Why would you now have a multi entry non B and a one year extension of stay?

    Not understanding but if you indeed have a multi entry non B valid until Nov 13 and you re-enter the country before that time without a re-entry permit you will receive a 90 day permitted to stay stamp which would give you time to get your new passport and then decide what to do.

    A one year visa application requires a passport with 18 month validity.

    My secretary handles all my immigration issues earlier. But now she has disappeared. And no one else at my office does know how to solve this, thereof my post here.

    In my passport is a stamp saying I have to leave the country 16 November 2006. But on my last (got it to day) “90-days-report-paper” is stamped 30 January 2007. Does that mean I can stay to that day??? I always do my 90 days reportings by messenger so I had not the opportunity to ask the immigration officer.

    The visa run to get another 90 day was a good ide.....
